" 0 (%) M I N U T E S City of Rancho Palos Verdes APPROVED AS PRESENTED Planning Commission May 11, 1976 April 27, 1976 The meeting was called to order at 7:45 p.m. in the Palos Verdes Peninsula Unified School District Building, 30942 Hawthorne Boulevard, by Chairman Shaw. PRESENT: Blue, McTaggart, Rosenberg, Shaw, Trefts ABSENT: None Also present was Director of Planning Sharon W. Hightower and City Attorney Pat Coughlan. MINUTES APPROVAL On motion of Mr. McTaggart, seconded by Mr. Blue and unanimously carried, the minutes of April 13, 1976 were approved as presented. On motion of Mr. Blue, seconded by Mr. McTaggart and unanimously carried, the minutes of April 21, 1976 were approved as presented. VARIANCE #5/GRADING APPLICATION #22 Chairman Shaw opened continued public hearing 7449 Via Lorado on Variance #5 and Grading Application #22. Applicant: William Hauf City Attorney indicated the Development Code as written is silent with regard to residen- tially zoned lots containing slopes in excess of 350, other than the notation that slopes in excess of 35% shall be treated as open space. The Code contains no provision for grading on slopes greater than 350. It was his recommendation that the Commission study the matter and initiate a Code amendment to allow that degree of grading which the Commission finds is appropriate, based on a continuation of the formula provisions of the Code and incorporating a vested rights position (i.e., dealing with recorded lots, the formation of which was not within City control, including a finding that the grading can be accomplished with no threat to the neighborhood). Director Hightower indicated the timetable for such a Code amendment would be a minimum of 2-3 months. City Attorney recommended the item be tabled with the understanding that the Commission will work with all deliberate speed on development of criteria for grading on slopes in excess of 35% and on the initiation of a Code amendment. Director Hightower emaphsized that, even after such a Code amendment, there could be no guarantee that the grading for this particular project would be approved. The applicant, William Hauf, stressed the need for expediency and indicated his willing- ness for the matter to be tabled. On motion of Mr. Rosenberg, seconded by Mrs. Trefts and unanimously carried, public hearing on Variance #5/Grading Application #22 was tabled to a date to be set at some future time. City Attorney left the chambers at this time and did not return. RESOLUTION 76-1 P.C. On motion of Mr. Rosenberg, seconded by Mr. Blue Conditional Use Permit #12 and unanimously carried, Resolution 76-1 P.C. was adopted. RECESS SPECIAL ANIMAL PERMIT #1 5235 Elkmont Drive Applicant: Mr. & Mrs. Boudreau denied, due to possible detriment to the other persons located in the vicinity. At 8:22 p.m. a brief recess was called. The Commission reconvened at 8:30 p.m. with the same members present. Director Hightower reviewed the request for approval of a special animal permit to allow the keeping of six horses on property located outside an established "Q" District, with the revised recommendation that the request be use, enjoyment, or valuation of property of The applicants, Mr. and Mrs. Boudreau, reviewed the fly and waste control program currently being conducted on the site, and indicated they had no interest in keeping six horses personally, but wish to establish the right to keep six horses for purposes of future sale df the property. Speaking in opposition to the proposal were Col. Besse, 5332 Manitowac; Rex Davison, 5227 Elkmont; Jack Bateman, 5256 Willow Wood; Robert Boyle, 5296 Willow Wood; Robert Cartwright, 5288 Willow Wood; Jennie Schmeikle, 5153 Elkmont; citing fly and odor problems, concern with fire access and access to trails, and concern with the possible precedent setting nature of the proposal. Col. Besse submitted a petition containing the signatures of individuals opposed to approval for the keeping of horses along Silver Spur Road or in adjacent areas. Mr. and Mrs. Boudreau further indicated the site is in a clean and sanitary condition, and submitted statements from the refuse collector and a feed store. Mr. Boudreau submitted a plan for waste and fly control for the property. Following Commission discussion, it was moved by Mr. Rosenberg, seconded by Mr. McTaggart and unanimously carried that Special Animal Permit #1 be tentatively approved, subject to the following conditions and limitations: (1) That the permit be issued for a twelve month probationary period. (2) That hearing be held before the Planning Commission at the end of such probationary period to determine the permanent approval of the use, based on a review of existing health, safety, and general welfare condition - (3) That the temporary permit be contingent upon submission of a written program by the applicants