Hightower. ANTENNA REGULATIONS Commission discussion on the pro- posed amendment to the Development Code pertaining to height of antenna structures included the following: (1) A minor exception permit is not sufficient for the 45'-75' height; there is not adequate notice; (2) The Commission should request review of the conditional use permit fees, ex- ploring the possibility of separate fee structures for existing legal non -conforming uses and new applications; (3) The Council's direction to the Commission was to recommend a change to eliminate the requirement for a conditional use permit for structures over 40'; the Commission's recommendation should reflect this direction; (4) The City should take care not to get the reputation as being an easy city in which to erect antenna structures; (5) The fee and paperwork necessary for a conditional use permit for an antenna are out of proportion with the impact of the proposed antennas on the City; (6) The Minor Exception Permit is exces- sive in cost and procedure; there should, however, be a procedure whereby more than just the immediate neighbors are notified, with a fee appeal to the Commission; (7) The City should retain the option to either im- pose conditions on an antenna or to deny the application; (8) Existing antennas are not impacted by this proposal; the new antennas are of greatest concern; (9) In some cases it may be more beneficial to have an antenna higher to remove it from a neighbor's view plane; in addition, antennas closer to the ground look larger and may be more abusive to the neighborhood. Following discussion, changes to the proposed amendment were made, as follows: 9614,B,2(b) In approving the permit, the Director, Commis- sion, or Council may impos.e such conditions as crank -up or tilt -over supports, or any other conditions as are deemed necessary to minimize view obstruction and incompatibility. 9614,B,4(b) For an independent structure or one mounted on another accessory structure, the height shall be measured from the highest point of existing grade to be covered by the foundation of the structure. 9614,B,6 Changes to the approved antenna array which exceed 100 of the array envelope may be ap- proved as an amendment to the Minor Exception Permit, with no fee required. It was further agreed that a new procedure for approving antennas should be devised to include a site inspection, notice of the adjacent home- owners and other homeowners affected by the proposed structure (as de- termined by staff), with a free appeal to the Planning Commission if there can be no agreement reached at the staff level.
