MINUTES
PLANNING COMMISSION MEETING
APRIL 24, 1990
The meeting was called to order at 7:36pm by Chairman McNulty
at Hesse Community Park, 29301 Hawthorne Boulevard.
PRESENT McNulty, Von Hagen, Katherman, Brooks,
Hotchkiss (arrived 7:56pm)
ABSENT None
Also present were Director of Environmental Services Robert
Benard, Associate Planners Laurie B. Jester and Joel Rous
and Assistant Planner Lisa Marie Davidson.
COMMUNICATIONS
Chairman McNulty acknowledged a letter from applicant Roger
Noorthoek regarding Site Plan Review No. 5338. Mr. McNulty
also noted for the record the communication received from the
California Fair Political Practices Commission regarding an
allegation made against Commissioner Von Hagen. As stated
for the record that the CFPPC letter states "...that the
complainant did not provide any facts to indicate that Mr.
Von Hagen had used his office in any way to influence the
political opinion of the City Council."
Mr. Benard acknowledged receipt of an information packet from
applicant Don Pierson regarding Variance No. 255, and noted
that he had given each of the Commissioners a copy of the
League of California Cities Brown Act publication.
CONSENT CALENDAR
A. Minutes of February 27, 1990
B. Minutes of March 27, 1990 -- Commissioner Brooks noted a
correction to the minutes under CUP 152 in order to indicate
that all the Commissioners still preferred the originally
approved site for the archery range.
C. Resolution No. 90-19 for a roving field archery range in
the Portuguese Bend Landslide.
D. GRADING NO. 1343 -- 28441 Cedarbluff; requesting
approval of an existing 42" high retaining wall in an extreme
slope.

E. GRADING NO. 1162 -- 5-112 Mustang; requesting approval
of after -the -fact remedial grading for a new single family
residence.
F. GRADING NO. 1428 -- City of Rancho Palos Verdes
Redevelopment Agency; request to redistribute 40,000 cubic
yards of earth in the Portuguese Bend Landslide.
Commissioner Katherman moved to approve the consent calendar
as amended, and Commissioner Von Hagen seconded the motion.
The consent calendar was then approved on the following roll
call vote:
AYES: Von Hagen, Katherman, McNulty, Brooks (who qualified
her vote with a "no" on Item "C", the roving archery
range.)
NOES: None

PUBLIC HEARINGS
A. VARIANCE NO. 255 Assistant Planner Lisa Marie
COASTAL PERMIT NO. 85 Davidson presented the staff
131 Yacht Harbor Drive report regarding the
applicant's request to approve
existing additions totalling 1261 square feet in the rear and
side yards and within the front yard setback. Staff's
recommendation is to conditionally approve the deck and
storage area in the rear yard and deny the spa, patio and
enclosure within the front yard setback.
Commissioner Hotchkiss declined to vote on this item due to
his involvement in the Portugese Bend Club HOA and the fact
that he received notice of the Variance.
Don Pierson, 131 Yacht Harbor Drive, applicant, explained his
handout to the Commissioners and asked them to allow all of
the existing improvements to remain. Mr. Pierson also noted
that he objected to the condition to record a covenant
running with the land and prohibiting future development.
Chairman McNulty explained khat in the past with other
applications, it has been the Commission's opinion that
should the moratorium be lifted, residents could come in and
ask that the covenants be removed.
Mr. Benard stated that the staff had not realized the
applicant's spa was a portable plug-in spa with no hard
plumbing, and that although there would be a concern
regarding proper drainage, it would be inappropriate to
consider the spa as part of the variance. Applicant Pierson
stated he had a 4" drain on the spa patio.
The public hearing was closed.

