PC RES 1977-024RESOLUTION P.C. 77-24 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES GRANTING A VARIANCE FOR THE ENCROACHMENT INTO AN INSTITUTIONAL ZONE REAR SET- BACK WHEREAS, the Palos Verdes Community Arts Association has requested a variance for the construction of a trellis patio cover in an institutional zone; and WHEREAS, after notice pursuant to the provisions of the City's Development Code, a public hearing was held on December 13, 1977, at which time all interested parties were given an opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property, which do not apply generally to other property in the same zoning district in that there is no other practicable method for expansion on the subject site because of lot configuration, slope characteristics and existing easements. Section 2: That such variance is necessary for the preservation and enjoy- ment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district since strict application of the Development Code deprives the subject property of privileges enjoyed by other property in the vicinity which is also located in the same zone. Section 3: That the granting of the variance will not be materially detri- mental to the public welfare or injurious to property and improvements in the area in which the property is located. Given this circumstance, the --subject improvement will not in any way impact properties located upslope or adjacent to the subject site. Section 4. That the granting of such a variance will not be contrary to the objectives of the General Plan. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes does hereby grant to the Palos Verdes Community Arts Association a zoning variation to encroach into the rear setback for said usage.
