A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES
GRANTING VARIANCE NO. 30
WHEREAS, Mr. John Wiggins has requested a Variance to permit an existing
City and County approved deck structure to encroach five (5) feet into the required
side yard setbacks (5'-0"), for the property located at 7270 Berryhill Drive; and
WHEREAS, after notice, issued pursuant to the provisions of the City's
Development Code, a public hearing was held on June 27, 1978, at which time all
interested parties were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES
DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there has been an administrative error made on the City's
part and that there would be practical difficulties and unnecessary hardships
created through removal of that portion of the deck in violation which would not
result in any material benefit to the City or adjacent neighbors. The expense
involved with removal of those portions of the deck in violation would also place
an undue burden upon the applicant. Therefore, this Variance is approved subject
to the following conditions:
1. Any future physical alterations to the deck (i.e., any increase in its
size) would require that the deck be brought into complete conformance
with the Code by removal of those portions of the deck which are en-
croaching into the side yard setbacks.
2. An adequate landscaping plan for the rear of the deck be submitted by
the applicant for approval by the Director of Planning.
