PC MINS 20000627Approved July- 1, 2000 CITY OF RANCHO PALOS VERDES PLANNING COMMISSION REGULAR MEETING JUNE 27, 2000 CALL TO ORDER Vice Chairman Clark called the meeting to order at 7:00 p.m. at the Fred Hesse Community Room, 29301 Hawthorne Boulevard. FLAG SALUTE Assistant Planner Smith led the'assembly in the Pledge of Allegiance. ROLL CALL Present: Commissioners Cartwright, Long, Mueller, Vannorsdall, and Vice Chairman Clark Absent: Commissioner Paulson and Chairman Lyon were excused Also ptesent were Director of Planning, Building, and Code Enforcement Rojas, Assistant Planner Smith, and Recording Secretary Peterson. APPROVAL OF AGENDA There being no objections to the Agenda, Vice Chairman Clark approved the Agenda as presented. COMMUNICATIONS Director/Secretary Rous introduced Assistant Planner Smith to the Planning Commission Director/Secretary Rotas distributed a clearer copy of page 2 of the staff report for item No. 3 of the Agenda. He also reported that at the City Council meeting of June 21, 2000 the City Council approved the Landslide Repair Plan at Ocean Trails, which now will be heard by the Coastal Commission on July 12, 2000. Commissioner Long reported that he had received a mailer from Marymount College inviting him to an informational meeting regarding their proposed expansion. He asked if there was a policy on whether Planning Commission members should attend such meetings. After discussion among the Commissioners, they felt that attendance to such meetings was acceptable as long as the Commissioners attended as a private citizen and not as a Planning Commissioner Director/Secretary Rojas also stated that in the Policies and Procedures there was a statement included saying that the Commission does not encourage the receipt of information or evidence outside of hearings. He felt that the Commissioners must share and disclose any information received at the meetings at the time of the Planning Commission meeting CONSENT CALENDAR 1. Minutes of June 13, 2000 2. Planning Commission Rules and Procedures — Resolution The Planning Commission approved the Consent Calendar, as presented, (3-0-2) with Commissioner Vannorsdall and Vice Chairman Clark abstaining since they were absent from the June 13, 2000 meeting. Lois Larue 3136 Barkentine Road asked the Planning Commissioner to tell the City Council members that the community does not want the development at Abalone Cove and asked staff to re -think the geology of the area. Commissioner Long expressed concern that members of the audience should not be allowed to discuss projects that were not on this agenda but were pending a hearing before the Planning Commission. Director/Secretary Rojas agreed that it would not be appropriate for audience members to speak on pending items, however he noted that the Planning Commission had already approved the Abalone Cove project PUBLIC HEARINGS 3. Variance No. 472: Mr. and Mrs. Robert Lewis (applicant), 28835 King Arthur Court Assistant Planner Smith presented the staff report. He explained that the application was before the Commission because there was a pending sale of the house and the applicant sought to legalize a past addition on the property He reviewed the findings made by staff, as presented in the staff report He explained that additions of this type are typically approved with a Minor Exception Permit, but that Minor Exception Permits cannot be used for after -the -fact construction. Therefore a Variance was necessary He explained that staff had made the necessary findings for the Variance and recommended approval of the project. Planning Commission Minutes June 26, 2000 Page 2 Commissioner Vannorsdall moved to open the public hearing, seconded by Commissioner Long. There being no objection, the public hearing was opened. Bob Lewis (applicant) 4 Palomino Lane, Rolling Hills Estates, stated that he was the former owner of the home He explained that the addition was built without a permit because the contractor told him at the time that a permit was not necessary. He stated that it was an error on his part and was requesting to legalize the addition. Bill Mack 28835 King Arthur Court stated that he was the new owner of the residence and requested Planning Commission approval of the request so that he can finish moving into the house Commissioner Vannorsdall moved to close the public hearing, seconded by Commissioner Long. There being no objection, the public hearing was closed. Commissioner Cartwright explained that if the Planning Commission approved the Variance then the applicant would still be required to meet all Building and Safety requirements, even though the addition is existing Commissioner Vannorsdall moved to adopt P.C. Resolution 2000-19, conditionally approving Variance No. 472, as presented, seconded by Commissioner Mueller. Approved, (5-0).
