The Pledge of Allegiance followed, led by Mike Mohler PRESENT Commissioners Alberio, Vannorsdall, Wang, Whiteneck, and Acting Chair Hayes Also present were Director of Planning, Building and Code Enforcement/Planning Commission Secretary Bernard, Planning Administrator Petru, Associate Planners Silverman and Jerex, Assistant Planner Klopfenstein, and Recording Secretary Drasco 1 a W ! i ♦ 0 Approved as presented, (5-0) COMMUNICATIONS Staff i Director/Secretary Bernard noted that one letter had been received for Item No 5 from the applicant requesting that the item be continued to a later Planning Commission meeting to allow time for further review of the conditions of approval. �•,9 APPROVAL OF CONSENT CALENDAR 1. MINUTES OF OCTOBER 24, 1995 Commissioner Vannorsdall suggested the following amendments 1) On Page 8, paragraph 2, he requested that the sentence be changed to read "Commissioner Vannorsdall recommended to Staff that the south wall (facing the church) be 6 feet to 8 feet", 2) On Page 8, in the last sentence in the last paragraph, that the word "Commercial" be changed to "Commissioner", 3) On Page 10, in the first paragraph of Item No 8, the name of the Commissioner making the statement should be Vannorsdall, 4) On Page 11, in the tenth paragraph he asked that the second sentence be changed to read. "He suggested that, if the existing sewer drain was needed, a trench could be cut down through the center of the driveway'; On Page 11, in the last sentence of the tenth paragraph, the word "wall" be inserted after "retaining", and, 5) On Page 12 in the fifth paragraph, he asked that the sentence be changed to read "Commissioner Vannorsdall reiterated that safety was most important and requested that the applicant reduce the slope and steps " Commissioner Alberio moved to accept the Minutes of October 24, 1995, as amended, seconded by Commissioner Vannorsdall. Approved, (4-0-1), with Commissioner Wang abstaining as she was not present at the October 24, 1995 meeting. 2 VARIANCE NO. 390, GRADING PERMIT NO. 1802, Mr Tom Villardi, 5832 Scotwood Drive (TS) Commissioner Vannorsdall moved to adopt P.C. Resolution No. 95-46, thereby approving the project; seconded by Commissioner Wang. Approved, (5-0). Director/Secretary Bernard noted that there was a 15 -day appeal period to appeal the decision to the City Council CONTINUED BUSINESS 3 VARIANCE NO. 392, GRADING PERMIT NO. 1819; Mr Arthur Fein, 27520 Elmbridge Drive (DJ) Associate Planner Jerex presented the Staff Report, stating that Staff was seeking direction from the Commission regarding environmental issues associated with the project. She added that Tom Findley, the City's Building Official was present for general questions Commissioner Alberio asked if footings and caissons were being added to the structure Associate Planner Jerex replied that all the preliminary recommendations from the City Geologist had been included in the new plan, except for the large caissons Director/Secretary Bernard said that if the project was approved the applicant would be required to apply for an after -the -fact building permit and that all Building Code requirements would be met. Commissioner Alberio noted that he could not find any cantilever, as mentioned in the Staff Report. PLANNING COMMISSION MINUTES DECEMBER 12,1995 PAGE 2 Associate Planner Jerex indicated that photographs being passed around would show the deck cantilever, which extended over the slope Commissioner Alberio asked if there was a report from the geologist and the engineer. Associate Planner Jerex replied that these reports would be generated after direction was received from the Commission Mr. Arthur Fein, (applicant) 27520 Elmbridge Drive, Rancho Palos Verdes. Mr. Fein said that he had noticed errors in the Staff Report which indicated that he had not acted promptly when he realized he was out of compliance He said that construction had actually stopped on July 20, 1994, not December 4, 1994, and that he had signed a contract with the engineer on August 2, 1994, indicating his willingness to cooperate with the City He also pointed out that in that period of time since construction had stopped there had been an earthquake and heavy rainstorms which had not caused slippage at the construction site Acting Chair Hayes asked Staff if Mr. Fein had indeed been cooperative and Associate Planner Jerex said that he had Mr. Fein continued, stating that no part of the deck was cantilevered, even though the Staff Report indicated otherwise He disagreed that his slope should be considered extreme because the City defined "extreme" as being over 35 degrees and his slope, at its steepest, was only 30 9 degrees Mr. Fein explained that there were three issues, geological, structural, and aesthetic He agreed that the deck should be completed in such a manner that no slippage will occur He said that the geological report stated that the slope of the bedrock was such that there was a safety factor of 