A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO) PALOS VERDES APPROVING, WITH CONDITIONS, AN
AMENDMENT TO AN APPROVED HEIGHT VARIATION, GRADING
AND SITE PLAN REVIEW PERMIT (CASE NO. ZON2010-00262) TO
ALLOW 1,758 CUBIC YARDS OF TOTAL EXPORT ASSOCIATED
WITH THE CONSTRUCTION OF A NEW RESIDENCE AT 30400
DIAMQNTE LANE (FORMERLY KNOWN AS 6480 PALO)S VERDES
DRiVE EAST) AND NO GRADING FILL ON ADJACENT VACANT LOT
4 OF TRACT 32322.
WHEREAS, on April 26, 2011, the Planning Commission adopted P.C.
Resolution No. 2011-19, approving a Height Variation, Grading and Site Plan Review
permit for a property located at 60400 Diamonte Lane (formerly known as 6480 Palos
Verdes Drive East) for the demolition of an existing 1-story residence and detached
guest house, and construction of a new 6,698 square foot single-family residence and
garage, 810 square foot guest quarters and 256 square foot covered pavilion, involving
2,051 cubic yards of total grading, of which 1,281 cubic yards would be deposited on
the adjacent vacant Lot 4 of Tract 32322, also owned by the subject parcel property
owner, and 200 cubic yards of net export (Case No. ZON2010-00252); and,
WHEREAS, on May 17, 2012, the property owner submitted a request to amend
the previously approved Grading permit to eliminate the 1,281 cubic yards of fill to be
deposited on Lot 4 of Tract 32322 and increase the amount of export from the project
site from 200 cubic yards to 1,758 cubic yards; and,
WHEREAS, pursuant to the provisions of the California Environmental Quality
Act, Public Resources Code Sections 21000 et. seq. ("CEQA"), the State's CEQA
Guidelines, California Code of Regulations, Title 14, Section 15000 et. seq., the City's
Local CEQA Guidelines, and Government Code Section 65962.5(f) (Hazardous Waste
and Substances Statement), Staff found no evidence that the approval of the requested
revision to the Grading permit would have a significant effect on the environment and,
therefore, the proposed project has been found to be categorically exempt (Section
15302); and,
WHEREAS, after notice issued pursuant to the requirements of the Rancho
Palos Verdes Development Code, the Planning Commission held a duly-noticed public
hearing on Mune 26, 2012, at which time all interested parties were given an opportunity
to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION DOES HEREBY FIND,
DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: The proposed revision is exclusively for the elimination of
Conditions No. 18 of P.C. Resolution No. 2011-19, which required 1,281 cubic yards of
fill to be deposited on the adjacent vacant Lot 4 of Tract 32322, and revising Condition

No. 19 of P.C. Resolution No. 2011-19 to increase the amount of export from the project
site from 200 cubic yards to 1,758 cubic yards.
Section 2: The proposed elimination of fill to be deposited on Lot 4 and the
increase in the amount of export can be approved because the proposed amendment
does not involve any changes to the proposed new residence, guest quarters, covered
pavilion or grading associated with the development of the residential lot, and only
changes the adopted conditions of P.C. Resolution No. 2011-19 to allow the excess
earth material be exported from the project site instead of being deposited on the
adjacent vacant lot.
Section 3: The proposed amendment is consistent with all grading findings as
adopted through Planning Commission Resolution No. 2011-19. As the proposal will
not alter the design of the previously approved buildings, Conditions of Approval
reflecting these changes have been revised to eliminate the amount of deposit
permitted on the adjacent vacant lot, as well as modified or added related to reflect the
proposed increase in the amount of export from the site. The following conditions are
modified, eliminated or added as follows, with new text shown in underline and deleted
text shown in strikethrough:
17. The Grading Permit allows a total 2-,05174 2,122 cubic yards of grading at 4440
Palos Verdes DOve 30400 Diamonte Lane, The proposed 66 1,940 cubic yards
of cut consists of lowering of the pad level of the residence, the removal of the hillside in
the northern side yard area, the removal of a portion of the existing driveway and
additional landscaping in the front yard area. The proposed 2435 182 cubic yards of fill
consists of the removal and construction of the driveway areas and leveling of the pad
area, and landscaping a portion of the front yard area.

