A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES DENYING VARIANCE
NO. 33
WHEREAS, Frank Brow has requested a variance for an encroachment on
the City's thirty (30) foot height limitation on property located at 3577
Bendigo Drive; and
WHEREAS, after notice issued pursuant to the provisions of the City's
Development Code, a public hearing was held September 12, 1978, at which
time all interested parties were given an opportunity to be heard and pre-
sent evidence.
NOW, THEREFORE, the Planning Commission of the City of Rancho Palos
Verdes does hereby find, determine, and resolve as follows:
' Section 1: That there are no exceptional or extraordinary circum-
stances which would allow the Planning Commission to grant the variance.
, Section 2: That the Planning Commission cannot identify any prop-
erty right possessed by others finder like conditions, which right the
applicant would be denied, because the same footprint and square footage
is available with or without the clerestory. -
'Section 3: That approval of the variance may have an adverse effect
due to the loss of privacy to one neighbor and the loss of view to another.
' Section 4: That there would be no violation of any policy or objec-
tive of the General Plan should the variance be granted.
.Section 5: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby denies approval of Variance No. 33.
APPROVED and ADOPTED this 12th day of September, 1978.
