CC RES 1986-073 RESOLUTION NO. 86-73 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES CREATING THE CABLE TELEVISION ADVISORY BOARD AND PROVIDING FOR APPOINTMENT OF ITS MEMBERS AND ITS POWERS AND DUTIES THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, ORDER AND RESOLVE AS FOLLOWS: Section 1: The City Council has previously created the Rancho Palos Verdes Cable Television Public Access Foundation. Section 2: The City Council hereby creates the Cable Television Advi- sory Board (Advisory Board) to assist the Foundation in performing its du- ties. Section 3: The Advisory Board shall consist of eleven (11) voting and two (2) non-voting members selected as follows: (a) Nine (9) voting members shall be appointed by the Foundation from within the boundaries of the four incorporated Peninsula Cities and the County unincorporated areas of Westfield and Academy Hills. At least six (6) of the nine shall live in Rancho Palos Verdes. (b) One (1) voting member shall be appointed by the Palos Verdes Pe- ninsula Unified School District Board of Education. (c) One (1) voting member shall be appointed by the Palos Verdes Li- brary District Board of Trustees. (d) A representative of the City's Cable Television Operator, who shall be a non-voting member. (e) The Rancho Palos Verdes City Manager or designee, who, shall be a non-voting member. Section 4: The terms of office of members of the Advisory Board shall be two years , except that the first term shall expire on December 1, 1987. Thereafter, terms shall expire on the date of the first Council meeting in December of odd-numbered years. Section 5: The Board of Directors of the Rancho Palos Verdes Cable Television Access Foundation shall appoint the Advisory Board Chairman. Section 6: If any vacancy shall occur in the membership of the Board other than by expiration of the term of office, it shall be filled by the entity originally appointing the member whose office is vacant. 701CP/RES4.1 Section 7: The Members of the Advisory Board may be removed from off- ice by vote of the majority of all the members of the Foundation Board. Section 8: The Advisory Board shall hold regular meetings at least once every other month. If a voting member of the Advisory Board does not attend two (2) consecutive regular meetings , unless excused by the Advisory Board, his membership thereon shall terminate automatically; provided, how- ever, that if a voting member misses more than twenty-five (25) percent of all the regular and adjourned regular meetings in any four (4) consecutive calendar quarters , unless excused in advance by the Foundation, his member- ship shall terminate automatically; and provided, further, that a voting member will be deemed absent from a meeting unless he is present during at least two-thirds (2/3) of the time of the entire meeting. Section 9: The Cable Television Advisory Board shall have the following powers and duties: (a) The Advisory Board shall make recommendations to the Foundation on matters concerning public access for cable television. (b) The Advisory Board shall advise the Foundation, on any such mat- ters when so requested by the Foundation. (c) The Advisory Board action on any such matters delegated to it by the Foundation are subject to the appeal of its decision to the Foundation. (d) The Advisory Board shall make an annual report to the Foundation of its activities for the previous year and shall make such other reports as it shall deem necessary or proper. (e) The Board shall perform such other duties as are assigned from time to time by the Foundation. PASSED, APPROVED and ADOPT on November 5, 1986. MAYOR AT ST: Igi . kCe-V--(2---.
