A RESOLUTION OF THE PLANNING COMMIS-
SION OF THE CITY OF RANCHO PALOS
VERDES DENYING VARIANCE NO. 39
WHEREAS, Variance No. 39 has been filed, which requests that a
deck be allowed to exceed the maximum height for an accessory structure;
and
WHEREAS, the residence is located at 2333 Sparta Dtive, which
is in an RS -2 zoning district; and
WHEREAS, the Planning Commission has reviewed this matter at a
public hearing held on May 8, 1979, at which time all interested parties
were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE -PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1. That there are not exceptional or extraordinary
circumstances or conditions applicable to the property, or to the intended
use of the property, which do not apply generally to other properties in
the same zoning district since the lot is adequate in size, within the re-
quired setbacks, for the primary use of the lot. Further, the physical
characteristics of the property are not unlike other properties within
the vicinity and under identical zoning classifications.
Section 2. That the variance is not necessary for the preser-
vation and enjoyment of a substantial property right of the applicant
which is possessed by other property owners under like conditions in the
same zoning district because owners of other lots of similar size and with
similar physical characteristics are required to meet the height limit for
accessory structures.
Section 3. For the foregoing reasons, the Planning Commission
of the City of Rancho Palos Verdes hereby denies Variance No. 39, and when
the City appeal period lapses that notice of the above action be filed with
the County Recorder, stating that the deck is in violation of the City
ordinances and was constructed without permits.
