PC MINS 19900925MINUTES PLANNING COMMISSION MEETING SEPTEMBER 25, 1990 The meeting was called to order at 7:30pm by Chairman McNulty at Hesse Community Park, 29301 Hawthorne Boulevard. PRESENT McNulty, Von Hagen, Hotchkiss, Brooks, Katherman ABSENT None Also present were Director of Environmental Services Robert Benard and Assistant Planners Bonnie Olson and Fabio de Freitas. COMMUNICATIONS Commissioner Von Hagen expressed concern about a circular he had received from the Peninsula Preservation Society containing unsubstantiated propaganda, and suggested the City Attorney look at the document and consider action against it. CONSENT CALENDAR A. Minutes of September 11, 1990 Commissioner Von Hagen moved to approve the Consent Calendar, seconded by Commissioner Katherman and carried 4-0 with an abstention from Commissioner Brooks, as she was absent from the meeting in question. PUBLIC HEARINGS There were no public hearings scheduled on the agenda. CONTINUED BUSINESS A. CONDITIONAL USE PERMIT Assistant Planner Bonnie Olson NO. 23 -- REV "MM" presented the staff report 3303 Palo Vista Drive regarding the applicant's request to revise the footprint and development specified for a new single family residence. Staff's recommendation is to approve the revision with conditions. Commissioner Katherman asked how the applicant would get the skylights approved since they are above 30', and Ms. Olson explained that the Commission has the ability to approve that aspect thorough this application, or could add a condition to lower them. PLANNING COMMIS & MEETING September 25, 1990 • Commissioner Hotchkiss suggested that Condition #3 in the Conditions of Approval be clarified regarding the rear setback. Commissioner Von Hagen moved to adopt the staff recommendation with the clarified Condition #3, and Commissioner Hotchkiss seconded the motion. Commissioner Brooks expressed her personal objection to the size of the house, and Commissioner Katherman agreed but also declared that the site is large enough and the house is appropriately terraced with more than 800 open space. The motion passed on a unanimous roll call vote. B. ENCROACHMENT PERMIT Assistant Planner de Freitas NO. 18 presented the staff report 6400 Corsini Place regarding the applicant's request to approve various encroachments within the public right-of-way. Staff's recommendation is to approve one of the staff -initiated proposals with conditions and any necessary modifications. Commissioner Brooks asked if a City vacation of the land in question would make it available to be purchased by the applicants, and Director Benard replied that it would probably be a partial vacation, and could relieve the City of potential liability problems. Mr. Benard also noted that there is precedent for such a vacation, as in the case of the fire station. Commissioner Katherman asked about the impact of the proposed pilasters and fencing on the visibility triangle, and Planner de Freitas stated the pilasters would be restricted in height as per the code. Ned Bosworth, 419 Malvern Avenue, Fullerton, applicant representing the property owners, outlined the compromises they had made since the last hearing, and cited major drainage problems from PVDE. Mr. Bosworth also noted that ground cover would not provide an effective screen from the street and was not water -conserving. He also stated he did not believe his design violated the visibility triangle, and expressed a strong desire to pursue the vacation process. Chairman McNulty questioned whether or not the application should be closed if the applicant was going to pursue the vacation process. Mr. Benard noted that the Commission could technically bifurcate the application and make a final decision on part of it, leaving the rest open via a continuance, if desired. Mr. McNulty also expressed his objection to "giving away" City property, and Commissioner Von Hagen stated he felt that the applicant was attempting to address serious traffic and trespassing incidents with this application. Page 2 PLANNING COMMIS & MEETING September 25, 1990 Commissioner Brooks moved to approve the items outside the visibility triangle on Corsini Place, but not including the stairs, fencing or gates and landscaping along PUDE, and to continue the remainder of the application pending the applicantle"pursuit of the vacation process. commissioner Hotchkiss seconded the motion. Commissioner Ratherman made an alternate motion to allow the stairs as proposed to encroach into the PUDE right-of-way and to allow fencing along the driveway to run along the north side and the walkway to intersect the property line at the appropriate height, and to deny the remainder of the application. The motion failed for lack of a second. The original motion passed on a roll call vote of 5-0. NEW BUSINESS -- There was no new business. QUESTIONS FROM THE AUDIENCE -- Chairman McNulty called for questions from the audience. There were none* STAFF REPORTS -- Director Benard reminded everyone that the SWAPC lunch was September 26. Commissioner Brooks stated she could not attend, as she would be representing the PV News at a luncheon for the Vice President of the United States. Mr. Benard also noted that the City Attorney had sent notification that the city had won the lawsuit filed by Arand and Segretto against the City regarding the EIR for the Marriott facility. Commissioner Von Hagen asked if a date had yet been set for the Hon project/Ritz Carlton workshop, and Director Benard stated that the EIR was currently in a consolidation stage and would be released after the City Attorney had reviewed it, at which time public hearings would be scheduled. ADJOURNMENT The meeting was adjourned at 8:50pm.
