PC RES 1979-020i RESOLUTION P.C. NO. 79-20 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 41 WHEREAS, Robert Hansen has requested a variance for the construction of a 10 -foot high chain link tennis court fence within the side and rear setback areas on the property located at 4140 Lorraine Road, Lots 10 and 11 of Tract No. 8471; and WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held November 13, 1979 at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That such variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district, because there is no evidence of any similar situations that would justify this finding. Section 2: That the granting of a variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located, since there is no substantial evidence that such an effect would occur. Section 3: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby denies Variance No. 41. APPROVED and ADOPTED this 13th day of November, 1979.
