PLANNING COMMISSION
November 24, 1987
The meeting was called to order at 7:30 PM by Vice -Chairperson Wike
at the Hesse Park Community Building, 29301 Hawthorne Boulevard.
PRESENT: CONNOLLY, MC NULTY, VON HAGEN, WIKE
ABSENT: ORTOLANO
Also present were Director of Environmental Services Robert Benard,
Associate Planner Greg Fuz, Associate Planner Ben Ortega, Assistant
Planner Paul Merrett and Assistant Planner Carolynn Wilker.

CONSENT CALENDAR
Minutes of October 27, 1987 Commissioner Von Hagen moved
approval of the October 27, 1987
minutes as distributed; seconded by Commissioner McNulty and passed
unanimously.

Vice -Chairperson Wike opened the
public hearing.
There were no requests to speak to the item.
Commissioner McNulty moved to close the public hearing; seconded by
Commissioner Von Hagen and passed unanimously.

seconded by Commissioner Von Hagen and passed unanimously.
Appeal rights were noted.
Variance No. 180/ Associate Planner Ben Ortega
Coastal Permit No. 37; related the applicant's request
Dimegilio and Barclay to continue the item.'
4115 Maritime
The pending revisions to the
proposal were discussed by Mr. Donald Barclay, landowner.
Commissioner McNulty questioned whether it would be appropriate
to hear the item prior to reviewing the applicant's revised plans.
Director of Environmental Services Benard pointed out that, while
the project as proposed would result in excess lot coverage, the
Commission could set the project's parameters and allow the Director
of Environmental Services to review revised plans and, if appropriate,
approve -those -revisions.
Vice -Chairperson Wike expressed her concern over the depletion
of open space at the location and noted that a revised plan could
further decrease the open space in the rear yard. She supported
a continuance of the request.
Commissioner Connolly commented on his support of a conceptual
approval of the project.
Commissioner Von Hagen explained his support to continue the item
until 7:00 PM, December 8, 1987.

Recycling for Small
Collection Facilities Vice -Chairperson Wike opened
the public hearing.

Er, Irvine, 92714, discussed: 20/201-s agreement to --supply and
maintain the recycling centers for Safeway and Hughes Markets;
the State recycling requirements; the igloo recycling machines
which 20/20 utilizes; and the related recycling process. He
requested a letter from the City explaining the items which
need addressing prior to a Commission determination.
Commissioner Von Hagen stressed that a container recycling workshop
would be appropriate. He voiced his concern over: the passive
recycling systems being trash collectors`, -'the noise problems
associated with bulk feed machines, ,"and the possibility of illuminated
signage.
Vice -Chairperson Wike commented that the item could be referred to
City Council with the understanding that it would be reviewed in
one year ,
Commissioner Connolly expressed his concern over the noise and
parking difficulties related to the large trucks picking up the
recycled material, as well as the various health hazards possibly
associated with the recycling centers. He suggested that the
Commission visit various container recycling sites prior to making
a determination. He agreed that a container recycling workshop
would be appropriate.
Commissioner McNulty concurred that various recycling sites should
be visited prior to a decision. He agreed that a recycling workshop
would be appropriate with consideration being given to such,�concerns
as noise; aesthetics; health hazards; and odors. He commented on the
Fire Department's possible concern over fire hazards related to
newspapers being placed in dumpsters.
Staff discussed the State requir'-6fabnt-st."--f-br--recyql-lng centers,
and provided input regarding,the time constraints of the issue.

Director of Environmental Services Benard indicated that it would
be appropriate to continue the item to January 12, 1988. He noted
that the City will provide a letter to 20/20 Recycle Centers
explaining the various concerns which need addressing prior to a
Commission determination. He mentioned that he will make an effort
to obtain a recycling center video for Commission viewing.

January 12, 1988; seconded by Commissioner McNulty and passed
unanimously.

For the record, Commissioner Von Hagen noted that the property was
sold to the applicant by a business associate of his prior to his
employment with Very Important Properties. He requested clarifi-
cation regarding the Commission's previous determination on the
item. He expressed his understanding of the applicant's concern
over a limitation of the hours of operation. He commended staff
on the proposed Development Agreement.
Vice -Chairperson Wike requested clarification regarding the
Amendment or Cancellation clause as included in the proposed
Development Agreement.
Staff provided information regarding the Commission's previous
determination, as included in Paragraph 3 of the applicable
resolution. Staff discussed the applicant's concern over the
hours of operation and explained the City's authority related
thereto. The applicant's concern over a 10,000 square foot
limitation of net leasable area was conveyed by staff who also
related the applicant's concern over a 50 percent limitation of
the total available net leasable area of the building on minor
office uses permitted in the CL Zone. Staff provided clarifi-
cation regarding the Amendment or Cancellation clause as included
in the proposed Development Agreement.

