RESOLUTION P.C. NO. 78-38
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES GRANTING VARIANCE
NO. 26
WHEREAS, Frank Iacono has requested a Variance for a 12 foot tennis fence to
be located in the front yard setback on the property located at 30421 Miraleste Dr; and
WHEREAS, after notice, issued pursuant to the provisions of the City's
Development Code, public hearings were held on May 9 and July 25, 1978, at which time
all interested pa -ties were given an opportunity to be heard and present evidence.
NOW, THEREFORE, the Planning Commission of the City of Rancho Palos Verdes
does hereby find, determine, and resolve as follows:
Section 1: That there are exceptional or extraordinary circumstances or
conditions applicable to the property, or to the intended use of the property,
which do not apply generally to other property in the same zoning district for
the following reason:
This property is a flag lot and access is restricted through the
subject portion of the property.
Section 2: That the variance is necessary for the preservation and enjoyment of
a substantial property right of the applicant, which is possessed by other property
owners under like conditions in the same zoning district because the City has
allowed similar fences in other circumstances and it is necessary to have a fence of
this height in order to enjoy the tennis court.
Section 3: That the granting of the variance will not be materially detrimental
to the public welfare or injurious to property and improvements in the area, as
witnessed by the signatures of neighboring property owners which the applicant
received; said fence is also necessary to prevent balls from going into the
roadway.
Section 4: That the intended use is not contrary to the objectives of the
General Plan.
Section 5: For the foregoing reasons, the Planning Commission of the City of
Rancho Palos Verdes hereby grants approval of Variance No. 26, subject to the conditions
listed in Exhibit "A".
