PC MINS 19770426M I N U T E S City of Rancho Palos Verdes Planning Commission Regular Adjourned Meeting April 26, 1977 The meeting was called to order at 7:40 p.m. in the City Council Chambers, 30942 Hawthorne Boulevard, by Chairperson McTaggart. PRESENT: Bacharach, Blue, Hughes, Rosenberg, McTaggart ABSENT: None Also present were Associate Planner Gary Weber and Assistant Planner Keith Turner. MINUTES APPROVAL on motion of Mr. Hughes, seconded by Mrs. Bacharach, and unanimously car- ried, the minutes of the meeting of April 7, 1977, were approved with the following amendments: Section 2,A, should read "Strike first ( ) and the words in the second ( ); Section 3,A 2., should read "primary view of structure or pad....."; below Section 5,A, add "5.B Delete." On motion of Mr. Blue, seconded by Mr. Hughes, and unanimously carried, the minutes of the meeting of April 12, 1977, were approved with the fol- lowing amendments: page 2, end of paragraph 14, add "Director Hightower said the environmental impact report and other available information was sent prior to this meeting, but that Staff would re -send it." On motion of Mrs. Bacharach, seconded by Mr. Hughes, and unanimously car- ried, the minutes of the meeting of April 14, 1977, were approved with the following amendments: page one, Subregion 1, should read ".....density of up to 1 du/ac. was appropriate. There was agreement that clustering was not appropriate."; and Subregion 2 should be changed to read "Subregion 3." The Commission discussed with Mr. Slauta the request by his neighbor in opposition to postpone hearing Grading Application No. 152 until 10:15, as he was not able to be present before that time. The Commission agreed to place this item at the end of the meeting, as they felt all input was im- portant, but did not wish to 'postpone it to a specific time as they could not predict the time of adjournment. On motion of Mr. Rosenberg, seconded by Mr. Blue, and unanimously carried, the item was moved to the end of the agenda. TENTATIVE TRACT MAP NO. 29795 Mr. Weber said that following the last Via Campesina meeting, the applicant submitted a Applicant: N. E. Nordahl, et al revised map intended to meet the con- cerns of the Commission, in which the tennis court was eliminated, the road- way was realligned to the mid-portion of the site, the lot configuration was redesigned and one lot was added. He said, as requested, staff has evaluated the feasibility of establishing a grading/construction restriction line and determined that such a line is not only feasible, but is desirable, and he suggested the criteria as shown in the staff report be used to deter- mine the location of the line. Staff recommendation is that the Commission recommend to the City Council approval of the map subject to the conditions listed in Exhibit "A" and in the staff report, with the additional condi- tion for a requirement that the cul-de-sac be changed to reflect the con- cerns of the Fire Department, either widened to a 30 -foot radius or to a hammerhead. Re condition #30, as requested by Palos Verdes Estates, staff recommends this condition either be altered or deleted. Mr. McTaggart agreed that condition #30 should be altered, as he felt the applicant should only be responsible for repairing any damage caused by him. Norm Nordahl said he was glad about the changes as it is now more compat- ible as a development than it was before. He said a hammerhead could be done rather than the cul-de-sac. • Public discussion was closed. -to The Commission discussed the width of the road and possible parking prob- lems, the formation of an assessment district and incorporating a build- ing height into the CC&Rs. On motion of Mr. Rosenberg, seconded by Mr. Blue, and unanimously carried, a provision was added to Exhibit "A" requiring the formation df an assess- ment district as a condition of approval. On motion of Mrs. Bacharach, seconded by Mr. Hughes, and unanimously car- ried, condition #20 was changed to read ".....'no parking' on one side of the street due to....." On motion of Mr. Rosenberg, seconded by Mr. Hughes, and unanimously carried, condition #24 was deleted. On motion of Mr. Rosenberg, seconded by Mrs. Bacharach, and unanimously carried, condition #30 was changed by striking the remainder of the sen- tence after ".....construction of the project." Mr. McTaggart asked Staff to work on an alternate solution for the im- provement of the street, a condition perhaps that if the money is not spent within three years it be reimbursed. Mr. Rosenberg was still concerned