for positive waste and fly control, violation of which will constitute grounds for revocation of the special animal permit. (4) That the number of horses permitted be limited to two, based on existing uses. RECESS GRADING APPLICATION #15 31014 Marne Drive Applicant: Butler Housing At 9:55 p.m. a brief recess was called. The Commission reconvened at 9:59 p.m. with the same members present. Director Hightower summarized the request for approval of grading for a single family residence, with the recommendation that the approval be granted. H. D. Hoon, Vice -President of Butler Housing, and A. E. Beran of Engineering Services Corporati&P represented the applicant. Following discussion of drainage problems and off-site grading, it was moved by Mr. Blue, seconded by Mrs. Trefts that Grading Application #15 be approved, based on substantial compliance with the Development Code's grading criteria, subject to the approval of a landscaping and irrigation plan by the Director of Planning, and subject to approval of the drainage plans by the City Engineer. It was moved by Mr. Rosenberg, seconded by Mr. McTaggart and carried, with Mr. Blue and Mrs. Trefts dissenting, that the motion be amended to require that the proposed 12" drainage pipe be brought to the street. The question was called for, and the motion to approve Grading Application #15 was unanimously carried. GRADING APPLICATION #43 Director Hightower summarized the request 30551 Palos Verdes Drive East for approval of grading for a single family Applicant: William Pierson residence, with the recommendation that the matter be continued to allow submittal of revised plans reducing volume and area of grading. The applicant, William Pierson, presented plans calling for the preservation of the majority of the trees on the site. Frank Manculich, obstruction, but problem. 30553 Palos Verdes Drive East, expressed concern with possible view indicated he had arranged to meet with the applicant to discuss the P.C. -2- 4/27/76 Following discussion, it was moved by Mr. Blue that Grading Application #43 be tabled to allow submittal of revised plans reducing the volume and area of grading. Motion died for lack of second. On motion of Mr. Rosenberg, seconded by Mr. McTaggart and carried, with Mr. Blue and Mrs. Shaw dissenting, Grading Application #43 was approved subject to the approval of landscaping and irrigation plans by the Director of Planning. PARCEL MAP #6515 Director Hightower reviewed Tentative Parcel 5375 Rolling Ridge Road Map #6515, for the creation of two 30,000+ Applicant: Leo Poxon square foot lots, with the recommendation - that the Commission adopt Resolution 76-2 P.C., with the following changes: second paragraph to read, "WHEREAS, pursuant to the Subdivision Ordinance of the City of Rancho Palos Verdes, the Planning Commission considered on April 27, 1976 the Tentative Parcel Map;" and Park and Recreation fee to be $911.27. Speaking in favor of the application were the applicant, Leo Poxon, and Richard Meine, 3270 Via Campesina. Doug Trowbridge, 5333 Rolling Ridge Road, expressed concern with the location of a house on the new lot. Following discussion, it was moved by Mr. Blue, seconded by Mr. McTaggart and unani- mously carried to adopt Resolution 76-2 P.C. approving TentativeParcel Map No. 6515, withthe changes outlined by staff. WORK SESSIONS Members were reminded of work sessions on April 29 to consider the Coastal Specific Plan and on May 4 to interview prospective members of the Animal Advisory Committee. Changes to the grading ordinance were added to May 4 meeting. Director Hightower recommended that other changes to the grading ordinance be con- sidered concurrently with changes in the Code regarding grading on slopes in excess of 35%. It was moved by Mr. Blue, seconded by Mrs. Trefts and carried, with Mr. Rosenberg dissenting, that staff be directed to give notice to the Los Angeles Times, Daily Breeze, and Peninsula News that the Planning( -Commission will be holding work sessions on various aspects of the Development Code every Thursday for the next several months, specifying, if possible, the topic to be considered at the work session. Director Hightower indicated staff would send notices as possible but that the attempt was to streamline procedures not add to them. SUB -COMMITTEE REPORT Mrs. Trefts indicated a copy of the draft ANTENNA HEIGHTS of recommended changes to the Code had been submitted to the Radio Club. Peter Von Hagen indicated the club members had endorsed the draft. It was agreed that a date for a work session to consider the draft would be set at either the April 29 or may 4 work session. ADJOURNMENT At 11:55 p.m. it was moved, seconded and carried to ad]ourn to Thursday, April 29, at 7:30 p.m. for a work session on the Coastal Specific Plan Workbook, to be held in the Council Chambers.