49 18, As a result of the grading quantities described above, a maximum ofd
1,758 cubic yards of export may be removed from the site.
28. The applicant shall obtain approval of a haul route from the Director of Public
Works prior to issuance of a building permit for the exportation of the grading quantities
allowed by Condition No. 18 above.
29. All vehicles associated with the exportation of earth material from the projec
site shall not use Diamonte Lane and shall instead access Palos Verdes Drive East via
a driveway exclusively in a manner approved by the City's Public Works Department.

Section 4: Any interested person aggrieved by this decision or by any portion
of this decision may appeal to the City Council. Pursuant to Section 17.02.040(C)(1)(g)
of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the
City, in writing, setting forth the grounds of the appeal and any specific actions
requested by the appellant, and accompanied by the appropriate appeal fee, no later
than fifteen (15) days following June 26, 2012, the date of the Planning Commission's
final action.
Section 21: For the foregoing reasons and based on the information and
findings included in the Staff Report, Minutes and other records of proceedings, the
Planning Commission of the City of Rancho Palos Verdes hereby approves, with
conditions, an amendment to Height Variation, Grading and Site Plan Review permit
(Case No, ZON2010-00252) to allow 1,758 cubic yards of total export associated with
the construction of a new residence at 30400 Diamonte Lane and no grading fill on Lot
4 of Tract 32322.

Conditions of Approval

1 Prior to the submittal of plans into Building and Safety plan check, the applicant
and the property owner shall submit to the City a statement, in writing, that they
have read, understand, and agree to all conditions of approval contained in this
resolution. Failure to provide said written statement within ninety (90) days
following the date of this approval shall render this approval null and void,
2. Approval of this permit shall not be construed as a waiver of applicable and
appropriate zoning regulations, or any Federal, State, County and/or City laws
and regulations. Unless otherwise expressly specified, all other requirements of
the City of Rancho Palos Verdes Municipal Code shall apply.
3. The Community Development Director is authorized to make minor modifications
to the approved plans and any of the conditions of approval if such modifications
will achieve substantially the same results as would strict compliance with the
approved plans and conditions. Otherwise, any substantive change to the
project shall require approval of a revision by the final body that approved the
original project, which may require new and separate environmental review.
4. The project development on the site shall conform to the specific standards
contained in these conditions of approval or, if not addressed herein, shall
conform to the residential development standards of the City's Municipal Code,
including but not limited to height, setback and lot coverage standards.
5. Failure to comply with and adhere to all of these conditions of approval may
cause to revoke the approval of the project pursuant to the revocation
procedures contained in Section 17.86,060 of the City's Municipal Code.
6. If the applicant has not submitted an applicant for a building permit for the
approved project or not commenced the approved project as described in
Section 17.86.070 of the City's Municipal Code within one year of the final
effective date of this Resolution, approval of the project shall expire and be of no
further effect unless, prior to the expiration, a written request for extension is filed
with the Community Development Department and approved by the Director.
7. In the event that any of these conditions conflict with the recommendations
and/or requirements of another permitting agency or City Department, the stricter
standard shall apply.
8. Unless otherwise designated in these conditions, all construction shall be
completed in substantial conformance with the plans stamped APPROVED by the
City with the effective date of this Resolution.

9. The construction site and adjacent public and private properties and streets shall
be kept free of all loose materials resembling trash and debris in excess of that
material used for immediate construction purposes, Such excess material may
include, but not be limited to: the accumulation of debris, garbage, lumber, scrap
metal, concrete asphalt, piles of earth, salvage materials, abandoned or
discarded furniture, appliances, or other household fixtures.
10, All construction sites shall be maintained in a secure, safe, neat and orderly
manner. Temporary portable bathrooms shall be provided on a construction site
if required by the City's Building Official. Said portable bathrooms shall be
subject to the approval of the City's Building Official and shall be placed in a
location that will minimize disturbances to the surrounding property owners.
11. Permitted hours and days of construction activity are 7:00 AM to 7:00 PM,
Monday through Saturday, with no construction activity permitted on Sundays or
on the legal holidays specified in Section 17.96,920 of the Rancho Palos Verdes
Development Code. Trucks shall not park, queue and/or idle at the project site or
in the adjoining public rights-of-way before 7:00 AM, Monday through Saturday,
in accordance with the permitted hours of construction stated in this condition.
12. This approval is to demolish the existing 8,807 square foot residence, attached
garage and detached guest quarters; and construction of a new 5,613 square
foot 1-story single-family residence, 1,085 square foot attached, in-direct access
3-car garage, 819 square foot detached guest quarters, and 256 square foot
detached covered pavilion,
13. Unless modified by the approval of future planning applications, the approved
project shall maintain a maximum of 40% lot coverage (28% proposed).
14, The approved residence shall maintain the following setbacks:
Front yard: 20'-0" min, (98'-10" proposed)
■ Rear yard: 20'-0" min. (75'-6"proposed for the residence,
20'-0" proposed for the guest quarters)
■ North side: 10'-0" min. (40'-4" proposed for the residence,
48W" proposed for the guest quarters)
■ South Side: 10'-0" min. (44'-10" proposed for the residence,
20'-0" proposed for the covered pavilion)
15. The pad elevation shall be graded from elev. 992.0' to 990.25', as indicated on
the stamped approved plans.
16. The height of the new residence is limited to 16'-6" tall from the highest elevation
of existing building pad covered by structure (992,0') to the ridgeline (10085),
and 18'-3" tall from where the lowest foundation meets finished grade (990.25') to
the ridgeline (1008,5').