about the accuracy of the figures used, and Mr. weber explained that condition #2 requires specific lot sizes and if the .figures are not correct, they would have to be brought into con- formance. P4ike Nichols, Lanco Engineering, explained how they arrived at these num- bers. On motion of Mr. Hughes, seconded by Mrs. Bacharach, and unanimously car- ried, the cut-back (spur) into Lot #1 was deleted, and all cuts and fill for the access road are not to exceed a slope ratio of 2:1. On motion of Mr. Rosenberg, seconded by Mr. Hughes, and unanimously carried, condition #34 was added to Exhibit "A" requiring that the CC&Rs reflect view protection; and condition #35 was added requiring a building restric- tion line. Mr. Blue proposed a motion, seconded by Mr. Hughes, recommending to the City Council approval of Tentative Tract Map No. 29795, subject to the conditions within Exhibit "A" as amended. Roll call vote was as follows: AYES: Bacharach, Blue, Hughes, Rosenberg, McTaggart NOES: None ABSENT: None Mr. Rosenberg requested that the Commission discuss at the end of this, meeting the possibility of requiring that the CC&Rs become part of the approval of the tentative tract map rather than the final map. RECESS At 8:45 p.m. a brief recess was called. The meeting reconvened at 8:48 p.m. with the same members present. GRADING APPLICATION NO. 160 Mr. Weber explained that the original 2135 Chandeleur Drive application proposing 423 cubic yards Applicant: Joseph Coia was approved by staff on March 28, but that since, a geologist and the County Engineer have agreed that cor- rective grading is necessary in order to stabilize the slope. Therefore, the applicant seeks approval of an additional 1100 cubic yards. Staff recommendation is for approval subject to the condition listed in the staff report. Russ McGuire, South Bay Engineering, said the applicant had hired the geologist to do a soils report and that they must follow his recommenda- tion for corrective grading. P.C. MINUTES 0 -2- 4/26/77 Public participation was closed. Mr. Rosenberg proposed a motion, seconded by Mr. Blue, to approve Graql�.ng Application No. 160 subject to the condition that a registeredj_ hgi- neer certify that the final land contouring relative to the buttresses is reflective of the existing topographic condition and that this be done prior to final grading inspection. Roll call vote was as -follows: AYES: Bacharach, Blue, Hughes, Rosenberg, McTaggart NOES: None ABSENT: None GRADING APPLICATION NO. 169 Mr. Weber said the applicant requests Lot 26, Tract 25376 (Grandpoint Ln.) approval for the grading of 1700 cu - Applicant: Dr. W. M. Schofield bic yards for the construction of a single family home, access, turn -around and rear yard "porch" area. He read the results of the evaluation of the project with respect to the code cri- teria (A - E in the staff report). He said he has talked with the appli- cant since the staff report was prepared and -that he is willing to revise the plans. Staff recommendation is if the Commission feels comfortable with the proposed changes in the plan, conditional approval be granted subject to the plans being reviewed by the Director of Planning; or if the Commission feels uncomfortable, the item be continued. W. M. Schofield said Staff had indicated they were overgrading. He showed the revised plans to the Commission which indicate a reduction in the over- age from 3341 square feet to 2900 square feet. Public participation was closed. Mr. Turner answered questions of the Commission, noting that grading could be decreased with the use of retaining walls in the rear yard area. In response to a Commission question, Dr. Schofield said the porch was the same elevation as the front room. Y14 -4-t The Commission4�9 they would prefer a contoured rear yard slope, and pointed out that the neighborhood is already well developed. Mr. McTaggart felt in this case more grading would create a more desirable effect. Mr. Blue proposed a motion, seconded by Mrs. Bacharach, to approve Grading Application No. 169 as originally submitted. Roll call vote was as follows: AYES: Bacharach, Blue, Hughes, McTaggart NOES: None ABSTAIN: Rosenberg ABSENT: None TENTATIVE PARCEL MAP NO. 7705 Mr. Weber said the request was to East of the intersection of Haw- divide a 39.4+ acre site into two thorne Blvd. & Via Rivera parcels of 20 and 19.4 acres, which Applicant: Palos Verdes Properties are intended for the purpose of sale. He described the project, location, surrounding areas, and zoning. He said the primary concern is whether