The meeting was called to order at 7:08 PM, by Chairman Alberio at
the Hesse Park Community Building, 29301 Hawthorne Boulevard.
PRESENT: Commissioners Vannorsdall, Hayes, Vice Chairman Mowlds,
and Chairman Alberio
ABSENT: Commissioner Whiteneck
Also present was Senior Planner Rojas.

A. STAFF
1. Planning Commission/Sub-Committee Development Code
Revision Review Schedule.
The Sub -Committee requested that the overview of
the entire Development Code language scheduled for
two meetings at the end of the review schedule be
split and presented in two sections.

CONTINUED BUSINESS
Development Code Revision, City of Rancho Palos Verdes,
Citywide. (JR)
Senior Planner Rojas stated that the purpose of this evening's
meeting is for the Planning Commission Sub -Committee to
conceptually review Articles III, IV, V, and VIII of Title 17 of
the City's Municipal Code. Furthermore, Senior Planner Rojas
commented that Staff will do the necessary research regarding items
discussed this evening and return with appropriate language for the
revisions at a future meeting.
The Planning Commission Sub -Committee reviewed the comprehensive
list of proposed revisions to Articles III, IV, V, and VIII of
Title 17 contained in the Staff Report. The Sub -Committee
considered Staff's recommendation for each proposed revision and
took the following actions:
Article III
Section 17.26 (Institutional District)
The Sub -Committee accepted Staff's recommendation.
Article IV
Section 17.34 (Open Space Recreation District)
The Sub -Committee accepted Staff's recommendation.
Article V
Section 17.40.070 (Auto Service Overlay)
The Sub -Committee accepted Staff's recommendation.
Section 17.46.020 (Equestrian Overlay District)
The Sub -Committee accepted Staff's recommendation.
Article VIII
Section 17.86.060 (Modification of Permits)
The Sub -Committee accepted Staff's recommendation.
Section 17.96 (Definitions)
The Sub -Committee accepted Staff's recommendation.
The Planning Commission Sub -Committee reviewed the previously
revised text of Articles III, IV, V, and VIII page by page. The
Sub -Committee requested that staff make the following revisions:
Chapter 17.26 (Institutional (I) District)
The Sub -Committee requested that in Section 17.26.030(B) the 30 -
foot maximum height limit be removed. It should be left open to
discussion under a Conditional Use Permit.
The Sub -Committee requested that Section 17.26.040 be changed so
that interior remodeling which changes the primary use shall be
subject to a Conditional Use Permit.

Chapter 17.28 (Cemetery (C) District)
The Sub -Committee requested that in Section 17.28.030(8) the
30 -foot maximum building height limit be removed.
Chapter 17.32 (Open Space Hazard (OH) District)
The Sub -Committee requested that Staff clarify the first paragraph
of Section 17.32.020 by ending the first sentence at the word
"welfare", removing the words "and includes" and beginning the next
paragraph with the word "District".
The Sub -Committee further requested Staff to clarify the wording in
Section 17.32.020(A) by inserting the words "or creating downslope
movement," after 11 ... or flooding,".
The Sub -Committee also requested that the wording "areas where
slope exceeds thirty-five percent" be clarified.
Senior Planner Rojas stated that Staff will clarify the definition
of an "extreme slope" under the definitions section. In addition,
he stated that Staff will discuss this section with the City
Attorney in regards to adding the wording 11 ... or creating
downslope movement".
The Sub -Committee requested Staff to correct all the statements
that mention "the director of environmental services".
The Sub -Committee requested that Staff change the wording of
Section 17.32.030(F)(2) so that an applicant provides a "written
and signed" agreement. Furthermore, the Sub -Committee requested
Staff to remove the words "shall be signed by the applicant" which
are at the end of the second sentence.
The Sub -Committee requested Staff to clarify the wording of section
17.32.050 by expanding the meaning of "a lawful use" to include
reference to a lot or property.
Senior Planner Rojas stated this language change will need to be
reviewed by the City Attorney.
The Sub -Committee requested that Staff correct the numbering
sequence of the Sections in the Chapter.

