JANUARY 9, 1996
After a ceremonial presentation honoring former Planning Commission Chairman Nick
Mowlds, the meeting was called to order at 7 10 P M. by Chairman Clark at the Hesse
Park Community Building, 29301 Hawthorne Boulevard The Pledge of Allegiance
followed, led by Nick Mowlds.
All members of the Planning Commission were sworn in by Deputy City Clerk Sara
Ferdman
PRESENT. Commissioners Albeno, Cartwright, Franklin, Ng, Vannorsdall, Whiteneck
and Chairman Clark
ABSENT NONE
Also present were Director of Planning, Building and Code Enforcement/Planning
Commission Secretary Bernard, Planning Administrator Petru, Assistant Planner Fabio
de Freitas, and Recording Secretary Drasco
SELECTION OF VICE CHAIR
Commissioner Whiteneck moved to nominate Commissioner Vannorsdall for Vice
Chair, seconded by Commissioner Alberio. There were no other nominations.
Approved, (7-0).
APPROVAL OF AGENDA
Commissioner Alberio moved to accept the agenda, as presented, seconded by
Commissioner Cartwright. Approved, (7-0).
COMMUNICATIONS
Staff-
Director/Secretary Bernard congratulated the new Commissioners on their appointment
and stated that he and Staff looked forward to working with them At the request of
Chairman Clark, he introduced the Planning, Building, and Code Enforcement Staff
who were present at the meeting Director/Secretary Bernard mentioned that there
were three brochures provided to the Commission regarding training sessions which
might be of interest He also noted that there had one piece of late correspondence
provided to the Commission regarding Item No. 3, listing additional suggested

conditions, and stated that the Commission could remove the item from the Consent
Calendar for further discussion, if so desired

Several Commissioners indicated that they had received a phone call from Mrs Joan
Wright inviting them to visit the area above Wayfarers Chapel

summarizing their background and experience

APPROVAL OF CONSENT CALENDAR
Chairman Clark asked Staff if was appropriate to have only the three returning
Commissioners vote on the Consent Calendar items, since the new Commissioner had
not been appointed at the time these items were discussed
Planning Administrator Petru replied that she had verified with the City Attorney that
items could be approved, as long as the motion was passed by a majority of the
returning members.
At this time, Chairman Clark asked Vice Chair Vannorsdall to chair the meeting for
approval of the Consent Calendar

Vice Chair Vannorsdall suggested that, on Page 1, in the last line of the last paragraph,
the word "location" should be added after the words "sewer drain", on Page 2, in the
first line of the first paragraph, the words "where future steps would be placed" be
added after the word "driveway"; on Page 2, in the fifth line of the first paragraph, the
word "add" be inserted before the word "steps'; on Page 2, new paragraph should be

Commissioner Alberio moved to accept the minutes, as amended, seconded by

to the Commission and were not present at the December 12, 1995 Meeting.

Commissioner Alberio moved to adopt P.C. Resolution No. 96-1; thereby
approving Height Variation No. 815 -Appeal, as re -designed, subject to conditions,
seconded by Commissioner Whiteneck. Approved (3-0-4), with Commissioners
Cartwright, Franklin, Ng, and Chairman Clark abstaining; as they had not yet been
appointed to the Commission when this item was discussed previously.
3 VARIANCE NO. 392, GRADING PERMIT NO. 1819; Mr Arthur Fein, 27520
Elmbridge Drive. (DJ)
Commissioner Alberio moved to adopt P.C. Resolution No. 96-2; thereby
approving Variance No. 392, subject to conditions; and, to adopt P.C. Resolution
No. 96-3; thereby approving Grading Permit No. 1819, subject to conditions.
Approved (3-0-4), with Commissioners Cartwright, Franklin, Ng, and Chairman
Clark abstaining; as they had not yet been appointed to the Commission when
this item was discussed previously.
Director/Secretary Bernard indicated that the P.C. Resolutions for Items No 2 and 3
would be signed that evening and that there was a 15 -day appeal period for any
interested party to appeal the Commission's decision to the City Council
At this time Chairman Clark resumed presiding over the meeting.

