PC MINS 19850611MINUTESd * PLANNING COMMISSION JUNE 11, 1985 �y The meeting was called to order at 7:30 p.m. by Chairman McNulty at Hesse Park Community Building, 29301 Hawthorne Bouelvard. PRESENT: MCNULTY, VON HAGEN, WIKE ABSENT: ORTOLANO Also present were Director of Environmental Services Sharon Hightower, Senior Planner Ann Negendank, Associate Planners Alice Angus and Steve Rubin, Assistant Planner Greg Fuz and Secretary Ann Brenesell. COMMUNICATIONS Brief discussion ensued relative to Dr. Stephen's letter and Chairman McNulty agreed to prepare a response for Commission review. CONSENT CALENDAR Minutes 5/28/85 With Commission consensus, a correction was made to page 5, last paragraph, last sentence: ...with the condition that the applicants shall remove all temporary structures prior to the expiration of C.U.P. 97. Mr. Von hagen moved to approve the minutes of 5/28/85 as amended; seconded by Mrs. Wike and passed unanimously. Resolution P.C. No. 85-11 The resolution was approved as St. Pauls Lutheran Church presented. OLD BUSINESS TTM #43725/CP#15 The staff report was presented Wong by Associate Planner Steve Clipper Road/PVDS Rubin which recommended adoption of Resolution P.C. No. 85-12, subject to the revised conditions (presented to the Commission at the meeting). Chairman McNulty opened the public hearing. With no comments, and no one to speak to the item, Mr. Von Hagen moved to close the public hearing and to adopt Resolution P.C. No. 85-12; seconded by Mrs. Wike and passed unanimously [and to recommend that City Council authorize the release of the letter of credit for landscaping and grading which was posted for Tract 329771 Chairman McNulty advised the item is appealable to City Council within 15 days. Miscellaneous Code Amendment #20 Senior Planner Ann Negendank presented the staff report and provided background relative to the notification process and acknowledged that no public hearing notice was sent to the Homeowners Associations prior to the May 28 meeting. Minutes June 11, 1985 Page 2 She reviewed the pending issues and stated the proposed Height Variation changes simply codify the already existing procedure. Graphics were presented to clear-up some confusion relating to extreme slope permits for cantilevered decks, and it was recommended that the Planning Commission take additional testimony and continue the public hearing to the July 9 meeting. At that time, staff would bring back a resolution including changes to the language recommended by the City Attorney. The public hearing was opened by Chairman McNulty and with no one to speak to the item, Mr. Von Hagen moved to close the public hearing at that time; seconded by Mr. McNulty and passed unanimously. Commission concerns related to the issue of "primary view" and the determination of that view left to the discretion of the Director of Environmental Services. A suggestion was made to add more specific language to include determination by the Planning Commission also. In opposition to this idea, it was stated that the language would be redundant since the Planning Commission already has the right to reconsider staff's decision by means of an appeal by the applicant. Further discussion ensued centering around the subjectivity of determining views. Director Hightower was asked to clarify '"primary view", and she iterated that it has been a policy agreement between staff and the Planning Commission to use the primary living area as the determining criteria. 04 of_�01%5 The•-srarYse s of the Commission -was--te accepU the language for Heingt Variation presented in the draft. Discussion ensued regarding mailing of the Notice of Decision and whether notification to 3ust the applicant, and initial respondents was adequate. By Commission consensus, the matter was tabled for further discussion at a later date. Mr. Von Hagen moved to continue the public hearing to July 9, seconded by Mrs. Wike and passed unanimously. Staff would prepare a resolution for Commission action at that time. Mrs. Wike read the following prepared statement into the record: "For the record, June 11, 1985, the staff report of May 28, 1985 paragraph 2 states that 'a public notice was sent to every home- owner's Association within the city'." Public testimony revealed that those Homeowner's association Presidents present did not receive notification of a public hearing for Code Amendment #20. Minutes June 11, 1985 Page 3 One of the Commissioners requested a list of those Homeowner's Associations that were notified. It was then that staff apologized for a failure to carry out the notification as instructed by the Chairman of the Planning Commission. Staff reported it as an oversight." NEW BUSINESS Encroachment Cartwright 30630 Calle Permit #1 de Suenos the Homeowners