Chapter 17.38 (Specific Plan Districts)
The Sub -Committee requested Staff to clarify the wording of section
17.38.080 by removing the word "located" found prior to the last
sentence of the section.
Chapter 17.40 (Overlay Control Districts)
The Sub -Committee requested that Staff change the word "that" to
"than" in section 17.40.040(C)(3).
The Sub -Committee requested that Staff change the word "delimited"
in Section 17.40.050(B)(6) to "delineated". Furthermore, they
requested Staff to correct the statement "department of
environmental services".
The Sub -Committee requested Staff to remove the words "to them" in
Section 17.40.050(C) (4), correct the words "environmental services"
in Section 17.40.030(D), and change the word "Insure" to "Ensure"
in Section 17.40.060(A)(3).
Chapter 17.42 (Residential Planned Development)
The Sub -Committee requested that Staff make a change in section
17.42.020(A) from 11 ... for and granting ... 11 to for the
granting ... 11.
The Sub -Committee requested Staff to make the parking requirements
of Section 17.42.040(E) consistent with the residential single
family parking standards recently proposed by the Sub -Committee in
their review of Section 17.02.030. They requested that three
parking spaces be required if the home is over 5,000 square feet in
size.
Chapter 17.46 (Equestrian Overlay (0) District)
The Sub -Committee requested that Section 17.46.020(A) and (B) be
clarified. It is difficult to understand the maximum number of
allowable animals per square foot of lot.
The Sub -Committee stated that the City Council limited the number
of horses to a maximum of three, regardless of the square footage
of the lot. The Sub -Committee suggested Staff check the City
Council direction and make any appropriate changes.

The Sub -Committee further requested that Staff clarify the
situation of whether abutting lots should be considered as one lot
for purposes of determining the number of animals allowed.
Senior Planner Rojas stated that this is one of the staff
recommended revisions which was presented in the Staff Report
earlier in the evening and agreed upon by the Sub -Committee.
Furthermore, that this proposed revision will have to be reviewed
by the City Attorney.
The Sub -Committee reminded Staff that the City Council directed
Staff to change the allowances described in Section
171.46.020(0)(1).
Chapter 17.84 (Nonconformities)
The Sub -Committee requested that Staff review Section
17.84.060(B) (2) and check the consistency between the Uniform
Building Code and the Development Code in regards to the
replacement value of non -conforming structures.
The Sub -Committee requested Staff to investigate the origin of the
date 2009 mentioned in Section 17.84.060(B)(4).
The Sub -Committee requested Staff to eliminate the last sentence of
Section 17.84.060(D).
Chapter 17.96 (Definitions}
The Sub -Committee requested Staff to re -arrange the definition
titles in a more logical manner so that subjects are easier to
find.
The Sub -Committee stated that the definition for basement should be
clarified by stating that windows are allowed to the outside.
The Sub -Committee requested that Staff create a definition of
"cellar" and that the definition include language whereby windows
to the outside area prohibited.
The Sub -Committee requested Staff to insert the words "or greater"
after "...separated by a two-inch" in the definition of "Common
wall".
The Sub -Committee requested Staff to correct the statement
director of planning" in the definition of "Director".

The Sub -Committee requested that Staff clarify the definition of
"extreme slope" by making it clear that the slope must be natural
and/or existing grade.
The Sub -Committee requested that the definition of "Large domestic
animals" be modified to include male goats that have been
castrated.
The Sub -Committee requested Staff to clarify the definition of
"Lot, reversed corner".
The Sub -Committee requested Staff to provide definitions of
"neighborhood compatibility" and "privacy", consistent with the
definitions established through the Height Variation process
(Chapter 17.02).
The Sub -Committee requested Staff to create definitions for
"Recreation, passive" and "Recreation, active".