Commissioner Brooks stated that she had visited the site and
moved staff alternative #3 to approve the Coastal Permit and
Variance as conditioned in Exhibit "A", omitting Section #6
of the Resolution and Condition #6 on Exhibit "A", and
amending Condition #4 to read "No additional square footage
beyond the approved 632 deck and 284 square foot storage area
underneath the deck in the rear yard, and the enclosed patio
and spa area, shall be added to the residence." The motion
was seconded by Commissioner Von Hagen, and passed
unanimously with Commissioner Hotchkiss abstaining.
B. VARIANCE NO. 256 The staff report was presented
6215 Picardie Road by Assistant Planner Lisa Marie
Davidson regarding the
applicant's request to approve a 277 square foot study room
and bathroom addition to encroach 12'9" into the front yard
private easement setback. Staff's recommendation is to
conditionally approve the request.
Louis Huang, 6215 Picardie Road, applicant, asked that the
staff recommendation be adopted.
Mr. Benard noted that the standard conditions had not been
attached to the staff report, but that the applicant would be
subject to landscape covenant and building permit
requirements.
The public hearing was closed.
Commissioner Von Hagen moved approval of the staff
recommendation, Commissioner Brooks seconded, and the motion
was approved unanimously.
CONTINUED BUSINESS
A. SITE PLAN REVIEW Associate Planner Joel Rojas
NO. 5338 presented the staff report
6432 Via Colinita regarding the applicant's
request to allow an existing
satellite dish antenna to remain as installed. Staff's
recommendation is to approve a modification of the
applicant's request and direct relocation of the antenna.
Mr. Benard noted that if the Commission wished to allow the
dish to remain at its present location an encroachment permit
would also be required since the dish is located within the
public right-of-way. Mr. Benard also noted that the dish
antenna is not consistent with the_ City Council approved
policy for allowing encroachments into the right-of-way.
Commissioner Von Hagen also noted that the City Attorney had
opined that cable was not a necessary alternative to evaluate
in review of satellite dish requests.

Roger Noorthoek, 6432 Via Colinita, applicant, referred to
his April 24, 1990 letter to the Commission, and asked the
City if they would accept his existing homeowners insurance
policy instead of the requested liability insurance.
Chairman McNulty stated that the City Attorney would be the
proper party to answer that question.
Marilyn Lyon, 6424 Via Colinita, neighbor, objected to the
mounting of the dish on the shed roof for safety reasons, and
asked that Site C be approved.
Robert Lyon, 6424 Via Colinita, asked if there had been any
structural studies done on the shed roof ability to support
the weight of the dish, and presented photographs showing the
potential view impact of the shed roof location. Mr. Lyon
also suggested approval of Site C.
Commissioners Von Hagen and Brooks noted that they were both
acquainted with the Lyons, but that it would not affect their
ability to vote on the issue.
The floor was closed to further testimony, and Commissioner
Hotchkiss stated that if the shed roof location were
approved, the dish should still be ground -mounted for safety,
but that he still preferred either Site B or C.
Commissioner Katherman also objected to the shed roof
location for reasons of safety, view impact and as a bad
precedent, and suggested either Site B or C.
Commissioner Von Hagen agreed that Site A, the shed roof, was
not viable for reasons including the noise impact of the dish
motors. Mr. Von Hagen also explained that the number of
satellites received did not necessarily indicate the quality
of programming received, and suggested that additional
studies be done on Site C to see which programming services
would be available to the applicant. Commissioner Von Hagen
then said that if Site C was not viable as a result of the
study, he would favor the current location.
Commissioner Brooks stated she thought the existing location
was inappropriate, and with the new availability of cable to
the applicant, it would supplement the dish signals
adequately to make Site C the most reasonable.
Commissioner Hotchkiss moved to authorize the satellite dish
to be removed from the present location and relocated in Site
C outside the front yard setback. Commissioner Katherman
seconded the motion, which passed 3-2 with Chairman McNulty
and Commissioner Von Hagen dissenting.

AUDIENCE QUESTIONS
Lois Larue, 3136 Barkentine Road, objected to the proposed
archery range, and inquired about the RDA grading application
and the minutes of March 27, 1990.
STAFF REPORTS
Mr. Benard noted that the May 8, 1990 meeting regarding the
Housing Element will start at 6:00pm.
ADJOURNMENT
