CC RES 1976-053 RESOLUTION No. 76-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES GRANTING A CONDI- TIONAL USE PERMIT FOR A RECREATIONAL FACILITY WHEREAS, Cayman Development Company has filed application for a conditional use permit for a recreational facility, joint tennis court, on Lots 59 and 60 of Tract 27114, 30250 and 30256 Avenida Selecta, Rancho Palos Verdes; and WHEREAS, after notice required by the Development Code, a public hearing was duly held on August 3, 1976 , at which time all interested persons were given a full opportunity to be heard and to present evidence. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS : Section 1. Said real property is in the RS-3 District, and the proposed use is permitted therein by conditional use Permit pursuant to Section 9711 of the Development Code. Section 2. The site, totaling 32,000 sq. ft. , adequate in size and shape to accommodate the yards , walls or f:efices, land- scaping, and other features required by this Code, providing the fence around the tennis court is allowed in the normal, rear back. The two lots, at 16 ,000 sq. ft. each, exceed the minimum lot size (13, 000 sq. ft. ) required in the RS-3 District. . Addi- tional landscaping would provide screening from adjacent .uses . Section 3. The site is adequately served by the existing street and highway system, since the proposed use is accessory to the primary use, which is single family residential. Section 4. Based upon the evidence presented, the facility will not adversely affect the adjacent property or the permitted use thereof. Section 5. The proposed use is not contrary to the General Plan, which encourages private recreation facilities in appro- priate locations. Section 6 . For the foregoing reasons, the City Council of the City of Rancho Palos Verdes hereby grants to Cayman Development Company a conditional use permit to allow the construction and use of a joint tennis court with ten (10) foot high fence, recreational facility on said real property subject to the following conditions, which conditions are deemed necessary to protect the health, safety, and general welfare in the District: 1. Draft legal documents assuring joint use and mainte- nance shall be submitted to and approved by the City Attorney. Signed copies of the approved docu- ments shall be filed with the City. 2 . A landscaping and irrigation plan providing for appropriate buffer planting along the east and south sides of the court shall be approved by the Director and installed prior to final inspection of the court. 3. The block wall along the rear property lines shall be restored to good condition. 4. There shall be no lighting on the tennis court. 5. Maintenance Conditions: Court' s landscape and irrigation system are to be maintained in good condition and failure to do so will result in revocation of the conditional use permit thus requiring the tennis court to be removed at joint expense of property owners.
