PC MINS 19850910MINUTES PLANNING COMMISSION September 10, 1985 The regularly scheduled meeting was called to order at 7:35 P.M. by Chairman McNulty at Hesse Park Community Building, 29301 Hawthorne Boulevard, Rancho Palos Verdes. PRESENT: , MCNULTY, ORTOLANO, VON HAGEN ABSENT: WIKE LATE ARRIVAL: HODGE (7:40) Also present were Director of Environmental Services, Sharon Hightower; Associate Planner Steve Rubin; Assistant Planners Greg Fuz and Jack Roberts; Senior Planner Ann Negendank. COMMUNICATIONS Letter from Palos Verdes Peninsula Horseman's Association. CONSENT CALENDAR (Commissioner Hodge Arrived). Minutes of July 9 and 23, 1985 Mr. Von Hagen noted that on Page 5 of the July 9, 1985 Minutes, the address 2139 Calle Ola Verde was incorrect and requested that it be changed to 2139 San Nicholas. Chairman McNulty requested that the phrase "Chairman McNulty made the following statement for the record" on Page 2, Paragraph 3 of the July 9, 1985 Minutes be changed to "Chairman McNulty made the following statement" - omitting the word 'record.' Mrs. Ortolano suggested that the phrase on Page 7 of the July 9, 1985 Minutes, "Mrs. Wike noted for the record" should remain as is. The Minutes of July 9 and July 23 were unanimously accepted. CUP No. 91 - Request for Extension Mrs. Ortolano moved that the two-year Miraleste Elementary School extension be granted, seconded, and passed unanimously. Minutes September 10, 1985 Page - 2 - Resolution P.C. No. 85-24 Approved as presented. Denying Tentative Parcel Map 16748 - Appeal CONTINUED BUSINESS INFORMAL HEARINGS CUP No. 23 - Revision V - Appeal The staff report was presented by Hanger, Lot 2, Tract 32991 Assistant Planner Greg Fuz, who outlined the review made by Council and that the item was referred back to the Commission. Staff recommended the revised plans which provides 23 feet of side setback, Alternate A. Robert L. Earl, Architect representing Hanger, requested Alternate Plan B be approved; the west corridor is the criteria. The Commission discussed the two alternatives. Chairman McNulty moved that Alternate Plan B be approved; seconded by Mr. Von Hagen. The motion passed on a 3-1 roll call vote as follows: AYES: ORTOLANO, MCNULTY, VON HAGEN 1 ii Chairman McNulty informed the applicant of his appeal rights. NEW BUSINESS Code Amendment No. 21 Environmental Assessment No. 475 Senior Planner Ann Negendank presented the staff report and recommended approval. Commission questions included the issue of adding 251 or more to the building's gross floor area, tne proposed project vs. what exists, 7tKel­anguage, provisions for private streets for equestrian easements. Chairman McNulty opened the public hearing. Sunshine, 6 Limetree Lane, representing Palos Verdes Peninsula Horsemen's Association, stated support for the amendment, that there were 75 miles of trails already in use in Rancho Palos Verdes not dedicated, the code amendment should not allow for new trails unless the existing ones have a blockage, the Trail Network Plan does not en- force this code amendment, and that the Planning Commission be the ones to consider modifications and that there should be offers of dedication made,not actual easements required. Minutes September 10, 1985 Page - -3 - Ray Mathys, 5738 White Cliff Drive, addressed proposed dedication concerns, the main- tenance of the proposed trails, the distance of the trails from the homeowner's pro- perty, and that this is not a horse community. Responding to a question he stated that trails implementation issues and others per- taining to this code amendment need to be addressed before it is adopted. The close proximity of these trails to residential structures need to be addressed. Richard hubacek, 2127 General Street, representing the Palos Verdes -South Bay Sierra Club, stated he had no specific concerns, but that the Club is out there to help. They do a lot of hiking in the Palos Verdes Peninsula and they would like to help develop trails and with their maintenance. Marge Flynn, 6733 Vallon Drive, Rancho Palos Verdes, representing the Council of Homeowner's of Rancho Palos Verdes, stated she was here on behalf of Naomi Phillips, acting President of their Council. She expressed the concern of the Council of the proposed language of this code amendment, and that there is a discrepancy between the "public notice" and the actual text of the proposed code amendment; the Council requests that this code amendment be deferred until accurate public notice is made and all potentially affected property owners within 500 feet of any required ease- ment be duly notified. She submitted a letter reflecting these concerns signed by her on behalf of Naomi Phillips. Chairman McNulty moved to continue the public hearing; seconded by Mrs. Ortolano, and passed unanimously. Variance