4. COA PERMIT NO 77 - REVISION. GRADING PERMIT NO. 1315 -
REVISION. ENVIRONMENTAL ASSESSMENT NO. 680; Portuguese Bend Club,
4100 Palos Verdes Drive South {FF}
Assistant Planner de Freitas presented the Staff Report, stating that remedial grading
in this area had been approved by the Planning Commission in the past, but had been
limited by the allowed quantity of earthwork Based on a suggestion from Dr. Perry
Ehlig, City Geologist, the Portuguese Bend Club was requesting that the Commission
approve a contour grading plan to maintain the land at a specific contour, regardless of
the amount of earth that had to be moved
Commissioner Whiteneck asked if the highest contour of the fill area would be an
elevation of 120 feet above sea level.
Assistant Planner de Freitas replied that this was correct, but that the project engineer
could best provide details as to what stage of the plan the grading was in terms of the
quantity of fill, and where the fill had been placed in accordance with the plan
Commissioner Whiteneck asked if additional fill height or a different location was
required and whether the applicant would have to return for review by the Commission.
Director/Secretary Bernard said that this was correct
Commissioner Ng asked who would monitor the progress of the grading
Assistant Planner de Freitas said that the monitoring would be performed by Dr Perry
Ehlig and that the applicant could be required to provide periodic reports to Staff, which
could be passed on to the Commission
Director/Secretary Bernard said that input was needed from the Commission as to the
appropriate intervals of the status reports and that the Resolution would reflect the
Commission's final determination He added that Staff had suggested three to six
month intervals
Vice Chair Vannorsdall questioned the need for monitoring because the fill would
eventually be washed away by wave erosion at the toe of the slide.

Commissioner Cartwright asked if he understood correctly that Staff was suggesting
that there be a written quarterly report and an annual verbal presentation to the
Director, and then subsequent status reports back to the Planning Commission
Assistant Planner de Freitas replied that this was correct but that the Planning
Commission could modify this schedule, as it deemed appropriate
Director/Secretary Bernard added that representatives of the Portuguese Bend Club
indicated to Staff that this interval and method of reporting was acceptable
Commissioner Whiteneck asked about the current rate of land movement in this area,
adding that if the rate of movement was not great, monitoring might not be needed
Director/Secretary suggested that the project engineer could answer Commissioner
Whiteneck's question
Commissioner Ng assumed that an increase in rainfall increased the rate of movement
of the landslide.
Director/Secretary Bernard said that the amount of rainfall did have an impact on the
rate of movement but also on whether or not the City could afford to complete all the
projects in the RDA area that were currently planned to remediate the larger landslide.
Commissioner Cartwright felt that quarterly reporting would be reasonable
Chairman Clark asked if there had been a contoured grading plan before
Director/Secretary Bernard said that grading permits are normally based on the
quantity of earth movement However, due to the unique circumstances in the
Portuguese Bend Club, contour grading had been suggested as an alternative that
would be appropriate and workable in this area.
Commissioner Alberio moved to open the public hearing, seconded by Vice Chair
Vannorsdall. Approved (7-0).
Mr Steve Cummins (project engineer) Dallas and Cummins Associates, Civil
Engineers, 17625 Crenshaw Boulevard, Torrance, CA 90504 Mr Cummins reported
to the Commission that he owned property in the Portuguese Bend Club at #81 Yacht
Harbor Drive, that he did not currently reside at that address, but that he was
representing the Homeowners Association

