A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES GRANTING VARIANCE NO. 5
WHEREAS, Mr. William Hauf has requested a variance to permit a single
family residence to encroach five (5) feet into a required ten (10) foot
front yard setback and five (5) feet into a required ten (10) foot rear
yard setback, for the property located at 7449 Via Lorado; and
WHEREAS, after notice, issued pursuant to the provisions of the City's
Development Code, public hearings were held on April 13, 1976, January 11,
1977, and January 25, 1977, at which times all interested parties were
given an opportunity to be heard and present evidence.
NOW; -THEREFORE, the Planning Commission of the City of Rancho Palos
Verdes does hereby find, determine, and resolve as follows:
Section 1: That there are exceptional or extraordinary circumstances
or conditions applicable to the property, -or to the intended use of the
property, which do not apply generally to other property in the same
zoning district for the following reasons:
a. The orientation of the lot and of the proposed structure is
consistent with the orientation and character of adjacent
lots and structures.
b. The orientation and slope of the lot is such that the struc-
ture is best suited for the proposed location within the lot.
Section 2: That the variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant, which is
possessed by other property owners under like conditions in the same zon-
ing district, in that the proposed structure is oriented in a manner whith
is similar to adjacent structures.
Section 3: That the granting of the variance will not be materially
detrimentaltothe public welfare or injurious to property and improve-
ments in the area save the proposed structure is oriented and located so
that view obstruction is minimized.
Section 4: That the intended use is not contrary to the General Plan.
Section 5: For the foregoing reasons the Planning Commission of the
City of Rancho Palos Verdes hereby grants approval of Variance No. 5.
