PC RES 2006-005 P.C. RESOLUTION NO. 2006-05 A RESOLUTION OF THE PLANNING COMMISSIONF THE CITY OF RANCHOL DENYING IT T PREJUDICE CASE ZON2005-00149, A HEIGHT VARIATION FOR A 2,067 SQUARE FT TWO-STORY ITI N TO AN EXISTING ONE STORY RESIDENCE, RESULTING IN A 4,640 SQUARE FOOT STRUCTURE MEASURING 25.31-FEETI LL HEIGHT, T PROPERTY LOCATED AT 28045 LL ROAD. WHEREAS, on March 30, 2005, the applicant Ted Powell, representing property owners Edward and Tamara Nizamian, submitted Case No. ZON2005-00149, a Height Variation application for a 2,067 square foot two-story addition to an existing one-story residence; and, WHEREAS, on April 29, 2005, the project was deemed incomplete pending submittal of additional information; and, WHEREAS, upon submittal of the required information, the construction of the temporary silhouette and submittal of the silhouette certification form, the case was deemed complete by Staff on November 28, 2005; and, WHEREAS, pursuant to the provisions of the California Environmental Quality Act, Public Resources Code Sections 21000 et. seq. ("CEQA"), the State's CEQA Guidelines, California Code of Regulation, Title 14, Section 15000 et. seq., the City's Local CEQA Guidelines, and Government Code Section 65962.5(f) (Hazardous Waste and Substances Statement), Staff found no evidence that Case No. ZON2005-00149 would have a significant effect on the environment and, therefore, the proposed project has been found to be categorically exempt under Class 1 (Existing Facilities) since the project involves an addition to an existing residence; and, WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos Verdes Development Code, the Planning Commission held a duly noticed public hearing on January 24, 2006, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE,THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HERESY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: The proposed project will not be compatible with the character of the immediate neighborhood due to the resulting structure size, the architectural style, and the bulk and mass of the structure. The resulting structure size will be significantly larger than the structure size range in the immediate neighborhood, and significantly larger than the average structure size. Further, the proposed addition will change the architectural style of the residence, from a ranch style to an eastern Mediterranean architecture. The proposed Mediterranean architecture substantially deviates from the character of the neighborhood and will not be compatible with the immediate neighborhood,which is developed with one- story ranch style residences. The proposed design includes flat vertical fagades along the sides with no articulation, resulting in tall two-story walls that appear massive. Along the front fagade, the design includes a rotunda over the entry and an additional rotunda feature behind the entry rotunda,which augment the apparentness of the structure, and introduces a design element that is not found in the immediate neighborhood. Lastly, the proposed second story does not provide for sufficient articulation and consumes almost the entire residence, creating a massive appearance along the most visible portions of the structure. Section 2: The proposed project will result in an unreasonable infringement of privacy upon the adjacent properties on either side, due to the proposed deck along the rear of the second story addition. The deck area will facilitate observation into the rear yard areas, infringing upon the privacy by allowing visibility into the rear yard areas,which is not a situation that currently exists. Since there is not an existing situation of visibility onto the properties on either side, the project will create new privacy infringement. Section 3: For the foregoing reason and based on the information and findings included in the Staff Report, Minutes and other records of proceedings, the Planning Commission of the City of Rancho Palos Verdes hereby denies without prejudice Case No. ZON2005-00149 for a Height Variation. Section 4: Any interested person aggrieved by this decision or by any portion of this decision may appeal to the City Council. Pursuant to Section 17.80 of the Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing and with the appropriate appeal fee, no later than February 8, 2006.
