PC MINS 19900710MINUTES PLANNING COMMISSION MEETING JULY 10, 1990 The meeting was called to order at 7:34pm by Chairman McNulty at Hesse Community Park, 29301 Hawthorne Boulevard. PRESENT McNulty, Von Hagen, Hotchkiss, Katherman ABSENT Brooks Also present were Director of Environmental Services Robert Benard, Planning Administrator Curtis Williams, and Assistant Planners Bonnie Olson, Lisa Davidson and Fabio de Freitas. COMMUNICATIONS Chairman McNulty acknowledged receipt of a letter from Arbolado Development Corporation agreeing to all the conditions in Exhibit "A", SUP 76. Mr. McNulty also noted that a draft copy of the July 3 City Council minutes specifically referencing the same issue, had been delivered to the Commission. CONSENT CALENDAR A. P.C. Resolution No. 90- , Variance No. 261, Grading No. 1437, 6111 Arrowroot --It was decided to remove this item from the consent calendar for Commission discussion after Continued Business. B. Grading No. 1436, 11 Amber Sky Drive Commissioner Von Hagen moved approval of the consent calendar as amended; Commissioner Hotchkiss seconded, and the motion passed without objection. PUBLIC HEARINGS A. GENERAL PLAN AMENDMENT NO. Planning Administrator 18, ENVIRONMENTAL Curtis Williams presented ASSESSMENT NO. 613 the staff report and Draft Housing Element background, plus a list of revisions suggested as a result of comments by the City Attorney. Staff's conclusion is that the Draft Housing Element is consistent with State law and presents a realistic City housing program, and staff recommends adoption of the document, and direction to staff to prepare a resolution for the July 24, 1990 meeting. The public hearing was opened. 0 PLANNING COMMISSON MEETING July 10, 1990 Lois Larue, 3136 Barkentine Road, expressed her disagreement with the City's position on the housing element, specifically related to State law regarding the 20% set-aside and provisions for providing affordable housing. The public hearing was closed on the motion of Commissioner Katherman with a second from Commissioner Hotchkiss. Commissioner Katherman inquired as to the practicability of using the set-aside funds for the purchase of mobile homes. Mr. Williams stated that since the RDA incorporates the slide area, in which new habitation is disallowed, and because of the potential liability problems, any new residential structures would be inconsistent with the present moratorium ordinance, land use and zoning designations. Commissioner Katherman also asked if Section 8 funds were available, and Mr. Williams stated that at this time, the City did not qualify because of the high level of rents, but that it was possible the 20% set-aside could be used to bring rents into the Section 8 category. Commissioner Von Hagen moved to adopt the Draft Housing Element and to direct Staff to prepare a resolution for the July 24, 1990 meeting. Commissioner Hotchkiss seconded, and the motion passed unanimously. B. VARIANCE NO. 265 The staff report was 6401 Corsini Place presented by Assistant Planner Lisa Davidson regarding the applicant's request to approve a 7'0" high solid wall and 10'0" entrance arcade along the front and side yard property lines. Staff's recommendation is to deny the request, thereby requiring redesign of the wall not to exceed 510" along the street -side property lines. The public hearing was opened. Richard Higgins, 6401 Corsini Place, applicant, stated that a 5' wall would not be high enough to block out the noise from PVDE, and he asked for a 6' high wall. Mr. Higgins also stated that none of his neighbors had any objections to his proposed wall, which would be hidden behind heavy vegetation. Commissioners Von Hagen and Katherman stated they felt that 6' was a reasonable compromise. Chairman McNulty suggested the possibility of a light -and -air fence, but Mr. Von Hagen stated the solid wall would be a more effective noise barrier, and he also suggested that details be added to the wall to break up the mass. Commissioner Katherman moved to approve the wall at 61, amending Condition #2 in Exhibit "A" to include maintenance of the existing vegetation plus a requirement that the Page 2 PLANNING COMMISSON MEETING July 10, 1990 applicant submit design and articulation details for the wall to the Planning Department for approval. Commissioner Von Hagen seconded the motion, and it passed 3-1 with Commissioner Hotchkiss dissenting. CONTINUED BUSINESS A. SPECIAL USE PERMIT NO. 76 Planning Administrator EXTENSION Curtis Williams presented Tract No. 45667 the staff report regarding (PVDSISeahi.11) the applicant's request to allow the continued use of rockcrushing equipment at Tract No. 45667, and staff's recommendation, at the direction of the Commission, to allow the extension through September 26, 1990, subject to conditions. Commissioner Hotchkiss asked why the conditions of approval included an additional two-week extension, and Mr. Williams explained that the additional two weeks would bring the