RDA MINS 19880419M I N U T E S RANCHO PALOS VERDES REDEVELOPMENT AGENCY REGULAR MEETING APRIL 19, 1988 The meeting was called to order at 8:40 P.M. by Chairwoman Bacharach. PRESENT: McTAGGART, HUGHES, HINCHLIFFE, RYAN AND CHAIRMAN BACHARACH Also present were Executive Director Dennis McDuffie, Finance Director Kevin Smith, Agency Secretary Jo Purcell, Agency Attorney Steve Dorsey, Public Works Director George Wentz and Director of Environmental Services Robert Benard. APPROVAL OF AGENDA Member McTaggart moved, seconded by Chairwoman Bacharach to approve the Consent Calendar as presented. The motion carried. [WV_1 0Uoka Approved the minutes of April 5, 1988. RESOLUTION NO. RDA 88 -7 ADOPTED RESOLUTION RDA 88 -7 ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING FUNDS FROM WHICH THE SAME ARE TO BE PAID. The motion to approve the Consent Calendar carried on the following roll call vote: AYES: HUGHES, McTAGGART, AND CHAIRWOMAN BACHARACH ABSTAIN: HINCHLIFFE AND RYAN AGREEMENT REGARDING ASSESS- Executive Director Dennis MENT DISTRICT PROCEEDINGS McDuffie presented the staff FOR KLONDIKE CANYON (1801) recommendation to approve the proposed agreement with the Klondike Canyon Hazard Abatement District with amendments. Agency Attorney Dorsey explained that this agreement was prepared by Robin D. Harris, an attorney for the law firm of Richards, Watson, & Gershon. Because that firm rep- resents both the City, the Redevelopment Agency and the Klondike Canyon Geologic Hazard Abatement District he said that the Agency would have to decide whether to have the agreement reviewed by an independent counsel. If the Agency deemed that to be unnecessary then they should pass a motion waiving any conflict of interest arising by virtue of Ms. Harris' preparation of the agreement . Responding to Agency's inquiry, staff stated that the City will be administering the construction project, the Agency will collect the funds from the City for its share of the total costs and the Agency will then transfer the funds into the improvement funds for the project. The Klondike Canyon District will assess residents in Zone "B" for this improvement. Member Hughes moved, seconded by Member McTaggart and carried to waive any potential conflict of interest for the firm of Richards, Watson & Gershon. Member McTaggart moved, seconded by Member Hughes to approve the agreement with the Klondike Hazard Abatement District.