Association. The problems regarding unauthorized activities. Associate Planner Steve Rubin presented the staff report and stated the request was to place a wall/gate across a City ease- ment and common lot owned by applicant's request is due to public use of the area for evening 6/9-%/0 Staff aired cohern regarding the width of the gate for emergency vehicle access. An irrevocable offer of dedication was considered and discussed as an alternate solution. John Cartwright, applicant, 30630 Calle de Suenos, objected to Conditions 5-8 as recommended by staff. He presented photo- graphs and a memorandum for Commission review. Referring to his memo, he stated his reason for the request was because of illegal activities such as dumping, petty vandalism and unauthorized access to Los Verdes golf course. When Mr. Cartwright was asked his opinion regarding an irrevocable offer of dedication, he replied that it was probably a better solution than the encroachment permit. The Commission supported staff's recommended conditions numbers 1 through 4 and made the following changes: Numbers 5 & 6 were deleted. The last sentence of #7 was deleted and replaced with the requirement that "the existing boulder and landscaped 'barrier' be maintained by the owner of Lot 1, Tract 33034; should these be changed, plans shall be submitted to the Director of Environmental Services for review and approval." Condition #8 was amended to require a 13 foot gate width instead of 15 feet. Mr. Von Hagen moved to approve Encroachment Permit #1 subject to the amended conditions; seconded by Mrs. Wike and passed unanimously. Chairman McNulty advised that the matter is appealable to City Council within 15 days. Minutes June 11, 1985 Page 4 New Business Grading #807, Miscellaneous Associate Planner Steve Hearing, Kennedy, Rubin presented the staff 6400 Corsini Place report of 6/11/85 which recommended denial of Grading #807. He stated that although the proposed structure would not visually impact surrounding properties, staff's primary concern related to the steepness of the slope and the size of the addition. Ronald Ettinger, 4232 Commonwealth, Flintridge, architect, stated the addition would provide primary living area and at a future date, the downstairs would be converted to family living quarters for the applicant's parents. He also said the applicant wished to use the home for his business. When Mr. Ettinger was asked if the addition would ever be used as a separate unit, he replied that it was primarily bedrooms with no separate access and no kitchen facilities. Another Commission concern centered on possible drainage from the septic tank causing erosion of the slope. Ken London, 20350 Sherman Way, Canoga Park, geologist, said he prepared the preliminary geology report and in his opinion the slope was stable. He said the septic tank would be 10' below ground level with a 2,000 gallon capacity. He said the footings would be 8" deep x 16" wide and , 3' into bedrock. Chairman McNulty closed the public hearing. The Commission consensus was that the proposed project is extremely large for the site but that it is designed for minimum view impact to surrounding properties and that there did not seem to be a suitable alternate location. There was agreement also that geology is an important issue and that the application must receive approval of the City Geologist. Therefore, Mr. Von Hagen moved to approve Grading #807 as proposed with the understanding that approval must be received from the City Geologist; seconded by Mr. McNulty and passed unanimously. Grading #798 - Appeal The staff report was presented Dewey by Assistant Planner Greg Fuz 3720 Vigilance which recommended denial of the appeal. Alternate locations were discussed and it was agreed by the Commission that there were none. Mr. Dewey, appellant, 3720 Vigilance, supported the request and stated he would be willing to landscape around the panels to protect against erosion and to install screening. He said the size and number of footings could also be reduced by perhaps 50 to 600. He thought roof mounting would impact surrounding properties and any other location would not be feasible; thus the proposed location offered the most ideal exposure with minimal view impact. U Minutes June 14, 1985 a page 5 Commission concerns centered around the number of footings in the slope, the number of panels, the aesthetics of the panels, and potential erosion due to panel runoff. Staff recommended the applicant redesign the project subject to a 50% reduction in area of panels and number of footings and to protect the slope from runoff. Mr. McNulty moved that the applicant redesign the project and bring it back to the Planning Commission at a later date; seconded�by Mr. Von Hagen and passed unanimously.