total time of operation to six months. Mr. Hotchkiss also questioned the further requirements imposed on the applicant by the City Council. Chairman McNulty noted that the applicant had indicated full approval in writing to all the conditions. Commissioner Katherman asked that the hydroseeding be done as soon as possible to encourage water conservation, and Mr. Benard stated that the applicant was aware of that concern. Mr. Katherman also asked about the costs of providing personnel to monitor dust control, and Mr. Benard stated that the applicant would pay for a monitor on site. At this time, the public hearing was reopened on the motion of Commissioner Katherman, with a second by Chairman McNulty. Lois Larue, 3136 Barkentine Road, asked if the public had been noticed of this hearing, and was informed that it had been announced at the last meeting that the hearing would be continued to this date. The public hearing was closed. Director Benard noted for the Commission's information that the rockcrusher was currently operating under the former conditions, and that it would continue to do so until the new extension was granted, at which time the new conditions would have to be met immediately before further work could take place. Commissioner Von Hagen moved to adopt staff recommendation, Commissioner McNulty seconded, and the motion passed without objection. Page 3 PLANNING COMMISSON MEETING July 10, 1990 (THE FOLLOWING ITEM WAS REMOVED FROM THE CONSENT CALENDAR FOR COMMISSION DISCUSSION) VARIANCE NO. 261 Commissioner Von Hagen 6111 Arrowroot acknowledged receipt of a letter from applicant Russell LaRose requesting clarification on the Commission's decision at the previous meeting. Mr. Von Hagen suggested that the applicant request that the item be re -noticed so that the Commission would be able to take further public testimony, or if Mr. LaRose felt his letter explained his position adequately, the Commission could deal with the issue at this time. Commissioner Katherman stated he did not consider the structure in question a porte-cochere, but rather a carport, and that he was not comfortable with approving it. Chairman McNulty also agreed that the structure was a carport. Mr. Benard stated that re -noticing of this type is unusual, and that the City would pick up the expense unless the Commission directed otherwise; or, the applicant could appeal the decision through the regular appeal process. At this point Chairman McNulty asked the applicant for an indication of which alternative he would prefer, and the applicant indicated he preferred re -noticing. The Commission opted to not act on the Resolution, but to continue the item to give the applicant time to meet with the staff and reconsider his design. The Commission asked staff to bring back a resolution in two weeks after further review of the applicant's design. On the motion of Chairman McNulty with a second from Commissioner Hotchkiss, the item was continued to the July 24, 1990 meeting without objection. NEW BUSINESS A. GRADING PERMIT NO. 1445 6000 Sandbrook Director Benard stated that the applicant had submitted a request to continue the item to the July 24, 1990 meeting. B. CONDITIONAL USE PERMIT The staff report was waived NO. 107 -- EXTENSION regarding the applicant's PVPUSD (Pedregal) request to approve a two- year extension of the CUP for a multi -use facility. Although the Commission agreed that the property was so well-maintained that a 3 -year extension would have been appropriate, Commissioner Katherman Page 4 PLANNING COMMISSON MEETING July 10, 1990 moved approval of the staff recommendation for a two-year extension. Commissioner Hotchkiss seconded, and the motion carried without objection. C. SIGN PERMIT NO. 523 Assistant Planner Fabio de 28041 Hawthorne Freitas presented the staff report regarding the applicant's request to approve two permanent identification signs -- one monument sign and one wall -mounted sign. Staff's recommendation is to approve the permit with conditions, and Planner de Freitas stated that the applicant was in agreement with all of them. Commissioner Katherman moved approval of the staff recommendation, seconded by Chairman McNulty. The motion passed on a 3-1 vote, with Commissioner Hotchkiss dissenting. QUESTIONS FROM THE AUDIENCE There were no questions from the audience. COMMISSION REPORTS Chairman McNulty reported that Saturday's Peninsula News had printed a -letter from Lois K. Larue and Gar Goodson containing inconsistencies and untruths including an allegation that Mr. McNulty claimed she had "declared war on City Hall." In fact, Chairman McNulty stated, Ms. Larue had coined the phrase herself at the January 23, 1990 Planning Commission meeting during a discussion of the Portugese Bend gabion project. Mr. McNulty also pointed out that Ms. Larue had gone on to make other criminal accusations against City employees, and suggested that writing such untruths could be construed as a criminal action in itself.