1.5, which was adequate for the City's requirement In reference to structural issues, the structural engineer planned to install caissons at the locations indicated by the red dots on the submitted drawing. Aesthetically, Mr Fein felt that he had done more than some of his neighbors and directed the Commission to Exhibit 3 in the materials he distributed. He acknowledged that the photograph taken from the Browndeer side did make the columns look severe but that he was planning to hide them with landscaping, as was done at the home to the right of his, where a pool and a block wall were added at the same level as his deck. He described photographs in Exhibits 4 through 6 which illustrated four other houses in the vicinity, two of which had used landscaping to screen decks and similar structures as large as his, as well as two properties which had made no attempt to hide the structures. PLANNING COMMISSION MINUTES DECEMBER 12,1995 PAGE 3 Commissioner Alberio asked if these other structure has been approved by the Planning Commission and Mr Fein said that they had been approved by a previous Commission Mr Fein also discussed a requirement for compliance with CEQA and pointed out that this requirement had not been applied to his neighbor's structures. Mr. Fein discussed Exhibit 9, his landscaping plan which was still in the planning stages, which described mature trees that he intended to plant to screen his structure. Mr. Fein concluded by requesting that the Commission approve Staffs alternative No 1 with the exception of (B) which dealt with landscaping He indicated that he would want to know the criteria for the landscaping before he agreed to this condition, but that he was willing to work with the City on a mutually agreeable plan. Commissioner Alberio asked Mr. Fein if he agreed with the City geologist's recommendations and Mr Fein said that he did. Commissioner Albeno asked Staff if there had been time to analyze the plan for the caissons Associate Planner Jerex replied that the plans had been reviewed, by the City, but not approved as yet Mrs Irene Dorian, 27514 Elmbridge Drive, Rancho Palos Verdes Mrs Dorian stated that she and her husband lived next door to Mr Fein and that they had no objection to his project. Acting Chair Hayes asked the applicant to return to the speakers podium Commissioner Vannorsdall asked Mr. Fein about cracks in his home he had mentioned during his testimony Mr. Fein said that there had been cracks around the fireplace when he first moved in, but that he had repaired them and there had been no other cracks. Commissioner Vannorsdall asked Mr. Fein if he had received an estimate on the cost of the caissons, indicating that he would guess the expense would be approximately $75,000 to $104,400 Mr. Fein said that the engineer had indicated that caissons would be expensive, but that he had not requested bids yet, as he was waiting for approval from the City PLANNING COMMISSION MINUTES DECEMBER 12, 1995 PAGE 4 i Commissioner Vannorsdall disagreed, stating that Mr Fein should know the cost of the project if he proceeded Commissioner Alberio moved to close the public hearing, seconded by Commissioner Whiteneck. Approved, (5-0). Commissioner Alberio moved to accept Staffs Alternative No.1, seconded by Commissioner Wang. Acting Chair Hayes confirmed that this would include the caissons and landscaping Director/Secretary Bernard confirmed that the Commission had conceptually approved the project and that Staff would bring back the appropriate P C Resolutions at the next meeting The motion was approved, (5-0), on a roll call vote. 4 HEIGHT VARIATION NO. 815 - APPEAL, Damiano and Sarah Colaroutolo, 4033 Miraleste Drive (KK) Assistant Planner Klopfenstein presented the Staff Report and asked the Commission for direction regarding the adequacy of the redesign Mr John Resich, (applicant's representative) 840 West Ninth Street, San Pedro, CA 90731 Mr Resich said that he had met with Staff and reduced the addition substantially to meet the requirements of the Commission and offered to go over the details of the changes if the Commission wished Commissioner Vannorsdall moved to close the public hearing, seconded by Commissioner Whiteneck. Approved, (5-0). Commissioner Alberio moved to accept Staffs Alternative No. 1, seconded by Commissioner Whiteneck. Director/Secretary Bernard indicated that Staff would bring back the Resolution at the next meeting, Approved, (5-0), on a roll call vote. PLANNING COMMISSION MINUTES DECEMBER 12,1995 PAGE 5 PUBLIC HEARINGS 5 CONDITIONAL USE PERMIT NO 185, VARIANCE NO 388, GRADING PERMIT NO. 1793, AND ENVIRONMENTAL ASSESSMENT NO 676, Wayfarer's Chapel, 5755 Palos Verdes Drive South. (TS) Director/Secretary Bernard noted that the applicant had requested that the public hearing be continued to the next meeting to provide the applicant more time to review the conditions of approval and that Staff was agreeable to a continuation Mr. Bernard explained that