The Commission discussed the September 1988 time limits Of Resolution P. C. No. 82-20
and Council Resolution No. 82-66° landslides, the proposed tract to not be horse - lots,
the large potential liability on the Homeowners' Association for maintenance of the
extensive common area, the potential problems involved with the developer maintaining
the common area, perimeter trail maintenance and maintenance of the trail along
Forrestal with regard to the CC & Rs, and the common area was noted as over lOO acres
with the gross acreage as 163 acres.
The Commission discussed Council Resolution No. 82-65 as follows: Condition No, 15
was discussed to include all 47 lots, Street lights referenced in No. 29 were discussed
to be necessary, and approval of the grading plan prior to the final map as mentioned
in No. 31 was discussed.
The Commission discussed Resolution P. C. NO. 82-20 as follows: Condition No. 7E
was discussed to be a continuing condition with the properties, NO, 7H was discussed
with regard to trails within the public right of way and those inside the tract,
No. 7K was discussed and the "1990 dollar amount" was clarified as the year, and No. 10
was discussed to mean the Tentative Tract Map is not approved by the Planning
Commission and the Commission recommends action on the map to the City Council.
Chairman Von Hagen opened the public hearing.

conditions attached to the Revision of Tentative Tract Map 37885.
The Commission discussed the Homeowners' Association/developer installing a
barrier along Forrestal as a safeguard against dumping.
Sunshine, 6 Limetree Lane, Palos Verdes Peninsuil'a Horsemen's Association,
dis .ssed the grading for Lots 45 and 46 could include trail access at the end
of Forrestal and the landscaping design with reference to damage by horses.
Mr. Alfred Sattler, 835 - 29th Place, San Pedro, South Bay P. V. Regional Group VF
the Sierra Club, voiced concern over the proposed tract's effect On the local
hiking programs and stressed the Sierra Club's willingness to work on trails in
the area.

These residents voiced concern Over dumping, motorcycle traffic, landslides,
the possibility of a trail extending down to Pirate, excavations, view impair-
ment, inadequate meeting notification, upkeep Of the north side of Lot 47, trail
preservation, density law inconsistencies, traffic, the access road to the dump
site, and the possibility of subdividing the lots in the future. In addition,

residents discussed the developer being bonded to protect against possible
land movement, a barrier along Forrestal being installed for protection against
dumping, a portion of Lot 47 being used as a greenbelt, the General Plan with
regard to promoting open space access, multi -use trails, easements for public
access to open space areas, private ownership affecting access to open space
areas, street light installation for safety and dumping discouragement, the
past ten years of public access as a guideline for preservation, the Califor-
nia State Supreme Court Cases upholding the public right to keep the land
open, and Palos Verdes Blue Butterfly sightings (Kendall).
The Commission discussed trail maintenance responsibility noting the beneficiaries
of trail improvements as the public who walks and rides the,trails, and homeowners
who have horses elsewhere, its intentions to protect as much view access as possible,
the existing condition of approval prohibiting blasting, dumping problems when the
existing barrier near Ladera Linda is removed, the Code's hours of operation on
building as applying, an easement for preserving public access to the land, the Trails
Network Plan and the extension of the trail down Forrestal, trail maintenance costs
with regard to liability insurance, the Palos Verdes Blue Butterfly, the developer
as not being responsible for undergrounding any utilities outside the development,
eliminating the 100 acres of common open space from the proposal, problems associated
with the project's lengthy start up, and suggested the Horsemen's Association assist

