A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES GRANTING A CONDI-
TIONAL USE PERMIT FOR A RESIDENTIAL PLANNED
DEVELOPMENT IN A RS -2 SINGLE FAMILY RESIDENTIAL
DISTRICT.
WHEREAS, Urban West Communities has requested a conditional
use permit to allow thirty-one lots and three common lots, in a resi-
dential planned development, on a 17.1 acre site located to the
south of St. John Fisher Church and abutting Crenshaw Boulevard,
with subject site falling within a RS -2 single family district;
and
WHEREAS, after notice issued pursuant to the provisions of
the City's Zoning Ordinance, a public hearing was held on April 12,
1977 at which time all interested parties were given an opportunity
to be heard and to present evidence.
NOW, THEREFORE, the Planning Commission of the City of Rancho
Palos Verdes does hereby find, determine,�and resolve as follows:
Section 1. That the proposed residential planned development
is permitted in the RS -2 district, subject to the issuance of a
Conditional Use Permit.
Section 2. That the 17.1 acre site located to the south of
St. John Fisher Church and abutting Crenshaw Boulevard is adequate
in both size and shape to accommodate 31 single family detached
units in a residential planned development and for all of the
open space requirements, private outdoor living area, landscaping,
and other features required by the City's Development Code or by
conditions imposed in this permit.
Section 3. The proposed residential planned development is
not contrary to the General Plan and said conformance has been
insured by site design considerations and landscaping plan re-
quirements, which are conditions of this permit.
Section 4. That the residential planned development will
locate its point of ingress/egress to obtain access from Crenshaw
Boulevard, which is properly designed to carry both type and
quantity of traffic generated by said project.
Section 5. That given the project's location, site design,
and conditions imposed through this permit, the granting of this
conditional use permit will not adversely affect the peace, health,
safety or general welfare of the area, nor will it be materially
detrimental to property values, jeopardize, endanger or otherwise
constitute a menace to the public health, safety and welfare of
persons or properties in the surrounding area.
Section 6. That the Planning Commission does hereby certify
that the Final Environmental Impact Report has been completed in
compliance with the CEQA and State Guidelines and that the Ccm.ission
has reviewed and considered the contents of the report in reaching
its decision. The Commission further finds that the approval of
this conditional use permit will not have a significant adverse
environmental impact, because grading has been minimized, steeper
slope areas left open to be maintained by the owners, drainage has
been adequately planned for, and other issues mitigated as discussed
in the Environmental Impact Report.

EXHIBIT "A"
Conditional Use Permit #28 is approved subject to the following
conditions:
1. Said residential planned development shall conform to develop-
ment standards listed in Chapter 1, Part 3, Section 9133.
2. A homeowners association shall be formed which complies with
Chapter 1, Part 7 of the City' s Development Code.
3. A declaration of covenants, conditions, and restrictions shall
be approved by both the City Attorney and Director of Planning.
4. The homeowners' association shall be responsible for maintaining
the abutting public parkway along Crenshaw Boulevard.
5. Prior: to issuance of a building or grading permit, and prior
to approval of a final map, a bond, or other acceptable security
shall be posted to ensure the completion of all common area and
off-site improvements within any Workable Phase of the Develop-
ment as per approved plans.
6. No occupancy permit shall be granted for any structure and
no parcels, lots or portion of a Residential Planned Develop-
ment site shall be separately sold or encumbered, until ap-
proval of the Director of Planning, upon the finding that all
of the common area and off-site improvements in the Workable
Phase of which such structure, parcel, lot or portion as a
part are completed to the extent that the dwelling units are
accessible and livable, and all dwelling units in the Workable
Phase are substantially developed (all building walls covered) ,
as per the approved plans. A bond or other guarantee of sub-
stantial completion of all dwelling units in a Workable Phase
may be accepted by the City in lieu of substantial completion.
7. If construction has not been completed to the point of founda-
tion inspection for a unit within one (1) year, or if the Work-
able Phase has not been completed within two (2) years from
the date of final approval of the Final Development Proposal
for the Workable Phase, the conditional use permit shall expire
and be of no further effect, and any final map for the sub-
division of land within such Residential Planned Development
or Workable Phase thereof shall become null and void, and the
owner of the property shall cause the subdivision to revert to
acreage.
8. A landscaping plan shall be submitted for approval by the
Director of Planning. Said plan shall include, but not be
limited to, plant materials (both proposed and existing) , walls/
fences, and exterior lighting. This plan will be evaluated for
its effects on adjacent properties and visual appearance from
Crenshaw Boulevard. Plant materials should be selected which
do not require permanent irrigation and possess fire retardant
characteristics.
9. No more than 31 single family detached dwelling units shall be
permitted.
10. Final building and site plans, including elevations, shall be
submitted to the Director of Planning for approval.
11. Approval of this conditional use permit is subject to the
approval of Tentative Tract Map No. 31714 by the City Council
without substantial changes or modifications hereto.