the draft Resolutions had not been completed prior to the meeting due to problems with the City's new computer network system. Acting Chair Hayes indicated that she had met Lloyd Wright, the Chapel's architect 22 years before and that he had expressed his hope at this time that the site would never be altered Mrs Hayes stated that she hoped that proposed changes, if approved, would not be regretted later She suggested that, even though this was her last meeting as a Commissioner, and therefore would not be a part of the final decision, she hoped the Commission would wait until the property could be restored to the original design, insofar as the relationship of the Visitor Center to the Chapel. The consensus of the Commission was to continue the public hearing, but to hear the speakers that were in the audience that evening Mr. Dean Andrews (applicant's architect), 1064 Upland Avenue, San Pedro, CA 90732 Mr Andrews reiterated that the applicant had requested a continuance to review the conditions of approval He said that the high expense to comply with the requirement for on-site security was of particular concern Acting Chair Hayes asked Mr. Andrews about the neighbors' concern that the property would be commercialized Mr. Andrews said that it would not be any more commercialized than it had been from the start Acting Chair Hayes asked if the amphitheater seating was being increased and Mr. Andrews said that the seating was not being increased, but that the plan provided for permanent seating for the same number of people. Acting Chair Hayes asked about if the adjoining property owner objected to the structure that would be built right on the property line, with no setback. PLANNING COMMISSION MINUTES DECEMBER 12, 1995 PAGE 6 Associate Planner Silverman said that Staff had received no objection from the adjoining property owner. Commissioner Albeno said that he talked with that property owner and the property owner had indicated that he had never given his approval for the reduced setback Acting Chair Hayes suggested that the applicant receive written approval from the adjoining property owner Commissioner Vannorsdall referred to the conditions of approval and asked Mr Andrews if he objected to them. Mr. Andrews said that his primary objection was to the requirement for on-site security Commissioner Vannorsdall asked Staff about the sound and lights from the amphitheater disturbing the neighbors Associate Planner Silverman explained that the recommended hours of use would be 1000 A M to 6,00 P.M during standard time and 10.00 A.M. to 8.00 P.M. during daylight savings time (basically daylight hours) except for special services at Easter and Christmas Commissioner Vannorsdall was concerned that the ground lights might not be sufficient near the closing hours of use, as dusk approached He also asked about locking the entrance gate and Mr Andrews replied that the gate was currently closed and locked during the time the Chapel was closed. A discussion ensued between several of the Commissioners and Mr Andrews which revealed that he did not favor enclosing the entire property with a fence, as he felt people could still climb over the fence if they really wanted to get in, and that he was not aware of the number of trespassers who came onto the property when the Chapel was closed Mr. Victor Bothmann, 3516 Almeria Street, San Pedro, CA 90732 Mr Bothmann stated that he was on the Board of Managers for the Chapel. He indicated that his main objection to the conditions of approval was the reduction of the seats in the amphitheater from 160 seats to 100 because the Chapel wished to hold larger weddings (including outdoor weddings) at the site Commissioner Alberio asked if there was adequate parking for 160 people and Associate Silverman said that there was, but that this included taking into PLANNING COMMISSION MINUTES DECEMBER 12,1996 PAGE 7 F - -I L J s consideration shared parking for all of the various uses of the property Commissioner Vannorsdall and Mr Bothmann discussed ground lighting at the amphitheater and Mr Bothmann agreed that safety was of paramount importance It was determined that additional lighting, such as the low profile lights used at Marymount, would probably not be visible to the surrounding neighbors or from Palos Verdes Drive South Commissioner Vannorsdall asked Mr Bothmann about a fence surrounding the entire property and Mr Bothmann felt that a fence would not necessarily protect the property from trespassers, but that the vehicle gate should be locked to keep out cars after hours Vannorsdall asked about the recommendation for signs Mr Bothmann said that he believed the suggested signs would detract from the beauty of the Chapel Commissioner Vannorsdall asked Mr Bothmann about the noise level requirement and Mr Bothmann said that he was not sure how noise would be monitored but that he did not anticipate that the activities would cause a high noise level Mr. Carl Venetchi, 2601 