PC MINS 19940323APPROVED j0 4/12/94 115 CITY OF RANCHO PALOS VERDES PLANNING COMMISSION DEVELOPMENT CODE SUB -COMMITTEE ADJOURNED MEETING MARCH 23, 1994 The meeting was called to order at 7:03 PM, by Vice Chairman Nick Mowlds at the Hesse Park Community Building, 29301 Hawthorne Boulevard. PRESENT: Commissioners Vannorsdall, Hayes, and Vice Chairman Mowlds ABSENT: Commissioner Whiteneck and Chairman Alberio Also present was Senior Planner Rojas. COMMUNICATIONS A. STAFF - None B. COMMISSION - None CONSENT CALENDAR - None CONTINUED BUSINESS Development Code Revision, City of Rancho Palos Verdes, Citywide. (JR) Senior Planner Rojas stated that the purpose of this evening's meeting is for the Planning Commission Sub -Committee to conceptually review Articles I and II of Title 17 of the City's Municipal Code. Furthermore, Senior Planner Rojas commented that Staff will do the necessary research regarding items discussed this evening and return with appropriate language for the revisions at a future meeting. The Planning Commission Sub -Committee reviewed the comprehensive list of proposed revisions to Articles I and II of Title 17 contained in the Staff Report. The Sub -Committee considered Staff's recommendation for each proposed revision and took the following actions: Article I Title 17 (Commercial filming) The Sub -Committee accepted Staff's recommendation. 11 Section 17.02.020 (RS Uses Permitted) I] The Sub -Committee, concerned with the safety of children around permitted bee hives, requested that Staff research with the City Attorney whether the City could be held liable in a case of injury. Otherwise, the Sub -Committee accepted all other Staff recommendations. Section 17.02.030 (RS Standards) Parking The Sub -Committee directed Staff to coordinate with the Department of Public Works with respect to establishing a minimum driveway width in residential zones; otherwise, the Sub -Committee accepted all other Staff recommendations. Exterior Stairs The Sub -Committee accepted Staff's recommendation. Section 17.02.040(A)(1) (RS Building Height) The Sub -Committee accepted Staff's recommendation. Section 17.02.040(A)(2) (RS Building Height) The Sub -Committee accepted Staff's recommendation. Section 17.020.040(b) (1) (Undeveloped subdivision View Preservation) The Sub -Committee accepted Staff's recommendation. Section 17.02.040(B)(1)(d) (Height Variation) The Sub -Committee accepted Staff's recommendation with respect to adding an invasion of privacy finding to the Height Variation process. However, with respect to the review of Height Variation applications, the Sub -Committee stated that all Height Variations involving more than 200 square feet should be reviewed by the Planning Commission, but that the final directive needs to come from the Council. Section 17.02.040(B)(1)(f) & (i) (Height Variations) The Sub -Committee noted that the phrase on the eighth line of the first paragraph which reads 11 ... on the second story ...11 should be changed to read 11 ... on the first story ... 11 or 11 ... on the lower elevation ... 11. PLANNING COMMISSION DEVELOPMENT CODE SUB -COMMITTEE MINUTES MARCH 23, 1994 PAGE 2 Section 17.08.030 (Home Occupation) The Sub -Committee directed Staff to formulate a procedure whereby, for an additional fee, a Home Occupation Permit would allow one outside employee. Otherwise, the Sub -Committee accepted Staff's recommendations. Section 17.10 (Second Units) The Sub -Committee accepted Staff's recommendation. Article II Section 17.12.030 (Vendors in Commercial Zones) The Sub -Committee accepted Staff's recommendation. Section 17.12.030 (Deliveries/Equipment in Commercial Zones) The Sub -Committee accepted Staff's recommendation. Section 17.15 (RS AdditionslRemodels) The Sub -committee requested that when this Section of the Code is brought before the City Council, that a footnote should be included which reads "if the City Council wishes, certain size remodels will go before the Planning Commission". Senior Planner Rojas stated that if the Sub -Committee was in favor of establishing such a procedure, then, if possible, the Planning commission should make a recommendation to the City Council as part of the Development Code Revision package. The Sub -Committee suggested that the City Manager place this item on the City Council's Agenda for review while the Planning Commission is still in the process of reviewing the Code, since the Sub -Committee is looking for direction from the City Council on this issue. Section 17.14.020 (CL Uses Permitted) The Sub -Committee accepted Staff's recommendation. Section 17.16.020 (CN