RESOLUTION F THE PLANNING I I F THE CITY OF
RANCHO PALPALOS VERDES DENYINGWITHOUT PREJUDICE CASE NO.
Z N2 -0 1 4, A HEIGHT VARIATION PERMIT FOR A NEWSECOND
STORY ADDITION OVEREXISTING ONE-ST Y RESIDENCE, FOR
PROPERTY LOCATED AT 7239 RUE LA FLEUR.
WHEREAS, on April 16, 2004, the applicant Mayne Sun, representing property
owner Sue Hyun Chang submitted Case No. ZON2004-00194, a Height Variation
application for an 888 square foot second story addition measuring 24-feet high; and,
WHEREAS, on May 11, 2004, the application was deemed incomplete pending
submittal of additional information and the construction of the temporary silhouette; and,
WHEREAS, upon submittal of the required information, the construction of the
temporary silhouette and submittal of the silhouette certification form, the case was
deemed complete by Staff on October 25, 2004; and,
WHEREAS, pursuant to the provisions of the California Environmental Quality Act,
Public Resources Code Sections 21000 et. seq. ("CEQA"), the State's CEQA Guidelines,
California Code of Regulation, Title 14, Section 15000 et. seq., the City's Local CEQA
Guidelines, and Government Code Section 65962.5(f) (Hazardous Waste and Substances
Statement), Staff found no evidence that Case No. ZON2004-00194 would have a
significant effect on the environment and, therefore,the proposed project has been found to
be categorically exempt under Class 1 (Existing Facilities) since the project involves an
addition to an existing residence; and,
WHEREAS, after notice issued pursuant to the requirements of the Rancho Palos
Verdes Development Code,the Planning Commission held a duly noticed public hearing on
December 14, 2004, at which time all interested parties were given an opportunity to be
heard and present evidence; and,
WHEREAS, on December 14, 2004, the Planning Commission continued the item to
the March 8, 2005 Planning Commission meeting to allow the applicant time to modify the
project; and,
WHEREAS, on February 18, 2005, the applicant submitted a revised project; and,
WHEREAS, on March 8, 2005, the applicant modified the silhouette to reflect the
modified project, and submitted certification of the silhouette; and,
WHEREAS, on March 8, 2005, the Planning Commission continued the item to the
March 22, 2005 meeting at the request of the applicant; and,
WHEREAS, the Planning Commission held a duly noticed public hearing on March
22, 2005, at which time all interested parties were given an opportunity to be heard and
present evidence.
NOW, THEREFORE,THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: The second story addition and resulting appearance will significantly
change the appearance of the immediate neighborhood and the second story addition will
not be compatible with the immediate neighborhood.
Section 2: For the foregoing reason and based on the information and findings
included in the Staff Report, Minutes and other records of proceedings, the Planning
Commission of the City of Rancho Palos Verdes hereby denies without prejudice Case No.
ZON2004-00194 for a Height Variation application for a second story addition over the
existing one-story residence.
Section 3: Any interested person aggrieved by this decision or by any portion of
this decision may appeal to the City Council. Pursuant to Section 17.80 of the Rancho
Palos Verdes Municipal Code, any such appeal must be filed with the City, in writing and
with the appropriate appeal fee, no later than April 6, 2005.
