PC MINS 19880510MINUTES PLANNING COMMISSION MAY 10, 1988 The meeting was called to order at 7:35 p.m. by Chairman Connolly at Hesse Park Community Building, 29301 Hawthorne Boulevard. PRESENT: Connolly, McNulty, Ortolano, Von Hagen, Wike ABSENT: None Also present were Director of Environmental Services Robert Benard, Senior Planner Ann Negendank and Associate Planner Carolynn Wilker. COMMUNICATIONS Chairman Connolly referred to Item 7A under New Business and announced that this item would be discussed at the appropriate time. CONSENT CALENDAR Commissioners Ortolano and Wike commented on Items A, C and D. Request was made to modify Paragraph 11 of the March 7, 1988 minutes to read: ". . . regardless of proximity to project ." Notion was made by Commissioner Wike, seconded by Commissioner Von Hagen and unanimously passed to approve the Consent Calendar as amended. PUBLIC HEARINGS Variance No. 183, Coastal Director of Environmental Services Permit No. 38; 204 Seascape Benard recommended continuance on this item until July 26, 1988. Motion was made by Commissioner Ortolano, seconded by Commissioner McNulty and unanimously passed to open the public hearing and to continue this item until July 26, 1988. Conditional Use Permit No. 137, Environmental Assessment No. 546, Variance No. 202, Grading No. 1114; 29516 Miraleste Plaza Associate Planner Carolynn Wilker related staff recommendation to to continue this item for an indefinite period until issues regarding property ownership and right-of-way easements are resolved. Motion was made by Commissioner Von Hagen, seconded by Chairman Connolly and unanimously passed to open the public hearing and to continue this item indefinitely per staff recommendation. Planning Commissi6`!'Minutes May 10, 1988 Page Two Extreme Slope Permit No. 5; Associate Planner Ann Negendank 26441 Silver Spur Road presented staff recommendation to approve the existing deck subject to certain conditions. Chairman Connolly opened the public hearing. No testimony was given. The public hearing was closed. Motion was made by Commissioner McNulty, seconded by Commissioner Yon Hagen and unanimously passsed to approve this item per recommendation of the staff. NEW BUSINESS Conditional Use Permit No. 101 - Chairman Connolly reviewed the Rev. "B"; Colorado South Bay request from the La Pointe Association c/o Wickliff and Homeowners Association to Co., 28845 Western continue this item. Director of Environmental Services Benard noted that Mr. Greg Fuz, who was present on behalf of the La Pointe Homeowners Association, is a member of his staff but is not involved in either evaluating or making recommendations In this matter. Representing the applicant was Mr. Chester Latcham, Wickliff Co., 303 East 17th Avenue, Denver, who stated objections regarding continuance in order to secure the requested building permit. Mr. Fuz, 1811 Caddington Drive, related the reasons for the La Pointe Homeowners Association request for continuance. Mr. Fuz also requested that the Commission restrict the use of Caddi.ngton Drive by theater patrons, and suggested a clarification of the retail/ non -retail categories. Commissioner Ortolano noted that the request for continuance suggests that parking at the location may be affected. On behalf of the staff, Senior Planner Ann Negendank addressed the parking issue and summarized the formula for calculating the required number of parking spaces per code. She also reviewed the distinctions for the two different uses. Commissioner Ortolano pointed out that a change In designation may not have an impact on the surrounding community. Commissioner Wyke expressed her concurrence with the La Pointe Homeowners Association request for continuance. Chairman Connolly and Commissioner McNulty did not agree with the La Pointe Home- owners Association request. Planning Commiss is Minutes May 10, 1988 Page Three Commissioner Ortolano questioned the primary uses of the retail/ non -retail classifications. She also asked if Mr. Latcham was in general agreement with the recommended conditions. The Commission reviewed Exhibit "A" of Conditional Use Permit No. 101 and recommended the following modifications: (1) Add the word "entertainment" to the end of line 2; (2) add the word "or" to the end of line 3 of Condition No. 9. Senior Planner Ann Negendank addressed the specific parking standard for retail and non -retail uses. Director of Environmental Services Benard addressed Commissioner Ortolano's concern about theater seating and confirmed the proposed condition confirming that the public should vacate the theater by 2:00 a.m. Motion was made by Commissioner McNulty to: (1) not continue this item; (2) confirm that the public should vacate the theater by 2:00 a.m.; (3) approve the staff recommendations; (4) amend Exhibit "A" of Conditional Use Permit No. 101 as follows: (a) add the word "entertainment" to the end of line two; (b) add the word "or" to the end of line three of Condition No. 9. Motion was seconded by Commissioner Ortolano and passed unanimously. At 9:00 a.m. there was a brief recess until 9:10 p.m. when the meeting reconvened. Grading No. 1116; 6457 LeBlanc Place The staff report was waived. Director of Environmental Services Benard announced that the appeal period would expire fifteen days from the present date. The applicant is in agreement with the conditions. Notion was made by Commissioner Von Hagen, seconded by Chairman Connnolly and unanimously passed to approve the staff recommendation. In a discussion of Item 4C, Commissioner Wike expressed her concern about the percentages of open space. Commissioner Von Hagen strongly disagreed with Commissioner Wike's position. Commissioner Wike proposed elimination of the walkway and requested that fencing and landscaping be addressed. Commissioner Ortolano asked that landscaping plans include a provision for open fencing. Planning CommissiopMinutes May 10, 1988 Page Four Chairman Connolly asked about the project relative to the guidelines being adopted. The Commission agreed to rely on Director of Environmental Services Benard's opinions with regard to fencing. Commissioner Ortolano expressed her support for Condition No. 2 in the Le Blanc application with regard to the view obstruction covenant. Notion was made by Chairman Connolly and seconded by Commissioner McNulty to approve the staff recommendation on this item and to include the following language in the provision for landscape planning: "Landscaping plan to include open fencing." The motion passed by a vote of four to one. Commissioner Wike objected. -T- SR1(FF REPORTS SWAPC Luncheon Director of Environmental Services Benard informed the Commission of a request from SWAPC to attend a luncheon on June 3, 1988. In response to a request from the Commission regarding swimming pools in developing lots along Palos' Verdes Drive South, Director of Environmental Services Benard stated that the codes do not preclude residents the right to have a pool. Chairman Connolly inquired about the contract for the Environmental Impact Report and the Hon and Monaghan projects. ADJOURNMENT The meeting was duly adjourned at 9:50 p.m.
