PLANNING COMMISSION MEETING
FEBRUARY 12, 1985
The meeting was called to order at 7:35 p.m. by Chairman McNulty at
29301 Hawthorne Boulevard.
PRESENT: MCNULTY, BROWN, ORTOLANO, VON HAGEN, WIKE
Also present were Director of Environmental Services Sharon Hightower,
Assistant Planner Greg Fuz and Secretary Ann Brenesell.

CONSENT CALENDAR
Minutes of 1/29/85 Under Commission Reports,
there was a typographical
error.
Mr. Von Hagen moved to approve the minutes as amended; seconded by Dr.
Brown and passed unanimously.
OLD BUSINESS

Kerwin recommended further continuance to
the February 29, 1985 meeting.

Dr. Brown moved to continue the public hearing until the February -29, 1985
meeting; seconded by Mr. Von Hagen and passed unanimously.
SUMMARY VACATION EASEMENT
Lot 19, Tract 31714 Director Hightower gave a brief
staff report which recommended
wording requested by the
the Planning Commission
regarding not vacating the pedestrian easement until such time as the
ultimate use of the adjacent School District property is established and
that the Planning Commission consider the encroachment permit process,
should application be made to utilize the easement.
Members favoring the encroachment permit process thought it was a viable
vehicle for the potential home buyer to have reasonable rights to the easement
area with some degree of exclusivity while protecting the rights
of theCity until the school property disposition is known.

Chairman McNulty moved to recommend to City Council not to vacate the
easement and that Planning Commission would consider encroachment permit
application attaching necessary conditions commensurate with the request;
seconded by Mrs. Ortolano and passed on a 3-2 vote with Dr. Brown and
Mrs. Wike dissesnting.

Assistant Planner Greg Fuz presented
the highlights of the 2/12/85 staff
report which recommended
review of the application and plans
(1) to approve project as proposed or
the plans to conform to the setbacks
Commission concerns centered on zoning clarification, specific conditions of
approval and the possibility of creating an MEP/Variance situation.
Chairman McNulty opened the public hearing.
The only resident to address the item was Dave Whittlesey, 32524 Seacliff
Drive supporting approval of the application. As a representative of the
area's Architectural Committee the only concern stated related to aesthetics.
He requested the roof color be in keeping with the surrounding area.
Mr. Von Hagen moved to close the -ptlbi a hearing; seconded by Dr. Brown and
passed unanimously.
Comments in opposition centered on its cumulative effect; the structure being
too large for the lot size creating an impact on the view corridor and
reduction of open space.
Consideration was also given to the owner's right to build within reasonableness
with conditions to control vegetation.
Mrs. Ortolano moved to direct the applicant to redesign plans to conform to
the setbacks and open space requirement as established in the original site
plan; seconded by Dr. Brown and passed on a 3-2 vote with Mr. Von Hagen and
Chairman McNulty dissenting.
REPORTS
Staff Director Hightower distributed
copies of Code Amendment #20
report to Council drafted
by staff. The Planning Commission concurred with staff to request a
work session with City Council.
Commission Chairman McNulty reported on
his joint Committee Chairpersons/
Mayor meeting.
Mrs. Ortolano reported she would not be in attendance at the next Planning
Commission meeting on February i9, 1985.

It was the consensus of the Comrrision that the Vice Chairperson attend the
City Council meetings when the Chairman could not attend.
