Garay -- 2070 Mac Arthur presented the staff report on
this request to reverse staff
approval of Hei�,ht Variation No. 423 with the recommendation that
the Commission dismiss the appeal.
Staff discussed �applicant's revised plan to include a maximum height
of 22'6" as opposed to the original height of 2518", applicant's
revised plan to include a 2:12 roof pitch as opposed to the original
request of 4:12, applicant's offer to pull back the south wall 3J feet
to further reduce the 2084 Mae Arthur (Harvey) view obstruction noting
applicant prefers the wall to remain where it was originally proposed,

the Commission's power with regard to trimming/removal of City

March 25, 1986 Planning Commission meeting, and City application
processing procedures.
The Commission discussed Commissioners not present at the 'March 11,
1986 meeting participating in the Height Variation No. 4237appeal
and the application having been substantially revised since the
March 11, 198;6 meeting.
Mrs. Catherine Garay,12070 Mac Arthur, applicant, discussed reducing
the size of the proposed addition in an attempt to reduce the 2084
Mac Arthur (Harvey) view obstruction, adding on over the garage to
not blend wel with the neighborhood, moving the proposed addition
forward another three feet stressing the lines of the existing walls
would not be as agreeable, the entry would not be useable, and the
proposed second story 10' X 8' room would be reduced significantly,
willingness to remove the rear yard olive tree, the March 24, 1986
News Pilot article pointing out that the photo did not represent the
property accurately, apprehension with regard to removing the front
yard pine tree, plans to use the second story 10' X 8' room as one
large room and the entry as an entry way or a small dining room.

The Commission discussed applicant removing the rear yard olive tree,
the possibility of applicant removing the front yard pine tree, the front
yard pine tree being taller than the proposed 22'6" roof height, 29215 Trotwood
(Apperson) view from kitchen, tree blockage of the 29215 Trotwood view,
Ordinance 194 (Code Amendment 20) containing only those sections of the Code
which were either added to or amended, City responsibility with regard to tree
trimming/the City's approved tree list, problems associated with recommending
tree removal on private property, kitchen areas with regard to primary viewing
considerations, considering each application on its individual merits, the City
Manager investigating mailing problems in the area, the Code's 16' height limit for
additions, and supporting staff's Alternative No. 3 approving applicant's first
revision (no stairway in the middle of the entry and the second story 10' x 8'
room would not be moved).
Mr. McNulty moved to adopt staff's recommendation to dismiss the
appeal and the motion died for lack of a second.

Criteria with the recommendation that the Commission discuss staff's
proposal and give direction to staff as to any changes the Commission
believes appropriate.

to the County median income, priority group members to be the first considered
as potential buyers (assuming they meet income criteria), possible priority
--groups identified in staff report, the City Attorney reviewing
affordable housing documents, State law requiring each City county
to provide affordable housing, City Council determining the selling
prices at which the units are to be sold, a first -come -first -serve
selling method, State law dictating no new construction sales are
final until a development is completed, the City's responsibility to
control priority criteria noting the City's ability to contract with
a licensed real estate broker with the administering of such a program
being taken out of the sales price, the developer providing the City
with a $3,000 fee to implement the practice, the requirement of the
City establishing priority criteria at the time the tentative map is
approved by City Council, and re-evaluating the criteria down the
road to see how it is applying.
The Commission discussed staff's possible priority groupings, mandatory
owner occupation of the affordable housing units, the City Attorney
advising the Commission as to the legalities related to priority
groupings and the legal amount of time allowed to establish the criteria
in an effort to handle the item in a most knowledgeable manner,
considering individual priority groupings as opposed to formulating a
City priority grouping ordinance or statute, the City controlling
resales, concern over the City's responsibility for administering the
criteria, the appropriateness of including City employe— in_the
pri-6-ri-fy- —groupings, including only RPV residents and not Peninsula
residents in the criteria, the. 5','year resale controls, and setting up

height reduction), the 4 foot parapet to be for concealing any roof mounted equipment,
the cost involved in lowering the 24 foot elevation, matching Crest grade elevations
for ease Of access, re0OYfOg trees blocking Catalina views for the six units at Ocean Crest
and Hawthorne, and agreement to moving the monument sign.
Mr. Frank Geoon/ 97 Cresta Verde, Rolling Bills Estates, representing
the Cresta Verde Condominium Association, discussed concern over view
obstruction, pole placement having never taken place, concern over
rooftop equipment, placing equipment in the underground parking area,
traffic difficulties as a result of the building, the closest unit to
the proposed pro]ect to be approximately 300/400 feet' and having
received notice of the March 25, 1986 Planing Commission meeting.

The Commission discussed the Hold Harmless Agreement as not being
enough City protection, the project adversely affecting the
surrounding properties, a deeper building foundation, compacting
the fill, the monument sign being part of the application and
meeting the sign lode, applicant reducing the proposed height as
much as possible, continuing the public hearing and asking applicant
to redesign the pro3ect, concern over adequate parking/neighborhood
and Hughes -Market parking problems as a result of the proposed
building, the City Geologist's stabilization recommendation, 'caisson - s,
addition requests with regard to compacted fill, State/Federal
approval with regard to the Blue Butterfly, the 9 foot perimeter
wall, and-setting•a two month time limit,,onapplicant removing the
vacafft building.

a height limit which will not impair the view from the condominiums
at the southwest corner of Ocean Crest and Hawthorne and, if the
obstruction cannot be improved, to bring back documentation stating
why. Mrs. Ortolano seconded the motion.
The-Ccmmiss-ion-further discussed applicant placing the rooftop
equipmentirCllthe underground parking area/Open Space Hazard Zone,
concern over inadequate parking/parking reduction as a result of
the rooftop equipment being placed in the underground parking area,
requiring applicant to improve parking, flash flooding, fire hazards,
the proposed structure design, the proposed color scheme of gray/
white, an alternative color scheme of earthtones, and handicapped
parking space location.
Staff discussed the proposed color scheme of gray/white to be an
agreeable one and handicapped parking spaces to be located where one
does not have to cross traffic lanes to access buildings.
The motion was passed unanimously.
Staff noted that, since the public hearing was not continued to a
specific date, the item will be renoticed.
Applicant stated intentions to apply for an extension in order to
modify plans.

discussed the Commission asking
staff to request City Council to consider secondary access for the
Golden Cove Project through City parkland adjacent to the.�ro v

commercial property, thereby resolving easement problems with St. Paul's Church,
Golden Cove Center and the Admiral Risty.
Commission Chairman Von Hagen asked the Commission
to consider the memo from the City Attorney