December 8, 1987; seconded by Commissioner McNulty and passed
unanimously.

The proponents of the request discussed: the history of the project;
the basement would not be converted into an accessory unit; the Code
requirements with regard to windows; the applicant's revised plans;
the proposed reduction in the front setback; and efforts to minimize
the impact of the project.
Those opposing the request included:

Those opposing the request discussed: concern over the large amount
of proposed lot coverage; concern over the project not blending with
the existing neighborhood; concern over a possible reduction in the
front setback; and concern over the placement of protruding stairways
on -the roof decks; and loss of views.
The feasibility of screening the front yard guest parking from the
street was discussed by Commissioner Connolly who pointed out that
a landscaping plan would minimize the impact of the proposed project.
Commissioner McNulty voiced his concern over the height of the
proposed structure; however, he pointed out that the project would
be within the building envelope. Because of his concern over the
possibility of an accessory unit in the basement, he voiced his
support of a recorded covenant prohibiting the conversion of that
area into another unit. He noted the improved architectural
treatment of the revised front facade and mentioned his lack of
concern over a reduction in the front setback, as proposed.
For the record, Commissioner Von Hagen noted that the property is
within his Homeowners' Association but that he is not acquainted
with the property owners. He pointed out that the public should
be offered an opportunity to testify to the pending Public Works
Conditions of Approval and, therefore, supported a continuance of
the public hearing.

Vice -Chairperson Wike expressed her opinion that the applicant made
an attempt to maximize the size of the proposed units. She emphasized
her positron that the project should be redesigned to minimize the
impact on the surrounding area. She noted her disagreement with a
reduction in the front setback.
Staff pointed out that the proposed pr03ect would be within the
Code requirements for the location. Staff provided input
pertaining to the front yard guest parking space and the open
space requirements for the property. Staff discussed that the
basement would not be considered a habitable space according
to the Code and that the requested Minor Exception Permit is
required for' a reduction_ -in the front yard setback.
Director of Environmental Services Benard explained the City's
requirements with regard to the proposed basement. He indicated
that a covenant could be recorded to prohibit the conversion of
that area into another unit. He pointed out that the proposed
height of the structure is within the Code requirements for the
property. He indicated that it would be inappropriate for the
Commission to make a determination prior to review of the pending
Public Works `Condi.tions- of- Ap.praval' .

staff report.
Commissioner Wike stressed her concern that the temporary for -lease
sign, which was approved for only one year in 1985, is still at the
location. She noted the Code enforcement difficulties in the section
of the City in which the property is located. She recommended that
the request be denied and that a sign program for the location be
required.
Commissioner Von Hagen related his understanding that the temporary
for -lease sign is needed.
Commissioner McNulty commented on his understanding that the temporary
for -lease sign is needed. However, he pointed out that the applicant
could be required to install an attractivesignand that the illegal
window signs could be prohibited. He explained his disagreement with
a one year time extension of the sign and indicated that the space
available at the location could be advertised via other means. He
supported a continuance of the item.
Commissioner Connolly related his support to continue the item.
Director of Environmental Services Benard provided information
regarding the - Code intent -related to temporary for -lease signs.
In response=to a question regarding another site; he -noted -that the
Wickliff Company'has-been notified of a sign violation at Portofino.
Commissioner McNulty moved to continue the item until January 12,

Commissioner Von Hagen expressed his opinion that Code Amendment No.
24 should include strict satellite dish placement requirements. He
suggested that the City Attorney's opinion should be obtained regarding
the City's ability to restrict placement in "unapproved" locations of
an alternative location is not feasible. Along similar lines, he
requested that the City Attorney be consulted regarding the City's
ability to restrict placement an "unapproved" locations if desired
channels could be supplied via cable. He emphasized his concern
over preemption and introduced the idea of a Satellite Dish Permit.
He discussed the safety problems related to roof top mounted dishes.
Commissioner McNulty agreed to strict placement requirements. He
related his opinion that the City could not force the distinction
between an antenna and cable. He voiced his concern over a three
year amortization period for existing, non -conforming uses, stating
that it should be shorter.
Vice -Chairperson Wike expressed her opinion that it would be
inappropriate to restrict use in an "unapproved" location if the
satellite dash could not be placed elsewhere.(.. -. `z VCG S,
Staff discussed the specifics of Code Amendment No. 24 and provided
input regarding restrictive placement requirements. Staff indicated
that a Draft Ordinance will be presented to the Commission for review
on December 8, 1987.
Director of Environmental Services Benard noted City Council's
growing concern over various related situations. He discussed
the difficulties associated with the placement of satellite dashes.

updated information regarding CUP No. 23 - Revision "J". He
noted that the applicant's decision to allow the application
to expire was based on a decision to redesign to meet the
standards of the original CUP.