Mr. Cummins shared his immediate concerns 1) How the residents on the slip planes
east of the beach access road were being affected by the slide 2) The bad condition
of the road itself, although it was not proposed to be repaved at this time 3) This was
the rainy season and rain accelerated the landslide but, luckily, there had been little
rain so far that year.
He explained that the Portuguese Bend Club was located on the southeast edge of the
slip plane. As the main body of the landslide to the north and west moves toward the
ocean, at approximately 1/2" per day, where the underlying slip plane came up toward
the Bend Club, there was a dragging, twisting affect on the main body of the slide
mass, so that over the years (about 58) the land had been pushed up At one time, the
area was almost flat all the way to the ocean, but that same area next to Yacht Harbor
Drive was now 1 00'to 150' above the homes This has created secondary lateral
forces which could result in another slide in the direction of the homes, because of their
lower elevation. Dr. Ehlig had previously indicated to him that it would be worthwhile
to attempt to load the lower portion (the toe) of the main slide, thereby creating a
resisting force for the upper portion and possibly slow it down
Mr Cummins had several questions regarding the Staff Report 1) He questioned the
need for a second grading permit He was under the impression that because the fill
was to be placed on City property, only one grading permit would be needed. 2) He
was expecting resolutions to be signed that evening because the Portuguese Bend
Club had applied for federal funding and was anxious to resume the work in the area,
using the new contour plan
Director/Secretary Bernard said that he would answer both questions. 1) A January
1995 letter explained to Mr McCarthy and Ms Lovnch the need for the second grading
permit, as the Code required one for each property where grading was proposed
Therefore, this was not the first time this requirement had been mentioned Mr
Bernard then offered to provide a copy of the letter to Mr. Cummins. 2) Since there
was an emergency Grading Permit still in place from May 1994, the work could proceed
as necessary in order to protect the homes Mr Bernard clarified that the City had
never told them to stop
Planning Administrator Petru added that, per Code, the City required a separate
grading permit for each property. However, in a discussion with the City Manager,
since the fill site was RDA property, a letter could be accepted from the RDA, in this
instance, in lieu of the second permit. If the contour lines were exceeded, a second
grading permit might be needed, depending on where the material was going to be
placed

Director/Secretary Bernard asked Mr. Cummins about the Staffs suggestions on the
monitoring reports.
Mr. Cummins indicated that he was in favor of monitoring since the Homeowners
Association was paying for this work and it was important to stay in touch with the
contractor who was performing the work
Mr. John McCarthy, (President, Portuguese Bend Club Homeowners Association), 105
Spindrift Drive, Rancho Palos Verdes Mr. McCarthy stated that most of his questions
had already been answered during discussions so far at this hearing He reiterated
that the Homeowners Association had incurred much expense to protect the homes in
the area and since the funds were depleted, he had contacted FEMA for a loan
However, there was a six-month period of time during which the work had to be
performed He had been concerned that the work could not be continued and was glad
to hear that this was not the case and also happy to hear that two Grading Permits
would not be necessary. Mr McCarthy indicated that he would continue to work closely
with the City because the City and the Homeowners Association had the same goal to
protect the homes in the area
Director/Secretary Bernard reassured Mr. McCarthy that, even though the Portuguese
Bend Club did not have a signed Resolution to take to FEMA, they might have a
conceptual approval from the Planning Commission after tonight's meeting that he
could use in place of the Resolution
Commissioner Franklin asked if the Coastal Commission had any involvement in this
project
Planning Administrator Petru explained that the land was in an "appealable area" of the
City's Coastal Zone and that, over and above appeals at City level, there would be a
10 -day appeal period to the Coastal Commission, if an approval of this project was
granted by the City
Commissioner Franklin asked how a Coastal Commission appeal could affect the
timing of this project
Planning Administrator Petru replied that the Coastal Commission met only once a
month at different locations up and down state Therefore, it was likely that there would
be some delay in scheduling the appeal to be heard by the Coastal Commission
Lois Larue, 3136 Barkentine, Rancho Palos Verdes, introduced herself and explained
her interest in the landslide to the new Commissioners She distributed a booklet about
the Portuguese Bend landslide written by Bernard Pipkin {who was retired from the

