A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 40
WHEREAS, Ralph P. Galante has requested a variance for the construction
of a single family residence with a maximum total height of 34 feet 6 inches on
the property located at 30327 Kingsridge Drive, Lot 9, Tract 15809; and
WHEREAS, after notice issued pursuant to the provisions of the Rancho
Palos Verdes Development Code, a public hearing was held October 23, 1979 at
which time all interested parties were given an opportunity to be heard and
present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there are not exceptional or extraordinary circumstances
applicable to the property involved, or to the intended use of the property, which
do not apply generally to other property in the same zoning district, because there
are alternative building and site designs available to alleviate the height problem.
Section 2: That such variance is not necessary for the preservation and
enjoyment of a substantial property right of the applicant, which right is possessed
by other property owners under like conditions in the same zoning district, because
it is possible to construct a two-story single family residence on the subject
property while remaining within the limits of the Rancho Palos Verdes Development
Code.
Section 3: That the granting of a variance will not be materially detri-
mental to the public welfare or injurious to property and improvements in the area
in which the property is located, -since there is no substantial evidence that such
an effect would occur.
Section 4: That the concept of the proposed structure is contrary to the
objectives of the Rancho Palos Verdes General Plan, since construction of the resi-
dence would violate grading and visual character policies.
Section 5: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby denies Variance No. 40.