South Victoria, Rancho Dominguez, CA 90220 Mr Venetchi said that he was the pastor of the Chapel and that the Chapel was a commercial venture because of the revenue generated by the weddings However, his ministry at the Chapel was not commercialized In response to the earlier comments made by Acting Chair Hayes, Mr Venectchi said that he believed that the original architect Lloyd Wright would have seen the need for change to the facility as time had passed Commissioner Vannorsdall asked if Sunday School was included in the future plans for the Chapel Mr Venetchi said that there was currently no Sunday School, but that he would like to establish one in the future, if the site could accommodate it. Commissioner Alberio was not sure this was a good idea Acting Chair Hayes said this issue could be discussed further at a later time PLANNING COMMISSION MINUTES DECEMBER 12, 1995 PAGE 8 Associate Planner Silverman said that this would be substantial change and that Sunday School usage would require review by the Commission as a revision to the Conditional Use Permit Commissioner Alberio opposed a continuance because a new Commission would have to start over in studying the project and the current Commission had done so much work already. He asked Mr. Vinetchi about non -wedding activities at the Chapel Mr Vinetchi said that there were regular Sunday services, special services at Christmas and Easter, baptisms, confirmations, memorial services, and visitation within the community and at hospitals. He said that it was a fullfledged ministry Ms. Corinne Gerrard, 22 Narcissa Drive, Rancho Palos Verdes Ms Gerrard said that she was in charge of Neighborhood Watch in the area and distributed information to the Commission. She felt that the nearby residences above the Chapel would be impacted by noise and light. Ms. Gerrard was opposed to the new structure because the property was located in the Landslide Moratorium Area and pointed out that there are cracks on Palos Verds Drive South Just below the proposed building site She discussed the two walkways from the Chapel up to Narcissa Drive which were used by visitors and/or trespassers at all hours. Mrs Gerrard said that she had lived in the neighborhood for nine years and had called the Sheriff every Friday and Saturday night during each summer. She indicated that the Sheriff chased away the trespassers and they returned when the Sheriff left Commissioner Alberio asked if the Sheriffs Department would have a record of the calls and Ms Gerrard said they would not because she had not filed any formal complaint, but only phoned Mr. John Beringer, 3412 Seaglen Drive, Rancho Palos Verdes. Mr. Beringer distributed a letter to the Commission indicating his concern regarding inadequate geological testing for the project and requesting that an Environmental Impact Report and a soil stability study be conducted before approval of the project He was opposed to building in the Landslide Moratorium Area and said there were slip planes under the proposed building site He noted that the study performed by Keith Ehlert stated that there was no guarantee that the site would not experience geologic problems in the future. Mr. Bill Griffin, 5 Ginger Root Lane, Rancho Palos Verdes. Mr Griffin said that he was solely concerned about the landslide issue and believed maintaining the stability of the nearby homes was of prime importance Mr Griffin said that he was a civil engineer and he believed that there was one or more slip planes in the area and did not feel that Keith Ehlert's study was adequate PLANNING COMMISSION MINUTES DECEMBER 12,1995 PAGE 9 Mrs. Joan Wright, 1 Fruit Tree Road, Rancho Palos Verdes. Mrs. Wright said that there was definitely land movement in the Portuguese Bend area and that she did not want the homeowners in the area to lose their homes because of this project. Mr. Bob Halderman, 88 Narcissa Drive, Rancho Palos Verdes Mr. Halderman said that he was concerned with setting a precedent for allowing building in the Landslide Moratorium Area and wanted to maintain the stability of the nearby homes, including his own, which was located on the border of the area where homes had been lost in the past. Mr William R Muller, 24 Narcissa Drive, Rancho Palos Verds Mr. Muller said that he lived behind the Chapel for twenty years and that there had a constant problem with young people congregating in the area on summer nights. He stated that he had no problems with the current light and sounds from the Chapel, but believed the permanent seating in the amphitheater might cause additional noise and possibly non- religious activities, such as concerts. He was also concerned about the landslide, and the proposed project's impact on the land movement in the area. Lois Larue, 3136 Barkentine Road, Rancho Palos Verdes, suggested that the Visitor Center could still be provided at its current location 114 mile to the west of the Chapel on Palos Verdes Drive South She felt that