University of Southern California and who laved in Palos Verdes Estates) in which he
indicated how serious the problem was in this area of the City She described how a
year earlier bulldozers had been working on the landslide with the approval of the City
Manager but without a public hearing. She did not agree with removal of dirt at the
bottom of the landslide because the proper method to handle the landslide should be to
remove dirt from the top and build up (not remove) dirt at the bottom of the landslide to
form a buttress. She indicated that monitoring was a new concept, that materials
provided to the public at Planning Commission hearings were incomplete, and that she
had no faith in Dr. Perry Ehlig's recommendation regarding management of the
landslide.
Chairman Clark asked if her comments indicated that she was opposed to the contour
grading
Lois Larue said that she did not understand the concept of contour grading and dad not
think that anyone else did either but she stressed that she did not want earth removed
on the seaward side of Palos Verdes Drive South and that she did not believe that
effective monitoring was possible.
Commissioner Alberto moved to close the public hearing, seconded by
Commissioner Cartwright. Approved (7-0).
Commissioner Ng asked, if the project was approved and monitoring indicated that
there was a problem with the fill relative to the environment, could the work be stopped
Director/Secretary Bernard said that the City and the Portuguese Bend Club both
wanted what was best for the adjacent homes and that the plan could always be
revised if it was found to be harmful or ineffective
Chairman Clark asked if there was a mechanism to stop the work if the monitoring
program Indicated negative results.
Director/Secretary said that there was, since the conditions allowed that either party to
seek modification to the approved grading plan.
Commissioner Alberio clarified that the issue before the Planning Commission was not
the monitoring intervals but the method of grading.
Director/Secretary Bernard agreed, stating that Dr Perry Ehlig had identified the best
method and location for placing the fill, which would be best for the City and the
Portuguese Bend Club

Commissioner Cartwright asked what types of information would be included in
monitoring reports.
Director/Secretary Bernard said that this would probably vary as the process moved
forward and that Dr Ehlig would be consulted for his suggestions
Commissioner Franklin asked about the fill area and whether the earth moved to the
designated area would likely wash out to sea
Director/Secretary Bernard acknowledged that this would most likely happen because
there was nothing in place to prevent continued wave erosion at the toe of the slide
However, Dr Ehlig and the City's panel of experts were attempting to determine the
proper method to anchor landslide at the toe
Chairman Clark mentioned the use of gabions, which had been used in the past,
indicating that he believed they had not been successful in keeping the earth from
washing out to sea.
Planning Administrator Petru and Chairman Clark indicated that gabions had been
used in the past in this area but that they had been only a temporary solution and that
eventually the earth did wash out to sea after the gabions had been destroyed by
heavy winter storms
Commissioner Franklin felt that it would have been better to have the City's Geologist
present at the meeting to explain the impacts of the earth washing out to sea.
Commissioner Whiteneck explained that Charles Abbott had been present at a recent
Commission meeting and Mr. Abbott said that the toe of the slide was located offshore.
Mr Whiteneck was concerned because earth was going to be moved from one part of
the landslide to another where it was expected to wash away He questioned the
accuracy of the drawing, specifically the statement that the mean high tide line was
located at the 80' contour line Citing his 28 years of experience working along this
coastline as an engineer, Commissioner Whiteneck said that he did not believe that the
mean high tide line was as high as 80' He stated that, at best, the contour grading
plan was a temporary solution and that the plan should be reviewed by an expert.
Director/Secretary Bernard explained that the expert the City would consult would be
Dr Perry Ehlig, who was the person who developed the concept of the contour grading
plan.
Commissioner Franklin wondered if it would be appropriate to build some type of
""retaining wall" structure at the toe of the landslide to minimize erosion

Commissioner Alberio stated that this was not the Issue before the Commission and
that the appropriate method for handling this Immediate problem had already been
chosen by the City Geologist
Commissioner Whiteneck felt that it was unacceptable that earth should continually be
lost due to wave erosion
Chairman Clark asked if the dirt had been lost in the previous method of grading
Director/Secretary Bernard assumed that it had been washed away since the landslide
had continued to move in this area, and suggested that the project engineer should be
consulted on this point
Mr. Steve Cummins returned to the podium at the request of the Chairman and said
that a huge body of land moving at a rate of 1/2" per day was very hard to control He
said that the 27,000 cubic yards of earth had been placed in approximately the same
area in years past and that it was gone now.
Chairman Clark asked if there were any observable adverse effects from this loss.
Mr Cummins said there had not been any adverse effects to his knowledge
Chairman Clark concluded that, based on past experience, any discussion of the
additional fill being placed in that same location as a moot point However, he believed
that the Commission could structure in the reporting requirements, some specifics on
the fill area and its condition as time passed
Commissioner Whiteneck believed that the loss of 27,000 cubic yards of earth should
be considered a adverse effect.
Chairman Clark said it was the landslide and, not the grading, that caused the earth to
wash away and asked if there were suggestions regarding the conditions of approval.
Commissioner Whiteneck said that the fill should be placed further up the slope, so that
it would not be washed away. However, he realized that the Commission was being
asked only to approve the monitoring plan
Director/Secretary Bernard noted that this hearing involved an interim grading permit
that was not intended to be a final solution to stop the movement of the landslide The
City's Redevelopment Agency (RDA) and the Federal Government were currently
conducting a feasibility study to determine the best method to anchor the toe of the
slide to prevent erosion He added that seeking this solution was dependent on