SUBJECT TO REVIEW AND APPROVAL BY THE BUILDING OFFICIAL, A
RIDGE HEIGHT CERTIFICATION IS REQUIRED BY A LICENSED LAND
SURVEYOR OR CIVIL ENGINEER PRIOR TO INSTALLATION OF ROOF
MATERIALS.
17. The Grading Permit allows a total 2,122 cubic yards of grading at 30400
Diamonte Lane. The proposed 1,940 cubic yards of cut consists of lowering of
the pad level of the residence, the removal of the hillside in the northern side
yard area, the removal of a portion of the existing driveway and additional
landscaping in the front yard area. The proposed 182 cubic yards of fill consists
of the removal and construction of the driveway areas and leveling of the pad
area, and landscaping a portion of the front yard area (REVISED PER
RESOLUTION NO. 2012-12, ON JUNE 26, 2012).
18. As a result of the grading quantities described above, a maximum of 1,758 cubic
yards of export may be removed from the site (REVISED PER RESOLUTION NO,
2012-12, ON JUNE 26, 2012).
19. All retaining wall heights shall match the elevation call-outs indicated on the
stamped approved plans. The retaining wall adjacent to the new driveway shall
not exceed T-6" tall and the retaining wall located upslope shall not exceed 4'-6"
tall and shall be a minimum of T-0" apart from any other retaining walls.
20. Based upon a foliage analysis conducted by Staff, the following must be done
prior to building permit final in order to restore the protected views from
surrounding properties: the pepper tree in the rear yard shall be trimmed down
and maintained at a height not to exceed 16 feet; and the pepper tree on the
slope between the building pad and Diamonte Lane shall be trimmed down and
maintained at a height not to exceed 16 feet in height.
21. Prior to issuance of a building permit, a Landscape Documentation Package
must be submitted for review by the City's landscaping consultant and approval
by the Community Development Director, The Landscape Documentation
Package shall be prepared and signed by a landscape architect, landscape
designer, or irrigation designer, as appropriate, except that the soil management
report shall be prepared by a qualified soil and plan laboratory. The applicant is
responsible for paying for the review by the City's Landscape Consultant.
22, This approval does not permit any new structures within the private right-of-way
easement of Diamonte Lane nor in the 25' wide easement running along the
northern property line.
23. All fences, walls and hedges located between the new guest quarters and the
easement line for Diamonte Lane shall not exceed 42" tall.
24. All grading, landscaping and construction activities shall exercise effective dust
control techniques, either through screening and/or watering.

25. A minimum 3-car garage shall be maintained, with each required parking space
being individually accessible and maintaining minimum unobstructed dimensions
of 9' in width and 20' in depth, with a minimum 7' vertical clearance,
26. All utility service lines installed to service the buildings shall be placed
underground from an existing power pole or other point of connection off-site
prior to certificate of occupancy.
27. The proposed chimneys shall not exceed the minimum height required for
compliance with the Uniform Building Code.
28. The applicant shall obtain approval of a haul route from the Director of Public
Works prior to issuance of a building permit for the exportation of the grading
quantities discussed in Condition No. 18 above (REVISED PER RESOLUTION
NO. 2012-12, ON JUNE 26, 2012).
29, All vehicles associated with the exportation of earth material from the project site
shall not use Diamonte Lane and shall instead access Palos Verdes Drive East
via a driveway exclusively in a manner approved by the City's Public Works
Department (REVISED PER RESOLUTION NO. 2012-12, ON JUNE 26, 2012).
30. All vehicles associated with the exportation of earth material from the project site
shall not use the Palos Verdes Drive East during the A.M. and P.M. peak hours, as
defined by the City's Public Works Department.