No. 128 The staff report was presented by Rizzi u Assistant Planner Greg Fuz, who 30503 Santa Luna Drive gave two alternatives for revision: move the proposed project closer to the house or build a new two -car garage. Staff recommended denial since feasible alternatives exist. Commission questions included if the property must be brought up to current code, if the grading permit has been granted, and if a garage is required or a carport. Chairman McNulty opened the Public Hearing, Behshad Shokouhi, 3515 Vista Haven Road, Sherman Oaks, architect representing Rizzi, stated that if the carport was to be built anywhere else around the property it would block the applicant's view, the existing pits were dug before construction for geo- logical tests to enable pouring of foundation, all work being performed has been ap- proved by the City, and that due to the fact that this house is an -irregular shape with no two -car garage, it allowed only a drive-thru. .i i i Minutes September 10, 1985 Page - 4 Roger Rizzi, 30503 Santa Luna Drive, stated he had spoken to the neighbors south of him and they approved the proposed construction. Mrs. Ortolano moved to close the public hearing, seconded by Chairman McNulty; and passed unanimously. The Commission discussed the points to be considered to make findings, such as the shape of the lot, area the property is loEzktAd, and that this house was built before the City incorporated',' the staff alternatives, and open space requirements. Mr. Von Hagen moved to deny the application; the motion died. Chairman McNulty informed the applicant of his appeal rights. Recess was taken for five minutes at 9:45 P.M. Meeting reconvened at 9:50 P.M. NEW BUSINESS INFORMAL HEAR114GS Height Variation No. 411 - Appeal Berini 30629 Rue de la Pierre effect. The staff report was presented by Assistant Planner Jack Roberts, for this appeal of staff's decision, and recommended denial due to cumulative The Commission noted that the architect had revised the plans, the new plans would increase the ridge by 3 feet instead of 8 feet as in the original proposal denied by staff. Chairman McNulty asked if there had been a view analysis on revised plans. Mr. Roberts responded no, but it could be compared with the photographs. Mary Berini, 30629 Rue de la Pierre, stated that the reason for construction was to add two more bedrooms, family room, and another bathroom. David C. Buchholz, 27067 Silvermoon Lane, Rancho Palos Verdes, the applicant's Agent, submitted photographs. He explained that the house was 25 feet in height above natural grade. He stated that the architecture was good and this height increase was not obstructing anyone's view. The Commission questioned whether with the revised plans of only a 3 foot increase if space reduction would pose a problem. .A Minutes September 10, 1985 Page - 5 - Gary Maxwell, 1455 Crenshaw Blvd., #200A, Torrance, architect, stated that they could live with it. Mrs. Ortolano moved to deny the height variation; motion died. Mr. Von Hagen moved to grant the appeal with the condition the ridge line not exceed 22 feet; seconded by Mr. Hodge. Discussion included concern with other properties' view being obstructed, there being no procedure to notify properties beyond 500 feet, and whether the revised plans would significantly impair anyone's view. The motion was passed on a 3-1 roll call vote as follows: AYES: HODGE, MCNULTY, VON HAGEN NOES: ORTOLANO It was requested that applicant resubmit their design. Applicant was informed of her appea`1 rights. Grading No. 825- Appeal The staff report was presented by Wong Assistant Planner Greg Fuz, who 3825 Crest Road stated the satellite dish exists and is, by interpretation, in an open space hazard zone. He stated that a second consideration was whether it would comply with Code No. 20; staff recommended denial. Melissa Wong, 3825 Crest Road, -stated that this was the most practical area for the satellite dish and that it would only cover a quarter of one square foot, they sent Out a notification letter, this was not located in hazard space, the lot existed be- fore the City, and the dish weighs- only 200 pounds. Mr. Von Hagen moved to approve to allow the satellite dish to remain, and that applicant must get a minor exception permit; seconded by Mr. Hodge and passed unanimously. No Commission reports. Staff Specific Plan No. 2 Associate Planner Steve Rubin stated Status and Hearing Date that September 25 has been scheduled for another workshop on Specific Plan No. 2. Minutes September 10, 1985 Page -- 6 - Director Sharon Hightower requested that the hearing date for the Specific Plan be a separate meeting. She suggested Wednesday, October 16 be tentatively scheduled. ADJOURNMENT There being no further business, the meeting was adjourned at 10:45 P.M.