upon the City receiving the approval from the Corps of Engineer to proceed with the
selected project (which might not happen) and having the funds to implement the plan
He clarified that the issue before the Planning Commission that evening was to
approve the continuation of the interim remedial grading to protect the homes and
Yacht Harbor Drive
Commisioner Whiteneck replied that, although he understood the urgency of the
situation, he wondered if there might not be a better location for the fill where it might
not be washed away
Director/Secretary Bernard suggested that the conditions could include a requirement
for the applicant to explore alternative locations for the fill to be placed in the future.
Mr Cummins said that he agreed with the previous speaker (Lois Larue) who said that
placing earth at the bottom of the landslide as a buttress was the correct way to control
the landslide.
Commissioner Whiteneck disagreed, stating that he believed the earth only held the
landslide back as long as it was there, but then it washed out to sea.
Vice Chair Vannorsdall and Commissioners Franklin and Whiteneck wondered if
moving the fill from the City (RDA) property would require approval by the City Council
Planning Administrator Petru said only a separate grading permit reviewed by the
Planning Commission would be necessary
Chairman Clark asked the Commissioners if they recommended the contoured grading
method or did they have another suggestion
Vice Chair Vannorsdall and Commissioner Alberio indicated that they were in favor of
the contour grading plan
Commissioner Cartwright agreed with Staffs recommendation for contour grading but
wanted to make sure that reasonable monitoring requirements were included in the
conditions of approval
Commissioner Whiteneck said that he was in favor of the monitoring and wanted to see
an alternative location for the fill investigated

Commissioner Ng was concerned about the fill location also and asked how Staff would
transmit the monitoring reports to the Commission.
Director/Secretary Bernard said that the information would be placed in the Planning
Commissioner's regular agenda packet
Commissioner Franklin agreed that monitoring and contour grading were good
concepts and that the Portuguese Bend Club should proceed with the emergency
action, but he suggested that Dr. Perry Ehlig prepare a "white paper" to justify the
specific location chosen for the fill and that the Planning Commissioner discuss the
location again at a later date
Chairman Clark believed contour grading would be beneficial to the Portuguese Bend
Club and the City, but also supported the concept of conditions to require a further
study regarding the location of the fill
Commissioner Alberio moved to accept the Staff recommendation, seconded by
Vice Chair Vannorsdall.
Commissioner Franklin asked if the motion should include the request for a "white
paper" from Dr. Ehlig.
Commissioner Albeno believed that it should not because this would be studied later
Chairman Clark clarified that Commissioner Franklin's suggestion of a "white paper"
was valid and that Commissioner Alberto was correct to suggest that the location of the
fill could be left open in the conditions of approval
Planning Administrator Petru indicated that another condition the Commission might
wish to consider would be that either party may seek revision to the permit, if
circumstances warrant a change to the project
Chairman Clark suggested that the conditions should also describe situations under
which the City could stop the grading
Commissioner Whiteneck asked what those situations might be
Chairman Clark said that this was open to speculation

Commissioner Franklin asked if these were amendments to the original motion made by
Commissioner Alberio
Chairman Clark determined that these modifications were agreeable to the maker and
the seconder of the motion
Director/Secretary Bernard clarified that the motion was to approve the Staff
recommendation to approve the protect in concept and bring back Resolutions to the
next meeting, which would include the conditions of approval, as modified by the
Commission
The motion was approved (5-2) on the following roll call vote.

