RDA MINS 19941004 M I N U T E S RANCHO PALOS VERDES REDEVELOPMENT AGENCY REGULAR MEETING 1/ OCTOBER 4, 1994 Following the City Council meeting, the Redevelopment Agency was called to order by Chairman Kuykendall. PRESENT: Brooks, Byrd, Lyon, McTaggart, and Chairman Kuykendall. Also present were City Manager Bussey, Assistant City Manager Antil, City Attorney Lynch, Director of Environmental Services Bernard, Director of Public Works, and Sr. Administrative Analyst Dolleschel. APPROVAL OF AGENDA Member Brooks, seconded by Member Byrd, moved to approve the agenda as presented. There being no objection, Chairman Kuykendall so ordered. APPROVAL OF CONSENT CALENDAR Member Brooks, seconded by Member Byrd moved to approve the Consent Calendar as follows: WAIVER OF READING Adopted a motion to waive reading in full of all ordinances and resolutions adopted at the meeting with consent to the waiver of reading deemed to be given by all members after the reading of the title. MINUTES (301 x 1900) Approved the minutes of August 2 and September 20, 1994. UPDATE OF AGENCY'S CONFLICT OF INTEREST CODE (301 x 1900) Adopted Resolution No. RDA 94-12 of the Redevelopment Agency of the City of Rancho Palos Verdes adopting a Conflict of Interest Code containing designated positions and disclosure categories. PORTUGUESE BEND SEWER SYSTEM ASSESSMENT SURVEY (1204 x 1900) Received and filed this report. Redevelopment Agency October 4, 1994 1 AWARD OF CONTRACT FOR PROFESSIONAL ENGINEERING SERVICES FOR ALTAMIRA CANYON DRAINAGE PROJECT (1204 x 1900) Awarded a contract to Dwight French & Associates, Inc. for professional engineering services for the preparation of engineering plans and specifications for improvements to Altamira Canyon Channel, and associated storm drain improvements and authorized the Agency Chairman and Secretary to execute an agreement with Dwight French & Associates, Inc. at a not-to-exceed fee of $69,872 plus I/ authorized staff to spend up to $3,493 contingency, for a total authorization of $73, 365. REGISTER OF DEMANDS (602 x 1900) Adopted Resolution No. RDA 94-13 . Ms. Lois Larue addressed several issues with regard to the Consent Calendar. City Attorney Lynch provided clarification relative to the Conflict of Interest Code. For Mr. Richard Bara, it was noted that plans for the sewer system have been designed and that the sewer line will be located above ground. The motion to approve the Consent Calendar reflected unanimous approval as follows: AYES: Brooks, Byrd, Lyon, McTaggart, and Chairman Kuykendall. PUBLIC HEARING PORTUGUESE BEND GRADING PROJECT ENVIRONMENTAL ASSESSMENT (1203 x 1900) RECOMMENDATION To open the public hearing and receive testimony on the draft initial study/mitigated negative declaration. Chairman Kuykendall opened the public hearing. Speaking in opposition to this project, Ms. Lois Larue noted that the City has a responsibility to preserve the City's Coastal Sage scrub. If the project were approved, she strongly encouraged the City to oversee the project to ensure the least amount of devastation. For Mr. Richard Bara, Senior Planner Rojas advised that a Redevelopment Agency October 4, 1994 2 mitigation monitoring program will be implemented to ensure any impacts are minimized and noted that any destruction of a sensitive plant species would result in replanting a similar plant species at the project site. Staff was commended on a job well done on the detailed 1/ background report. There being no objection, Chairman Kuykendall ordered the public hearing closed. PORTUGUESE CANYON EROSION CONTROL PROJECT ENVIRONMENTAL ASSESSMENT (1203 x 1900) RECOMMENDATION To authorize staff to begin proceedings for the formation of a Sewer Maintenance District to maintain a sanitary sewer system that is to be built in Abalone Cove. Chairman Kuykendall opened the public hearing. Member McTaggart moved to waive the staff report on this particular item. The motion was seconded by Member Byrd. There being no objection, Chairman Kuykendall so ordered. Ms. Lois Larue expressed great concern with regard to the redistribution of the approximately 50,000 cubic yards of earth material. In response to Ms. Larue's noted concern, it was noted by staff that experts in the field will be providing professional guidance. The time schedule for project was briefly reviewed. There being no objection, Chairman Kuykendall closed the public hearing. REGULAR BUSINESS MAINTENANCE OPTIONS FOR THE ABALONE COVER SANITARY SEWER SYSTEM (1900) RECOMMENDATION To authorize staff to begin proceedings for the formation of a Sewer Maintenance District to maintain a sanitary sewer system that is to be built in Abalone Cove. City Attorney Lynch reviewed staff's recommendation and the alternatives and provided clarification with regard to financing. Redevelopment Agency October 4, 1994 3 Ms. Sharon Hegetschweiter, President of the Portuguese Bend Community Association, thanked staff for forwarding all pertinent information with regard to this issue to her; advised the Members that the Association has not formulated a decision with regard to this matter; and stated that if a special assessment were set aside for replacement of capital improvements, such funds must then be utilized for capital I/ improvements and not maintenance. She also noted that maintenance should occur on an annual basis. Ms. Lois Larue spoke in opposition of any additional assessment. Member Byrd, seconded by Member McTaggart, moved to concur with the staff recommendation. There being no objection, Chairman Kuykendall so ordered.
