RESOLUTION OF THE PLANNING ISI F THE CITY OF
RANCHO AL VERDEVERDES CERTIFYING NEGATIVE CL TI
PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT FOR
CASE NO. ZON2007-00100 (A CONDITIONAL E PERMIT, GRADING
PERMIT AND ENVIRONMENTAL ASSESSMENT), FOR PROPERTY AT
840 HAWTHORNE BOULEVARD, KNOWN AS THE SALVATION ARMY
CRESTMONT COLLEGE F I E TRAINING.
WHEREAS, on February 27, 2007, the Salvation Army submitted Case No.
ZON2007-00100, applications for an Environmental Assessment and Conditional Use
Permit for the Salvation Army Crestmont College for the Offer Training, located at 30840
Hawthorne Boulevard; and,
WHEREAS, on March 21, 2007, the project was deemed incomplete by Staff
pending the submittal of additional information; and,
WHEREAS, on December 14, 2007, upon submittal of all required information and
plans, including a Grading Permit application, the project was deemed complete by Staff;
and,
WHEREAS, pursuant to the provisions of the California Environmental Quality Act,
Public Resources Code Sections 21000 et. seq. ("CEQA"), the State's CEQA Guidelines,
California Code of Regulation, Title 14, Section 15000 et. seq., the City's Local CEQA
Guidelines, and Government Code Section 65962.5(f)(Hazardous Waste and Substances
Statement),the City of Rancho Palos Verdes prepared an Initial Study and determined that
there is no substantial evidence that the approval of Case No. ZON2007-00100 would
result in a significant adverse effect upon the environment and, therefore, a Negative
Declaration has been prepared and notice of same was given in the manner required by
law; and,
WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos
Verdes Development Code, the Planning Commission held a duly noticed public hearing
on February 12, 2008, at which time all interested parties were given an opportunity to be
heard and present evidence.
NOW,THEREFORE,THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: The Planning Commission has independently reviewed and
considered the proposed Negative Declaration, the public comments upon it, and other
evidence before the Commission prior to taking action on the proposed project and finds
that the Negative Declaration was prepared in the manner required by law and that there is
no substantial evidence that the approval of Case No. ZON2007-00100 for a Conditional
Use Permit and a Grading Permit would result in a significant adverse effect upon the
environment.
Section 2: Case No. ZON2007-00100, a Conditional Use Permit and Grading
Permit for a 28,627 square foot, 33'-8" high, addition to the existing dormitory building is
consistent with the Rancho Palos Verdes General Plan and with the underlying
Institutional-Educational land use designations,which will not be changed as a result of the
approval of the project.
Section 3: There are no sensitive natural habitat areas on the subject site. Thus,
no site disturbance or alteration will result from the approval of Case No.ZON2007-001 00,
and therefore, the project will have no individual or cumulative adverse impacts upon
resources, as defined in Section 711.2 of the State Fish and Game Code.
Section 4: Based upon the foregoing findings, the adoption of the proposed
Negative Declaration is in the public interest.
Section 5: Any interested person aggrieved by this decision or by any portion of
this decision may appeal to the City Council. Pursuant to Chapter 17.80 of the Rancho
Palos Verdes Municipal Code, any such appeal must.be filed with the City, in writing and
with the appropriate appeal fee, no later than fifteen (15) days following the date of the
Planning Commission's final action.
Section 6: For the foregoing reasons and based on the information and findings
included in the Staff Report, Environmental Assessment and other components of the
legislative record, in the proposed Negative Declaration, and in the public comments
received by the Commission,the Planning Commission of the City of Rancho Palos Verdes
hereby certifies that the Negative Declaration has been prepared in compliance with CEQA
thereby allowing an addition to the existing dormitory building at the Salvation Army's
Crestmont College for Officer Training located at 30840 Hawthorne Boulevard, measuring
three-stories (33'-8") in height to match the height of the existing dormitory building and a
total of 28,627 square feet.
