H.Award Contracts for Construction, Construction Management, Inspection, and Materials Testing Services for the FY2011-2012 Areas 3 and 5 Residential Streets (Supports 2013 City Council GoalNo. 4, Public Improvement Project –PhaseII Infrastructure –Citywide Street Maintenance) (Murphy) Recommendation: 1)Approve the construction plans and project specifications on file in the Public Works Department for the FY 2011-2012 Areas 3 and 5Residential Streets Improvement Project -Phase II; 2) Award a construction contract to VSS International, Inc. in the amount of $1,200,000, and a professional services agreement for the construction management, inspection, and materials testing to Merit Civil Engineering, Inc. in the amount of $178,947, and authorize Staff to utilize an additional 10% ($137,895) for project contingency; and, 3) Authorize the Mayor and City Clerk to execute the agreements. PUBLIC HEARINGS: 1.Water Quality and Flood Protection Program –Annual User Fee Rate –FY13-14 (30 mins) (Supports 2013 City Council Goal for Public Infrastructure) (Jones/McLean) City Council Agenda July 16, 2013 Page 3of 6 Recommendation: 1)Receive, review and file the independent 2013 Annual Report on the Water Quality and Flood Protection Programprepared by the Oversight Committee for the storm drain program, dated May 29, 2013;2) Conduct a public hearing pursuant to Health and Safety Code Section 5473.2 and Section 3.44.40 of the Rancho Palos Verdes Municipal Code on July 16, 2013 on the Annual Report prepared by Harris & Associates, the Annual Report prepared by the Oversight Committee and information provided by Staff, and determine whether to collect the Storm Drain User Fee (the “Fee”) for FY13-14, and if so, the rate per Equivalent Residential Unit (“ERU”) for FY13-14; 3) At the conclusion of the Public Hearing determine the existence or absence of a majorityprotest; 4) In the absence of a majority protest, Staff recommends that the Council determine that the rate per ERU for FY13-14 shall be $96.27 as set forth in the Annual Report, ADOPT RESOLUTION NO. 2013-__,A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES,FINALLY ADOPTING A REPORT, AS FILED, IN CONNECTION WITH THE STORM DRAIN USER FEE ESTABLISHED PURSUANT TO CHAPTER 3.44 OF THE RANCHO PALOS VERDES MUNICIPAL CODE; DETERMINING THE AMOUNT OF SUCH FEE FOR FY13-14; AND ORDERING THAT SUCH FEE BE COLLECTED ON THE COUNTY OF LOS ANGELES TAX ROLL FOR FY13-14;and, 5) In the event of a majority protest, direct Staff to present to City Council at a subsequent meeting a resolution determining the amount of the Storm Drain User Fee for FY13-14 and providing for an alternative method of collecting the Storm Drain User Fee for FY13-14. 2.Adoption of Addendum No. 5 to a Negative Declaration for Ordinance No. 510 and (10 mins) Introduction of an Ordinance to Amend Rancho Palos Verdes Municipal Code Chapter 17.76.030 –Fences, Walls and Hedges (Case No. ZON2012-00346) (Rojas/Harwell) Recommendation: 1) ADOPTRESOLUTION NO.2013-__, ADOPTING ADDENDUM NO. 5 TO THE NEGATIVE DECLARATION FOR ORDINANCE NO. 510, FOR A CODE AMENDMENT TO REVISE CHAPTER 17.76.030 OF THE DEVELOPMENTCODE (FENCES, WALLS AND HEDGES); andINTRODUCE ORDINANCE NO. ___, AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES, ADOPTING AN ORDINANCE AMENDING RANCHO PALOS VERDES MUNICIPAL CODESECTION 17.76.030(B)(1)TO REQUIRE THE APPROVAL OF A FENCE, WALL AND HEDGEPERMIT FOR ANY NEW FENCE WITHIN A REAR OR SIDE YARD SETBACK; AMENDING RANCHO PALOS VERDES MUNICIPAL CODE SECTION 17.76.030(C)(1)(B)(IV) TO CLARIFY THE EXISTING HEIGHT LIMITATIONS APPLICABLE TO COMBINATION WALLS/HEDGES; AND AMENDING RANCHO PALOS VERDES MUNICIPAL CODE SECTION 17.76.030(D)(1)(A) TO CLARIFY THAT A MINOR EXCEPTION PERMIT IS NOT REQUIRED FORANY FENCE HIGHER THAN FORTY-TWO INCHES UP TO SIX FEET WITHIN THE STREET-SIDE SETBACK (CASE NO.
