CC RES 1988-078A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES PROPOSING A CHANCE TO ME MADE IN CONNECTION WITH PROPOSED ROCKINC- HORSE ROAD SEWER ASSESSMENT DISTRICT RPrTTAr..q A. On January 14, 1988, the City Council of the City of Rancho Palos Verdes adopted its Resolution No. 88-3 entitled "A Resolution of the City Council of the City of Rancho Palos Verdes Declaring Its Intention to Order Improvements for Proposed Rockinghorse Road Sewer Assessment District Pursuant to the Municipal Improvement Act of 1913." B. On September 6, 1988, the City Council "of he City of Rancho Palos Verdes adopted its Resolution No. 88 -. entitled "A Resolution of the City Council of the City of Rancho Palos Verdes Amending Its Resolution No. 88-3 Which Declared the Inten- tion of the City Council to Order Improvements for Proposed Rock- inghorse Road Sewer Assessment District." C. Pursuant to such Resolution No. 88-3, as amended, the City Engineer filed with the City Clerk of the City of Rancho Palos Verdes a report entitled "Engineer's Report, Rockinghorse Road Sewer Assessment District." D. On September 20, 1988, the City Council adopted its Resolution No. 88-58 entitled "A Resolution of the City Coun- cil of the City of Rancho Palos Verdes Approving the Report of the Engineer in connection with Rockinghorse Road Sewer Assess- ment District and Appointing a Time and Place for Hearing Protests." E. Pursuant to such Resolution No. 88-58, the City Council appointed December 20, 1988 as the time for hearing protests to the proposed improvements described in Section 3 of Resolution No. 88-3. F. On November 21, 1988, the City Engineer opened bids for construction of the proposed improvements and the only bid received was higher than the estimated construction cost stated in the Engineer's Report preliminarily approved on Septem- ber 20, 1988. As a result thereof, the City Engineer has recom- mended certain proposed changes to be made to the Engineer's Report. THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: Section 1. The Engineer's Report for Rockinghorse Road Sewer Assessment District which was filed with the City Clerk of the City of Rancho Palos Verdes and preliminarily approved by the City Council, provides for as assessment of $140,000 to represent the total cost and expenses of the proposed improvements. The City Council hereby proposes to make a change to the assessment to reflect the receipt of a construction bid in an amount higher than the amount stated in such Engineer's Report for the total estimated construction cost and hereby directs the City Engineer to prepare a proposed modification to the Engineer's Report to reflect such proposed change. The City Council hereby proposes to approve an assessment of $,175,450.00. Such proposed change to the assessment will result in an increase of $35,450.00 in the total estimated cost of the improvements and an increase of $2,364.00 in the amount assessed against each of the parcels of property within Rockinghorse Road Sewer Assessment District. Thus, the amount to be assessed against each of the parcels fol- lowing such proposed change will be $11,697.00 Section 2. The City Council hereby appoints January 17, 1989, at 7:30 p.m. in the Main Meeting Room at Fred Hesse Community Park, 29301 Hawthorne Boulevard, Rancho Palos Verdes, California 90274, as the time and place for hearing any objec- tions to the proposed change and to the corresponding proposed modification to the Engineer's Report. Any interested person having any objection to the change and modification proposed to be made may appear before the City Council at the above time and place and show cause why the proposed change and modification should not be ordered. Section 3. The City hereby designates Mr. Ceorge Wentz, Director of Public Works, City Hall, City of Rancho Palos Verdes, telephone number (213) 541-6500, to answer inquiries regarding the hearing proceedings. 1988.
