A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES GRANTING A CONDITIONAL USE PERMIT

FOR THE CONSTRUCTION OF DORMITORIES FOR AN EDUCATIONAL
FACILITY IN AN INSTITUTIONAL ZONE
WHEREAS, Marymount Palos Verdes College has requested a conditional use permit
for the construction of a 54 -unit dormitory facility and dommon room, which are in-
tended to house students at the college, at 30800 Palos Verdes Drive East; and
WHEREAS, after notice issued pursuant to the provisions of the City's Develop-
ment Code, public hearings were held on October 24, 1978, and November 14, 1978, at
which time all interested parties were given an opportunity to be heard and to present
evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE -CITY OF RANCHO PALOS VERDES DOES
HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That the proposed dormitory structures are permitted in an institu-
tional zone, since they are part of and necessary to the function of the educational
facility, subject to a conditional use permit.
Section 2: That the site is served by Palos Verdes Drive East and a private
access road, bbth,:of which -are -designed to carry the type and quantity of traffic
generated by the proposed use.
Section 3: That the subject use, with the safeguards and conditions imposed by
this permit,will cause no significant adverse effects to adjacent properties or the
permitted uses thereof.
Section 4: That the subject use is in conformance with the General Plan which
designates the site for an institutional use.
Section 5: That, given the project's location, design, adjacent usesy and lot
configuration and size, the site is adequate to accommodate the proposed use.
Section 6: That based on the nature and location of the construction, and the
anticipated user characteristics, a variance request is not necessary to enable the
required parking spaces to be located at a distance greater than 300 feet from the
building it is to serve.
Section 7: For the foregoing reasons, the Planning Commission of the City of
Rancho Palos Verdes hereby grants approval of Conditional Use Permit No. 42, subject
to the conditions found in Exhibit "A", which are necessary to protect and preserve
the health, safety, and general welfare in the area.

EXHIBIT "A"
CONDITIONAL USE PERMIT NO. 42 IS APPROVED SUBJECT TO THE FOLLOWING
CONDITIONS:
1.
This approval expires twelve (12) months from the date of approval
by the
Planning Commission unless building permits have been applied
for.
2.
The grading plan must be approved by the Director of Planning
and
City Engineer.
3.
A geology and/or soil engineering report may be required prior
to
approval of
building or grading plans.
4.
Drainage plans and necessary support documents to comply with
the
following
requirements must be approved by the City Engineer;
a. Provide drainage facilities to remove the flood hazard to the satisfaction
of the City Engineer.
b. No building permit will be issued for the site if subject to flood hazard
until adequate drainage facilities protecting the site are operable as
determined by the City Engineer.
C. Eliminate the sheet overflow and ponding or elevate the floors of the
buildings with no openings in the foundation walls to at least twelve
(12) inches above the finished pad grade.
d. Provide drainage facilities to protect the site from high velocity scour-
ing action.
e. Provide for contributory drainage from adjoining properties.
5. The development shall be served by sewers, pursuant to the City Engineer's
requirements.
6. The Fire Department shall review the proposal and submit any comments or recom-
mendations to the Director of Planning prior to issuance of permits.
7. The owner of the property shall be responsible for the proper maintenance of
the improvements including the landscaping.
8. No occupancy permit shall be granted until such time as the Director of Planning
has determined that all improvements, including landscaping, have been properly
installed according to approved plans.
9. A landscaping plan, using the criteria shown in the staff report of November 14,
1978 (as amended), shall be submitted for approval by the Director of Planning.
Said plan shall include, but not be limited to, plant material, irrigation
system, and exterior lighting.
10. Final site and building plans must be approved by the Director of Planning.
11. All off-site illumination currently being generated by the campus must be
eliminated to the satisfaction of the Director of Planning.
12. The maximum ridgeline heights shown on the development plan shall not be ex-
ceeded.
13. Exterior building materials shall be submitted for final approval to the Director
of Planning.
14. Approval of the project is contingent upon a qualified archaeologist performing
a survey to determine the likelihood of any archaeological resources being present
on the site. The survey should include a "walkover" and records search. Should
the survey reveal no cultural resources, no further action would be necessary.
Should the survey reveal resources, the following procedure should be undertaken
prior to any grading:
a. Definitive tests should be conducted to determine the extent and location
of the resource.
b. If the tests are positive, the developer should be required to preserve or
excavate all cultural resources.
