CC RES 1973-031 RESOLUTION NO. 31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES RE CONTRACT FOR BUSINESS LICENSE COLLECTION ENFORCEMENT SERVICES OF THE COUNTY OF LOS ANGELES THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES RESOLVE AS FOLLOWS: Section 1. The City Council of the City of Rancho Palos Verdes pursuant to the terms and provisions of that written agreement entitled "General Services" dated September 7, 1973, entered into by and between the County of Los Angeles and the City, does hereby request the County of Los Angeles to provide business license collection, investigation and enforcement services when requested by the City, together with other services necessarily related thereto. Section 2. It is hereby requested that the Board of Supervisors of the County of Los Angeles approve and authorize the performance of services requested in Section 1 of this resolution, subject to those terms and conditions set forth in said "General Services" agreement. Section 3. The City Clerk is directed to forward a certified copy of this resolution to the Clerk of the Board of Supervisors. APPROVED AND ADOPTED this 7th day of September, 1973. The County agrees, through the Tax Collector off' the County of Los Angeles, to provide business license services within the corporate limits of City to the extent and in the manner herein- . after set forth.Such services shall only encompass duties and functions of the type coming within the jurisdiction of and customarily ren- dered by the Tax Collector acting ex-officio as license collector of the County of Los An%e l`s under the Charter of said County and __the statutes of the State . • The level of service shall be that same basic level of ser-- vice that is and shall be hereafter during the term of this agreement provided for unincorporated areas of the County of Los . Angeles b y said Tax Collector as License Collector ex--officio. � 3 The rendition of such services, the standard of. performance - and other matters inc .dental to the performance of such services, and the control of personnel so employed, shall remain in the County. Yn event 61 dispute between the parties as to the extent of the duties and functions to be rendered hereunder, or the level and manner of performance of such service, the determina Lion thereof made by the Tax Collector of the County shall be final and conclusive as between the parties hereto. • $uch service shall include the enforcement of such municipal - - license ordinances as the City may adopt, as hereinafter provided for - . • 2. To facilitate. the performance of said functions, -it is . hereby agreed that the County shall have full cooperation and assistance from the City, its officers, agents and employees . . 3. For the purpose of performing said functions; County shall furnish and supply all necessary labor, supervision, equip- ment and supplies necessary to maintain the level of service to be rendered hereunder . . . - • • Notwithstanding anything hereinbefore contained, it ls agreed . that. in all instances- wherein special supplies, stationery, notices, forms and the like must be issued in the name of said City, the same shall be supplied by said City at its own cost and expense . • . • 2. • a . 4. All persons employed -In the performance of such services and functions for said Cit y shall be County employees and no City - employee as such shall be taken over by said County, and no per- son employed hereunder shall have any City pension, civil service, or any status or right: - ,For the purpose of performing such services and functions, and for the purpose of giving official status to the performance -thereof where necessary; every County officer and emplo gee • - engaged in the performance of any service hereunder shall be -deemed to be an officer or employee of said City while performing • services for said City, which services are within the scope of this agreement and are purely municipal functions . • • 5. Cit y any shall not be called upon to assume any liability for the direct payment of any salaries, wages, or other cowen- sation to any County personnel performing services hereunder for •_ said County, or any liability other than that provided for in this agreement . - -_ - - -- - - _ Except as herein otherwise specified, the . City shall not be liable for compensation or indemnity -to any County employee for injury or sickness arising out of his _ emp1oyment . •6. County, its officers and employees,- shall not be deemed to assume any liability for inter,tional or negligent acts of . said City or of any officer or employee thereof. • . 7. Unless sooner terminated as provided for herein, this agreement shall be effective on the date hereinbefore mentioned -3. • • c • • . . • . • . 4 and shall run for a period o f five (5) years thereafter. At the option of the City Council of,said' City, with the consent of the Board of Supervisors of said County, this agreement shall be - renewable for successive p eriods of not exceeding five (5). years each. . •- •In event City desires to renew this agreement for any sue- .ceedin• five-year period, the City Council, not later than g ,� P December 3 preceding next recedin - the expiration date of this agreement, shall notify the Board of Supervisors of County that it wishes - to renew the same, whereupon on said Board of Supervisors, not later than the last day of January, shall notify said City Council in writin g of its willingness to accept such renewal for an adds-- • tional five-year period or such other term. as it deems advisable, otherwise such agreement shall finally terminate at the end of -such five-year period. . Notwithstanding the provisions of this paragraph hereinbefore - set forth, either party may terminate this agreement as of the first day of July of any year upon notice in writing to the other : party of not less than two calendar months prior to the date of - such termination . • 8. Notwithstanding anything to the contrary herein contained this contract shall be sooner terminated at any time that any license ordinance of the City requires a license fee less than : provided by Ordinance No . 5860 entitled: - (a) The fee p y Count Y "An ordinance regulating and licensing businesses and other activities,." adopted November 27, 1951; County Ordinance No. 4729 entitled •lh... Pound O: dinance, adopted July 23, l9 46 and County . t 4. • 1 1 • Ordinance No. 4516 entitled "An Ordinance regulating the operations of sound vehicles and advertising vehicles, " adopted July 10, 1945, • for businesses, occupations, and activities the same or substan- . tially the same as those licensed, respectively by said County ordinances . (b) - A fee which the County Auditor..Controller finds to be . reasonable in amount to cover actual costs of collection and regulation in the case o.f businesses, occupations and activities which are neither the same nor substantially the same as any licensed by said County Ordinance No . 586o, said County Ordinance No . 4x'29 or said County Ordinance No. 4516, or where the extent of duties required for inspection are substantially increased over - ' . those required for similar County licenses . This contract shall also be sooner terminated if because of any amendments adopted by the Board of Supervisors to said Ordi.-- - nances Nos . 5860, 4729 or 4516, or because of a re-determination by the County Auditor-controller of the amount of a reasonable fee, any fees provided for by the City license orc lnancc become less than the respective fees provided in any of said ordinances or by the County Auditor-Controller unless, within one hundred and _ s twenty days after a request so to do by County, City so amends its license ordinance that no fee is less than provided for in this contract. This contract does not require the City to license every business or activity licensed by the County. . 9. Ordinance No . 451.6, and in the case of other businesses a a- . occu p tions and activities, is the same as the amount determined as - • hereinbefore provided by the County Auditor-Controller. Where the ; City license fees exceed such amounts, City agrees that County • may retain from such fees amounts equal to such amounts. and County agrees to pay the difference to the City. • 11 If, between the effective date of an amendment to any . of the County ordinances referred to herein, increasing the fee for any business or activity, or the determination of the County Auditor--Controller increasing such fee, and` the effective date of the amendment of the City license ordinance increasing such fee, the fee charged by the City is less than oharged . by the. County or determined by the County Auditor-Controller, the County shall retain all such license fees, not ' in excess of County 's increased fees, as full consideration for the services rendered . 12. The County agrees to keep _such books and -records in such form .and manner as the County Auditor-Controller of the County of Los Angeles shall specify.
