A RESOLUTION OF THE PLANNING COMMIS-
SION'OF THE CITY OF RANCHO PALOS
VERDES GRANTING VARIANCE NO. 38
WHEREAS, Variance No. 38 has been filed, which requests that
fence heights within the front and sideyard setbacks exceed the allowable
heights; and
WHEREAS, the residence is located at 31429 Marne Drive, which
is in an RS -2 toning distirct; and
WHEREAS, the Planning Commission has reviewed this matter at a.
public hearing held on April 24, 1979, at which time all interested parties
were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1. That there are exceptional or extraordinary circum-
stances or conditions applicable to the property, or to the intended use of
the property, which do not apply generally to other properties in the same
zoning distirct because lot configuration does not permit adequate outdoor
living area as is provided on other lots in the vicinity. High winds in the
back -yard limit usable outdoor living area to the front.
Section 2. That the variance is necessary for the preservation
and enjoyment of a substantial property right of the applicant which is
possessed by other property owners under like conditions in the same zoning
districts. Outdoor living area is limited and the variance will allow for
private outdoor recreation.
Section 3. That the granting of the variance will not be mater-
ially detrimental to the public welfare or'injurious to property and improve-
ments in the area in which the property is located. The variance is neces-
sary for the enjoyment of the property and the location of the wall is such
that it is not detrimental to the public welfare.
Section 4. That the granting of such a variance will not be con-
trary to the objectives of the General Plan. The wall insures privacy, a
stated objective of the City's General Plan.
Section 5. For the foregoing reasons, the Planning Commission of
the City of Rancho Palos Verdes hereby approves Variance No. 38 subject to
the dondition that the wall receives approval from Los Angeles County Build-
ing and Safety.