or not the parcels could be developed, and that the evaluation indicates they could be. Staff recommendation is for approval subject to the conditions in Exhibit "A". Mike Kochan, assistant general manager of Palos Verdes Properties, res- ponded to Commission questions. MINUTES -3- 4/26/77 Mr. Rosenberg proposed a motion, seconded by Mr. Blue, to adopt Resolution No. 77-10 (P.C.), approving Tentative Parcel Map No. 7705, subject to the conditions in Exhibit "A". Roll call vote was as follows: AYES: Bacharach, Blue, Hughes, Rosenberg, McTaggart NOES: None ABSENT: None COMMISSION REPORTS Mr. McTaggart said the first item scheduled on the Council/Commission joint meeting agenda is the proposed Commission Handbook, which refers to the role of the Council and Commis- sions. Other items are communications, the handling of proposed ordinances, legal counp!el at Commission meetings re land use, condominiums, etc. He said he would try to arrange this meeting for May 16. Mr. Rosenberg said he would like the Council to set policy that CC&Rs be submitted at the time tentative tract maps are filed. After discussion, Mr. Rosenberg proposed a motion, seconded by Mr. Blue, and unanimously carried, directing Staff to prepare a formal resolution recommending to the City Council that a policy be adopted requiring pre- liminary CC&Rs to be submitted at the time of filing tentative tradt maps, so that the Commission can place certain conditions to be included manda- torily in the CC&Rs. Said resolution is to be presented for approval at the next meeting. Mr. McTaggart said Mas Ishibashi will be present at the next Coastal Plan work session to speak as a professional farmer. He also said Joe Barnett has volunteered to give background of the incidents along the bluffs and some very recent traffic figures; this will be at either the next meeting or the following one. He further said that the Fire Battalion Chief would be present at the next meeting. Mr. Blue reminded the Commission -that the financial statements re their status as of April 1 must be filed during the month of April. GRADING APPLICATION NO. 152 As the other items on the agenda were 7447 Via Lorado completed, at 9:40 p.m. the Commission Applicant: Eugene & Barbara Slauta began consideration of this item which had been placed at the end of the meet- ing. Mr. Weber said Mr. Forbes had volunteered information at the last meeting which staff saw this morning and that the letter was received this after- noon. He said staff is not prepared at this time to give any kind of evaluation of the proposal. He said he talked to Mr. Hauf and apparently there is a communications problem between the applicant and Mr. Hauf. Staff recommendation is for continuance of the item and that the applicant be asked to revise his plans to reflect the concerns of the Commission or that the Commission make a decision on the original plans. Re #2 in the letter, Mr. McTaggart asked that staff verify the statement of Mr. Hauf. Mr. Hughes felt the Commission should consider the project on its own merits and not wait for the neighbor's proposal. He felt they should reach a consensus on their concerns so that the applicant can respond. Mr. McTaggart agreed and also felt that the Commission should not take action tonight, particularly since the -applicant was present at the be- ginning of the meeting when the Commission post-poned the item to the end of the agenda, but is not present now. A consensus was reached unanimously on the following items: modification of the driveway should be made; no objection to the house location, but they suggested the garage be detached and moved further down the hill to- wards the street; there is a considerable amount of surface grading and 2800 yards is excessive. MINUTES 0 -4- 0 4/26/77 Mr. Turner explained that all of the grading activity proposed now is cut and that if the concept is changed, there could -be fill also; therefore, although it may change the way the grading occurs, it may not change the volume. Mr. McTaggart felt the same volume of grading on a better plan could be acceptable. Mr. Rosenberg proposed a motion, seconded by Mr. Hughes, to table Grading Application No. 152 until such time as revised grading plans are presented to the City. Mr. McTaggart directed Staff to indicate to Mr. Slauta that this item will not be continued again for the benefit of Mr. Forbes if he is unable to attend the meeting. He further said that if the applicant does not choose to revise the plan, this item will be first on the agefida at the next meet- ing.
