RDA MINS 19901115 ADJ MINUTES RANCHO PALOS VERDES REDEVELOPMENT AGENCY ADJOURNED REGULAR TOWNHALL MEETING NOVEMBER 15, 1990 The meeting was called to order at 7: 30 P.M. by Chairman Hughes at the Ladera Linda Community Center, notice having been given with affidavit thereto on file. After the pledge of allegiance to the flag, roll call was answered as follows: PRESENT: McTAGGART, BACHARACH, HINCHLIFFE, RYAN & CHAIRMAN HUGHES Also present were Executive Director Paul Bussey, Agency Attorney Steve Dorsey, Assistant RDA Attorneys Bill Strausz and Robin Harris, Agency 'Secretary Jo Purcell , Public Works Director George Wentz , City Engineer Charles Abbott, RDA Engineer Jon Taylor, and City Geologists Dr. Perry Ehlig. Chairman Hughes explained that the audience should submit their questions in writing and that answers to those questions would be integrated into the presentations by the various experts. RESOL. NO. RDA 90-24 - It was the consensus that SETTING FORTH CERTAIN this resolution should be COMMITMENTS RE HORAN the first item of business SETTLEMENT of the Board. Member McTaggart moved, seconded by Member Bacharach to adopt the proposed' resolution. RESOLUTION NO. RDA 90-24 OF THE RANCHO PALOS VERDES REDEVELOPMENT AGENCY SETTING FORTH CERTAIN COMMITMENTS IN CONNECTION WITH THE HORAN SETTLEMENT AGREEMENT was presented by title and read in its entirety by the Executive Director. Board inquiries centered on identifying what land the City owned in the Redevelopment Agency area that was valued at $1 , 015, 512; the breakdown of the value of the roads versus I/ the beach in this amount; and, if the City had been paying the ACLAD annual assessment. The motion to adopt the resolution was carried on the following roll call vote: AYES: BACHARACH, McTAGGART & CHAIRMAN HUGHES NOES: RYAN ABSTAIN: HINCHLIFFE GEOLOGIC STATUS OF City Geologist Perry Ehlig LANDSLIDES & VICINITY then made a slide presentation depicting the various stages of the slide abatement program and the effects of those efforts on the rate of movement. He then summarized both his Status Report On. The Stabilization Of The Portuguese Bend Landslide dated October 13, 1990 and the Status Report 1/ And Need For Proposed Remedial Measures for Abalone Cove Landslide, dated November 15, 1990. (Both of these reports are on file with the Agency' s Secretary. ) During the course of his presentation, Dr. Ehlig responded to written questions submitted by residents of the area. These questions focused on the following: why ACLAD could not do everything necessary in the Abalone Cove area; what were the future projects planned for the area; the status of the Army Corps of Engineer' s report; if the water coming from the Island View area could be directed out of the slide area; where the installation of sewers stood on the list of priorities; if the shoreline protection project would be benefitting other areas besides those properties being assessed; if the well north of P.V. Drive South had a rising water table and if it was an active pumping well and at what rate; and, why it was necessary to wait until the completion of all the studies before installing the sewers. (These written questions are on file with the Agency's Secretary. ) ABALONE COVE IMPROVEMENT Agency Attorney Dorsey DISTRICT - FORMATION then summarized the Reimbursement And Settlement Agreement entered into on October 13, 1987 between the City and the Redevelopment Agency and the County , of Los Angeles. (Copies of this agreement were made available to those in attendance at the meeting. ) During the course of his presentation, Mr. Dorsey also responded to the questions posed by the residents. Those questions focused on the following: how many plaintiffs are in the "Friends of the Bend" litigation; how long the project could be delayed;. why the assessment formula couldn't be changed; if the lien is paid off by a resident and the tax increment pays off the debt would the property owner be reimbursed for paying off the lien; if the tax increment money would be first spent to pay for the bonds; if P.V. Dr. South could be made into a toll road; how soon after a "qualified", person died would the 1/ joint tenant have to pay the lien; how the members of the Technical Panel are chosen; if property owners can buy their own liens; how residents of the community could serve as representatives on the Board; if, because of the Horan. litigants, the County and the City had entered into an agreement to place liens on resident' s property, whether the non-Horan litigants had lost their constitutional rights; RDA -2- NOVEMBER 15, 1990 and if the County Board of Supervisors do not vote in favor of the bond issue, why owners of vacant property should continue to make payments to ACLAD. (These written questions are on file with the Agency' s Secretary. ) TAX INCREMENT -REVENUE AUDIT - ABALONE COVE Frank Spevacek of the Rosenow Spevacek Group, LANDSLIDE ABATEMENT Inc. explained the PROJECT various tables in their November 15, 1990 Tax Increment Revenue Audit For The Abalone Cove Landslide Abatement Project: repayment schedule, the tax increment projection model , projected growth in the RDA fund deposits, J P ro 'ected draw down on bond proceeds, original debt service projected and debt service schedule in year 17 . (This November 15, 1990 report is on file with the Agency' s Secretary. ) RECESS & RECONVENE At 9: 35 P.M. Chairman Hughes declared a recess . The meeting reconvened at 9: 50 P.M. HORAN PLAINTIFFS Representing the Horan plaintiffs was their attorney Ron Beck, who voiced support for the resolution adopted by the Board. PORTUGUESE BEND Steve Goppert, HOMEOWNERS ASSOC. representing the Portu- guese Bend Homeowners Association requested that the Board prepare a plan of where the money has been spent and the anticipated expenditures. He suggested the Board adopt a policy to perform the projects in the order recommended by the panel of experts. Responding to an audience regarding citizen participation on the Board, Mr. Dorsey explained the conflict of interest restrictions placed on board members should they live in the Redevelopment Agency area. Sharon Hegetschweiler, 6 Clovetree Place, suggested that the Board appoint Steve Goppert to serve on the Board and requested that the citizens have a bigger part in gathering I/ information to be considered by the Board. RDA -3- NOVEMBER 15, 1990 John Horn, 3 Plum Tree, questioned the equity of the assessment formula on homes versus vacant property.