access to the existing Visitor's Center could be improved by creating a left hand turn pocket into this off-site location so that visitors did not have to make a U-turn and would not get lost going to the site. She objected to the City's management of the landslide and to Staffs evaluation of this building site. Commissioner Vannorsdall moved to continue the public hearing. Planning Administrator Petru suggested the January 23, 1996 meeting, rather than the first meeting of January, which would be mainly devoted to an orientation program for the new Planning Commission members. Commissioner Alberio reiterated that he was opposed to a continuance because the new Commission would have to start over to study the project Acting Chair Hayes noted that the applicant had requested the continuance Commissioner Alberio believed that the project could be approved with the proposed conditions of approval and that the applicant could come back later for changes He added that the decision would probably be appealed to the City Council, in any case. PLANNING COMMISSION MINUTES DECEMBER 12, 1995 PAGE 10 2 Commissioner Vannorsdall modified his original motion to continue the item to January 23, 1995, seconded by Commissioner Wang. Approved (4-0), on the following roll call. AYES: Commissioners Vannorsdall, Wang, Whiteneck, and Acting Chair Hayes NOES: Commissioner Alberio RECESS AND RECONVENE Recessed at 8.50 P.M. and reconvened at 9.35 P.M. 6. VESTING TENTATIVE TRACT MAP NO. 50666 - REVISION "B" CONDITIONAL USE PERMIT NO. 163 - REVISION "B", Zuckerman Building Company/Palos Verdes Land Holdings Company, 3000 Palos Verdes Drive South at La Rotonda Drive. (CP) Planning Administrator Petru presented the Staff Report, stating that this item represented revisions to the Ocean Trails project and she highlighted two specific points. 1 The applicants had requested that the western half of the bicycle loop trail around Half Way Point Park be eliminated, consistent with the Coastal Commission's conditions of approval so that there would be just pedestrian access on that side of the park. Staff had no strong objection to this request, but felt that the Commission should consider the fact that, unlike some of the other trails in the project, because of the gently sloping terrain, it would be possible to see this loop from most vantage points within the park and it would be natural to have a bicycle loop completely around the park. Therefore, Staff was recommending that the loop remain However, the applicant could elaborate on the reasons for requesting that the bicycle use be eliminated from the trail when they addressed the Commission. 2 The last topic in the Staff Report (which was, incorrectly identified in the Staff Report as Hole 14, and is actually Hole 4) noted that there was a trail crossing the fairway with the latest revised configuration of the golf course Staff was aware that trails would be crossing the fairway at Holes 13 and 14 and precautions had been taken to require protective fencing in these areas However, trails crossing the fairways should be kept to a minimum and Staff was concerned about another conflict. This was discussed with the applicant to see how the trail could be wound around the back sides of those tees, because this would be a challenging level pedestrian trail. For the PLANNING COMMISSION MINUTES DECEMBER 12,1995 PAGE 11 current conditions of approval for the Conditional Use Permit, (on Page 5 of 14 of the Staff Report), it is specified that the layout of the golf course has to comply to the plan but leaves the final approval to the discretion of the Director and any substantial revisions would come before the Planning Commission Planning Administrator Petru suggested that language be added to Condition F1 of Conditional Use Permit No 163 stating that "wherever possible, the final design of the golf course shall minimize the conflict between golf holes and the public trails", because the revised site plan was not the final design of the golf course Commissioner Alberio asked if, aside from changes the Coastal Commission might require, Staff was suggesting these two changes Planning Administrator Petru said that this was correct, but that the Coastal Commission will still review the final golf course layout and may ask for additional changes Planning Administrator Petru clarified that, after talking to the City Attorney, there were three draft Resolutions for the Planning Commission's consideration, two recommending that the City Council approve Addendum No 4 to Environmental Impact Report No 36 and Vesting Tentative Tract Map 5066 - Revision "B", and one approving Conditional Use Permit No 163 - Revision "B" Because Addendum No 3 to the EIR (in 1994) only covered the inclusion of the School District property into the golf course and not the changes in the golf course configuration, the City Attorney felt it was important to prepare another addendum, although extremely simplified, to