5. VARIANCE NO 401 - CLARIFICATION, Mr. and Mrs Vincent Carbone, 29723
Knollview Drive. (FF)
Chairman Clark asked Vice Chair Vannorsdall to preside over the hearing for this item
Assistant Planner de Freitas presented the Staff Report, stating that Staff was
recommending approval of the applicant's proposed modification to elevations of the
house and was seeking direction from the Commission regarding steepness of the
driveway, since the Commission's previously proposed suggestions were proving to be
unfeasible
Commissioner Whiteneck asked of steps were going to placed down center of driveway
and if a mirror was to be installed across the street from the driveway for traffic safety
Assistant Planner de Freitas said that the architect had included the steps in the
revised plans for better access up to the house and that a requirement for a mirror had
been listed in the conditions of approval.

Mr Ray Medak, (protect architect), 150 West Sixth Street, #201, San Pedro, CA 90731
Mr. Medak corrected the address of the subject property (as indicated on the agenda)
which should be 29723 (not 29733) Knollview Drive He explained that there had
already been a mirror hidden in the trees across the street for traffic safety and the
trees would be trimmed so that the mirror was visible He reaerated Assistant Planner
de Freitas' comments about the problems of complying with the Planning Commission's
suggestion regarding lessening the steepness of the driveway He explained that there
was a storm drain under the center of the driveway, but it was not known how far under
the ground it was installed However, since heavy equipment might crack the driveway
or the installation of the steps, some or all of the driveway might need to be replaced
and the storm drain depth might be determined at that time If replacement was
necessary, Mr. Medak speculated that it might be possible to make the driveway
steeper on bottom and less steep at the top Regarding the roof design, Mr Medak
noted that it had been altered from the original hip design to a gabled design.
Commissioner Albeno asked if Mr Medak had spoken to the next door neighbor about
obtaining permission to grade onto her property, in order to decrease the steepness of
the driveway
Mr. Medak said that she had no objection, as long as her view was not blocked, which it
would not be
Vice Chair Vannorsdall said that he was satisfied with the roof modification but was still
concerned with the steepness of the driveway He asked the project architect if it could
be made more level at the top
Mr. Medak replied that the steepness could be changed by only about one foot
Vice Chair Vannorsdall felt that this was not enough of a difference to require the
driveway to be re -graded and suggested that Staff work with the applicant to make the

Planning Administrator Petru agreed that Staff would continue to work with the
applicant
Commissioner Whiteneck moved to accept the Staffs recommendation, thereby
providing clarification for Variance 401 as requested by the applicant; and,
directed Staff and the applicant to work together to reduce the steepness of the
driveway as part of the plan check and construction of the project, seconded by
Commissioner Alberio. Approved by Minute Order, (3-0-4), with Commissioners
Cartwright, Franklin, Ng, and Chairman Clark abstaining; since they had not been
appointed to the Commission when this item was discussed previously.

6 Pre -Agenda for the regular Planning Commission meeting of Tuesday, January
23, 1996
Planning Administrator Petru noted that adoption of the Resolution for Item No 4
(Portuguese Bend Club) would be placed on the agenda for January 23, 1996, and that
Staff might recommend that the Wayfarer's Chapel item might be continued to a later
date, if the revised plans were not submitted within the next few days
Commission
Chairman Clark suggested that, at some time in the near future, the Commission review
and possibly revise its Rules and Procedures (P C Resolution 92-37)
Vice Chair Vannorsdall asked if a geology report for Wayfarer's Chapel could be
provided to each Commissioner and he suggested that there be another group site
visit.
Planning Administrator Petru replied that she would check to see if geology reports
could be provided to the Commissioners
Commissioner Whiteneck asked if the site visit to Wayfarers Chapel would include the
area Mrs Joan Wright had asked the Commissioners to visit.
Commissioner Franklin questioned whether the tour with Mrs Wright should be
declined in lieu of the visit to the Chapel property
Vice Chair Vannorsdall agreed that the new Commissioners should visit the Chapel
property first.
Planning Administrator Petru suggested that the January 23, 1996 meeting could be
adjourned to a group site visit to Wayfarer's Chapel
Director/Secretary Bernard said that Staff would coordinate visiting both areas on the
same date and that Staff would contact Mrs Wright to coordinate this effort.