Uses Permitted) The Sub -Committee accepted Staff's recommendation. The Planning Commission Sub -committee reviewed the previously revised text of Articles I and II, page by page. The Sub -Committee requested that Staff make the following revisions: PLANNING COMMISSION DEVELOPMENT CODE SUB -COMMITTEE MINUTES MARCH 23, 1994 PAGE 3 Chapter 17.02 (Single-family Residential [RSL Districts) Senior Planner Rojas explained the rationale for the previous revisions proposed for the single -Family Residential Development Standards Chart contained in Section 17.02.030. The sub -Committee agreed with all the previous revisions to the chart, except as follows: The Sub -Committee requested that the parking equipment be modified to require 3 garage spaces for residences over 5, 000 square feet in size; The Sub -Committee accepted Staff's recommendation that a new column be added to the chart which addresses maximum structure size for lots of record which pre -date the Development Code. The additional column would establish a maximum structure size based on the existing area of each non -conforming legal lot. The Sub -Committee requested that the maximum gross square footage discussed in Footnote No. 8 include garages. In addressing the issue of "pop-up" garages and other second story design standards, the Sub -Committee requested that the following guidelines be established: Establishment of a 5 foot second story setback from the first story foundation footprint. The second story setback would apply to a minimum of 70% of the second story footprint; Proposed Height Variation applications that do not meet the standards established through this Chapter shall be initially reviewed by the Planning commission. The Sub -Committee requested that Staff incorporate new language regarding the lacing of trees, the method for determining view obstruction, an appeal process to the City Council, and the cost of the trimming procedure into Section 17.02.040(8)(2) (View Restoration). Senior Planner Rojas stated that new Code language related to the view restoration process needs to be reviewed by the City Attorney and the View Restoration committee prior to being incorporated into Title 17. As a result, language revisions to this section are not anticipated to be a part of the Development Code Revision proceedings. Chapter 17.04 (Multiple -family Residential (RM) Districts) The Sub -Committee requested that Staff provide a Development Standards Chart that is more legible. PLANNING COMMISSION DEVELOPMENT CODE SUB -COMMITTEE MINUTES MARCH 23, 1994 PAGE 4 Chapter 17.06 (Attached Unit Development Standards The Sub -Committee requested that Staff modify Section 17.06.020 to allow Planning Commission and/or Director authorization for the review of utility easements. Chapter 17.10 (Second Unit Development Standards) Under Section 17.10.020(B), the Sub -Committee requested Staff to research whether the City can prohibit the use of trailers as housing units. Under Section 17.10.020(E) and (G), the Sub -Committee requested Staff to research why second units are limited to 1,200 square feet and one bedroom, respectfully. The Sub -Committee requested Staff to add Section 17.10.020(N) to specify that both units are to be owned by the same person/persons. Chapter 17.12 (Commercial Districts) The Sub -Committee requested that each Section of the Code start on a new page and that dates which reference the adoption of the revisions be added at the bottom of each revised page. Under Section 17.12.040, the Sub -Committee requested that Staff eliminate the 30 foot maximum height restriction. Under Section 17.12.050, the Sub -Committee requested that Staff add language that would not exempt interior remodeling from a Conditional Use Permit, if the remodel would result in a change in the existing use. Under Section 17.12.060, the Sub -Committee requested Staff to add the word "the" to the last sentence of the first paragraph to read "*development shall provide* the following ...". Chapter 17.22 (Commercial Recreational (CR) District) Under Section 17.22.040, the Sub -Committee requested that the 48 foot height limit be eliminated. B. striping. • The Sub -Committee reiterated their concerns of addressing neighborhood compatibility through residential standards, in particular with respect to second story structures. In addition to the standards requested as part of the earlier discussion of Chapter 17.02, the Sub -Committee requested that Staff establish a standard where the second story of a residence is 20% smaller than the footprint of the first story structure, including the garage.