decide whether or not those changes resulted in any significant impacts In preparing Addendum No 4, Staff did not find that the modifications to the project would result in any new or increased significant impacts Commissioner Vannorsdall moved to open the public hearing, seconded by Commissioner Alberio. Approved, (5-0) Mr. Ken Zuckerman (applicant), 2 EI Portal, Palos Verdes Estates, CA 90274 Mr Zuckerman explained that he was present as the project manager for Ocean Trails, as was Mike Mohler, for continuity, as his predecessor He was hoping to bring Ocean Trails into final form with the Coastal Commission's approval through the inclusion of the School District property and the relocation of the clubhouse He was requesting that bicycle use be eliminated from the trail on the west side of Half Way Point Park to make the City's trails conditions consistent with those of the Coastal Commission and to eliminate confusion in the future He stated that he had no problem with Staffs recommendation to revise the location of the trail at Hole No 4 to minimize conflict with the golf course Mr Zuckerman said that he would work with Staff for compliance with PLANNING COMMISSION MINUTES DECEMBER 12, 1995 PAGE 12 the City and the Coastal Commission Conditions of Approval to move ahead with the project. Mr. Robed -Ag (representing Ocean Terraces Condominium Association), 3200 La Rotonda Drive, #15, Rancho Palos Verdes Mr Agli stated that he had been working as a representative of the Association for eight years during the planning of this project and that the Association was still in support of the proposed development. Mr Agli emphasized that the applicant had maintained excellent communication with the Association and that he was expressing the members' appreciation Lois Larue, 3136 Barkentine Road, Rancho Palos Verdes, said that she was reminding the Planning Commission that the Coastal Commission found that the people like Chris Stravos, an environmental engineer who had been riding his bike in this area for 30 years, had prescriptive rights to that area and that the Hon/Zuckerman group had gone to Sacramento stating that their project would provide jobs She asked if Chris Stravos and the Coastal Conservation Coalition were notified that this item was on tonight's agenda She closed by stating that one of the goals of the General Plan was to preserve agricultural land and she suggested that the 8 acres owned by the School District be saved for agriculture and not used as part of a golf course Planning Administrator Petru replied that a notice was sent to residents within a 500' radius of the property as well as the interested parties list for Coastal Permits, which included those mentioned by the speaker She added that she would double check the interested parties list for the City Council agenda on the VestingTentative Tract Map amendment. Commissioner Vannorsdall moved to close the public hearing, seconded by Commissioner Whiteneck. Approved, (5-0). Commissioner Alberio moved to approve the revisions, subject to the modified Conditions of Approval outlined by Planning Administrator Petru, including the applicant's request to remove the bicylce use from the west side of the Half Way Point Park loop trail, seconded by Commissioner Wang. Commissioner Whiteneck asked, on Page 4, about the width of the easement for public access through the golf course parking lot to Forrestal Canyon Planning Administrator Petru said that it could be as wide as the clubhouse driveway or as wide as the Paseo del Mar right-of-way Staff recommended that it be as wide as the driveway PLANNING COMMISSION MINUTES DECEMBER 12, 1995 PAGE 13 The applicant did not object and the Commission agreed. Commissioner Alberio moved to adopt P.C. Resolution No. 95-47, recommending approval of draft Addendum No. 4 to the City Council, seconded by Commissioner Vannorsdall. Approved, (5-0), on a roll call vote. Commissioner Vannorsdall moved to adopt P.C. Resolution 95-48, recommending approval of the revisions to the Vesting Tentative Tract Map No. 50666 to the City Council, seconded by Commissioner Alberio. Approved, (5-0), on a roll call vote. Commission Whiteneck asked, on Page 9, why the 45 -space parking lot on the east side of the clubhouse was available only to the public and that golf parking would be prohibited He wondered about parties held at the clubhouse, etc., and the use of this lot for overflow parking Planning Administrator Petru said that this was a Coastal Commission requirement and that there was overflow parking at the Maintenance Budding. She clarified that use by the public of this parking was from dawn to dusk and that, after dark, the lot would be available to the clubhouse Director/Secretary Bernard indicated that this would be clarified in the conditions of approval. Commissioner Wang moved to adopt P.C. Resolution No. 95-49 approving revisions to Conditional Use Permit No. 163, seconded by Commissioner Alberio.