Mrs. Wike read the following information regarding yearly horse trail maintenance
for I-, miles of trail in "The Ranch: development in Rolling Hills Estates (source,
"The Ranch"): $1900 - for $3 million liability insurance
4800 - Weed abatement
2000 - Wood chips
2000 - Maintenance of wood fences
$10,700 / year for 139 homes @ $920 per year per home.
The Commission discussed Council Resolution No. 82-66 in regard to deleting 7_onT1—tion
No. 29 and inserting a condition stating, "Street lights are included in the develop-
ment with the Public Works Department recommending the appropriate number of lights."
The Commission also discussed Resolution P.C. No. 82-20 in regard to deleting the
"paths/trails" from Condition 7A noting concern over non-users being field liable for
trails and discussed deleting Condition No. 21.
Staff stated the elimination of the 100 common open space areas from the proposal
would require a new subdivision and the access road to the dump site would be
near the driveway of Lots 45 and 46.
Mr. McNulty moved to adopt Resolution P.C. No. 86 -.-recommending City Council
approval of (1) the Supplemental Environmental Impact Report to Final Environmental
Impact Report No. 16, (2) the Revision to Tentative Tract Map.No. 37885, and approv-
ing the revisions to Conditional Use Permit No. 79 including a change in Condition
No. 29 of Council Resolution No. 82-66 to the extent that, "Street lights shall be
installed in a manner pursuant to the recommendations of the Public Works Department
and the maintenance costs of the street lights will be attributed to the Homeowners'
Association" and a new condition be added to read, "The owners must, in the CC & Rs,
specifically spell out in broad language and bold, underlined type that the project
area includes the Homeowner Association's obligation to maintain all the common
area included in the tract and equestrian trails or other trail networks within the
tract, assuming all liability and costs therefor and shall duly record same on all
grant deeds." Mr. Von Hagen seconded and the motion passed by majority with
Mrs. Wike dissenting. The Commission requested this item be included under the
Consent Calendar at the February 11, 1986 meeting.

Mr. McNulty moved to continue Item VB2, Grading 845 and Grading 846, and Item _
VIA1, Variance No. 131 and -CUP No. 104, to the Planning Commission meeting of
February 11, 1986 and begin the meeting at 6:30 PM. The motion was seconded
by Mr. Von Hagen and passed unanimously.
Tentative Tract Map 44239 Chairman Von Hagen noted this item will
and CUP No. 100 be included on the agenda for the regular
Golden Cove Planning Commission meeting February 25, 1986.
Associate Planner Steve Rubin presented the staff report on the RPV Investors/Bredero
Hawthorne request for approval of a 49 -unit townhouse condominium project with the
recommendation that the Commission open the continued public hearing, take public
testimony, discuss the items in staff's report, provide staff and applicant with
direction, and continue the public hearing to February 25, 1986.
Staff discussed water problems at Golden Cove and noted no evidence of same at
the property site, roof slopes, view impairment, landscaping, and traffic circulation
noting more detail will be provided February 25, 1986.
The Commi.ss.ion discussed: Jviews/.r.idgeT-ines-with-regard to -the 20 view plane encroach-
ment, no General_P_lan vista identified from Hawthorne, "C" Street maximum elevations
4 feet lower than proposed ridgeline heights, access with regard to the number of
entrances/exits, the idea of a left turn/U turn pocket at the new City Hall entrance,
problems with "Right Turn Only" exits from the development, and the storm drain
system/Los Angeles County Flood Control approval.
Chairman McNulty opened the public hearing.
Mr. Howard Adler, 505 No. Tustin, #246, Santa Ana, applicant, discussed: view
impairment, traffic access, project review in an effort to make as little impact as
possible, planned installation of 400 cu foot enclosed storage units in garages,
20 foot minimum setback noting plans to move the affected building back to meet the
setback requirement, no variance requests, fencing removal along Hawthorne/42" b-l-o-ck_

The Commission discussed: a second access with regard to the Church concern over noise
interference and church parking lot use, 400 cu feet of enclosed storage in garage
and the rec center as including a pool and patio with changing rooms.

These residents voiced concern over access problems, traffic/noise pollution,
density, soil stability, and drainage. Residents also discussed developer bonds
during grading, the Hawthorne "dipping" effect, affordable housing, geology,
fencing, and the need/desire for more commercial establishments in the area.
Staff discussed the soil content/expansion material to be silty clays and stated
design of building foundations must be with the worst situation in mind._ Staff noted the
Hawthorne "dipping" effect to be the result of compacting of fill -
