COASTAL PERMIT NO. 41 APPEAL Environmental Services Director
Robert Benard presented the staff
memorandum of December 24, 1987 and
the following recommendations: 1)
Hold a hearing for the purpose of
receiving public comments concerning the merits of the appeals. 2) Dismiss
the appeals on the basis that the hearing officer's findings are sufficient
and that no new significant information has been presented by the appeals
that would affect the hearing officer's findings.
As outlined in the staff memorandum, Director Benard summarized the
background on the hearing officer's decision to conditionally approve
Coastal Permit No. 41 for Phase II of the Agency' s landslide stabilization
project, and the Planning Commission's review of the issues raised by the
appellants in this matter. He then summarized the staff analysis, the
Executive Director appeal, the Smolley appeal, the Clarke appeal, the
Sargent letter of concern, and the alternatives that the City Council could
consider in determining the merits of the appeals and/or dismissal of the
appeals.
