CC RES 1974-084 RESOLUTION NO. 74-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, GRANTING A CONDITIONAL USE PERMIT FOR A COMMERCIAL TENNIS FACILITY WHEREAS, Pettengill, Kamen and Associates have requested a con- ditional use permit for a commercial tennis facility on a leased portion of the Marymount Palos Verdes College campus; and WHEREAS, after notice required by the City's Zoning Ordinance, public hearings were duly held on the requested conditional use per- mit on August 6 and 20, 1974, and September 17, 1974 , at which time all interested persons were given a full opportunity to be heard and to present evidence. NOW, THEREFORE , the City Council of the City of Rancho Palos Verdes does hereby find, determine and resolve as follows : Section 1. Said real property is in the RA-1 District and the proposed use is permitted therein by conditional use permit . Said real property is described as a portion of the Marymount Palos Verdes College campus, situated at 6717 Palos Verdes Drive South, City of Rancho Palos Verdes, California. The area to be utilized under the permit is planned by the College for recreational use. Section 2. The site is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, landscaping and other development features prescribed in this resolution. The proposed courts would not be visible to more than ten residences, which are located on the South Side of Via La Cresta, from which the courts would be distant at least 330 feet. The site is at a substantially lower elevation than the adjacent residential area, and is partially isolated therefrom by the natural topography. 24" box trees, properly placed as a part of an approved landscape plan, would provide additional view and sound protection. Section 3. The site is adequately served by two major thorough- fares, Hawthorne Boulevard on the North and Palos Verdes Drive on the South, and streets of sufficient width and improved as necessary to carry the kind and quantity of traffic such use would generate, and by other public or private service facilities as are required. The additional traffic generated by the proposed use would not result in any substantial impairment of traffic circulation or safety. Section 4 . Based upon the evidence presented, the facilities to be located on and the uses to be conducted on said real property will not adversely affect the health, peace, comfort or welfare of persons residing or working in the surrounding area, or be materially detrimental to the use, enjoyment or valuation of property of other persons located in the vicinity of the site, or jeopardize, endanger or otherwise constitute a menace to the public health, safety or general welfare. Section 5 . For the foregoing reasons, the City Council of the City of Rancho Palos Verdes hereby grants to Pettengill, Kamen and Associates a conditional use permit to allow the construction and use of a commercial tennis facility on said real property subject to the following conditions, which conditions are necessary to protect the health, safety, and general welfare in the District: 1. . Final site, architectural, landscaping, irrigation, signing, lighting, and fence plans shall be approved by the Director of Planning. The landscaping plan shall provide for trees of not less than 24" box size to be planted in a pattern to provide maximum screening of the site from the nearest residences. 2. A minimum of five (5) percent of the paved parking area shall be devoted to interior planting areas. These planting areas shall have a minimum width of three (3) feet. All landscaped planters shall have a six (6) inch high concrete curb at the edge of any paved area. 3. Environmental Excise Tax shall be required, based on the square footage of the clubhouse. .,. 4 . No liquor shall be served on the premises. 5. There shall be no tournaments in the evening and no tournaments which do not included members, except for those operated by the college. 6. Courts one, two, three, four, and five shall not have windscreens. 7. The applicant shall pay for reconstruction of the left turn pocket on Hawthorne Boulevard to extend it from the present 60 feet to 250 feet plus the normal 90 feet reverse taper. 8. The driveway to Hawthorne Boulevard shall be re-striped. 9 . The six northern courts only may be lighted. 10. The lights shall be provided with shields which shall be subject to the approval of the Director of Planning and shall have a maximum of 30 footcandles measured at 42 inches above the court surface. There shall be separate switches for each court. 11. The court surface shall be such that it reflects a maximum of 11% of the light striking it. 12. The hours of court use shall be the following: a. After 7 a.m. every day. b. To dusk, on Saturday and Sunday. c. To 9 : 00 p.m. or dusk, whichever is later, on Monday through Friday. The City Council reserves the right to modify said hours upon review at the end of one year. -2- Resolution No. 74-84 Section 6. The Mayor shall sign this resolution and the City Clerk shall attest and certify to the passage and adoption thereof.
