CC RES 1975-073 RESOLUTION NO. 7 5-7 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES GRANTING A CONDITIONAL USE PERMIT FOR A COLLEGE WHEREAS, Marymount Palos Verdes College has requested a con- ditional use permit to operate a non-profit, private two-year liberal arts community college at 30800 Palos Verdes Drive East, with the only improvements being internal rehabilitation to create academic and office facilities, exterior painting, mechanical and electrical repairs, and landscaping; and WHEREAS, the Planning Advisory Committee of the City of Rancho Palos Verdes has recommended its approval; and WHEREAS, after notice required by the City' s Zoning Ordinance, a public hearing was duly held on the requested conditional use per- mit on August 19 , 1975 , at which time all interested persons were given a full opportunity to be heard and to present evidence; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1. That, given the conditions contained herein and applying hereto, the requested use at the location proposed will not: a. Adversely affect the health, peace, comfort, or welfare of persons residing or working in the surrounding area, because the factors which present potential conflict with this finding, specifically the tennis courts, the abutting circular parking area, and the most northerly driveway access, have been duly prescribed for in Exhibit "A" of this Resolution; or b. Be materially detrimental to the use, enjoyment or valu- ation of property of other persons located in the vicinity of the site, for the same reasons expressed in (a) above, and because the use is not materially different from the present activities; or c. Jeopardize, endanger or otherwise constitute a menace to the public health, safety or general welfare, by the nature of its use or by its clientele; and Section 2 . That the proposed site being 22 acres is adequate in size and shape to accommodate the yards, walls, fences, and load- ing facilities, landscaping, and other development features as pre- scribed in this Resolution, or as is otherwise required in order to integrate said use with the surrounding area; and Section 3. That the proposed site is adequately served by: a. A well-developed arterial, Palos Verdes Drive East, of sufficient width and which is improved as necessary to carry the kind and quantity of traffic such use would gen- erate , and the existing facility has over 100 parking spaces and good vehicular access for the proposed use; and b. Other public and private service facilities as are required and are presently serving the existing facility. Section 4 . That the proposed use is not in substantial conflict with the General Plan in that: a. The proposed use is for a two-year private liberal arts community college; and b. The Land Use Plan of the General Plan of the City of Rancho Palos Verdes designates the subject property for Institutional Educational Usage. Section 5. For the foregoing reasons, the City Council of the City of Rancho Palos Verdes hereby grants a conditional use permit on the property located at 30800 Palos Verdes Drive East, whose legal descrip- tion is contained in Exhibit 11B" and is a part hereof, to operate Marymount Palos Verdes College in the above described manner and subject to the conditions prescribed in Exhibit "A" of this Resolution, said conditions being necessary to protect the health, safety, and general welfare in the District. PASSED, APPROVED AND ADOPTED this 2nd day of September, 1975. Mayo / ATTEST: City Cle k Or -2- Resolution No. 75-73 EXHIBIT A 1. The Director of Planning shall review and approve all final plans. 2 . The service road adjacent to the San Ramon properties shall be closed at Palos Verdes Drive East, and that a sign "faculty only" be placed at west entrance at the approach to service road from the front parking lot. 3. A grape stake or similar fence shall be erected along the property line from Palos Verdes Drive East to the first large planter area (approximately 300 feet) . 4 . The two planter areas at the parking circle shall be planted with additional buffer plantings; plantings shall not be trimmed up from the ground. 5. Additional planting shall be installed around the corner of Court #3 with the movement of that portion of fencing on Court #3 nearest the property line to provide a five foot planting area between that court and the property line. 6. Windscreens, a minimum of six feet in height, shall be installed and maintained on the southeast sides of Courts #3 and 4 and the northeast end of Court #3. 7. The hours of play on Court #3 shall be limited to week days only, from 9 a.m. to 4 : 30 p.m. 8. The courts shall not be lighted. 9. The fence and other apparatus shall be removed from the training court. 10. Use of the parking circle on the east side of the campus shall be restricted to faculty and staff only. -3- Resolution No. 75-73
