CC RES 1977-007 RESOLUTION NO. 77-7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AP- PROVING TENTATIVE TRACT MAP NO. 32677 Whereas, Tentative Tract Map. No. . 32677 has been filed which would create ninety (9 0) home sites, for single family l dwelling g ly g units units, and one (1) 11. 9 acre common area, from an existing 14. 93 acre parcel; Whereas, the Planning Commission has reviewed this matter and has recommended approval, subject to Conditional Use 'Permit No. 19 and stated conditions; and Whereas, after notice issued pursuant to the rovisions p of I/ the City' s Development Code, a Public Hearing was held on January 8 y 1 , 1977, at which time all interested parties were given an opportunity present evidence. PP ty to be heard and to P NOW, THEREFORE, the City Council of the City of Rancho Palos Verdes does hereby find, determine and resolve as follows : Section 1: That the creation of 91 lots is consistent with - the Development Code and General Plan. Section 2: The proposed use of lots 1-90 is for single family attached dwelling units, while lot 91 will be commonly owned and maintained by a homeowners association. Such use is compatible with the objectives, policies, land uses i • P ses and programs identified in the General Plan. • Section 3: That the subject property is physicall y suitable to accommodate Tentative Tract No. 32677 in terms of design and density and will not result in substantial g bstantial environmental damage, based on compliance with the City' s Development Code and General Plan, and consideration of information contained in the appropriate ro riate Environmental Impact Report. Section 4: That the creation of lots and improvements will not jeopardize, endanger, or otherwise constitute a menace to the public health, safety or general welfare of persons in the surround- ing ing area, nor will it adversely affect the peace, health, safe • safety, or general welfare of the area, since physical improvements, dedications, Conditional Use Permit, and maintenance agreements are required. Section 5: There are no public easements which will be interfered with by the proposed subdivision. Section 6 : Dedications required by local ordinance are shown on the Tentative Map and/or set forth in the conditions attached hereto as Exhibit "A" . Section 7: That the City Council does hereby certify that the final Environmental Impact Report has certify • P p been completed in compliance with the C.E.Q.A. and state guidelines and that the Council has re- viewed and considered the contents of the report in reachin g its I/ ' decision. The Council further finds that the approval of this Tentative Tract Map will not have a significant adverse environmental impact. Section 8 : For the foregoing reasons, the City Council of the City of RAncho Palos Verdes hereby grants approval of Tentative Pp Tract Map No. 32677 subject to the attached conditions marked Exhibit, which are necessary to protect t y p the public health, safety, and general welfare in the area. A homeowners ' association shall be formed which complies with Chapter 1, Part 7 of the Development Code. A declaration of covenants , conditions, and restrictions both the City tractions shall be approved b y C ty Attorney and Director of Planning. The homeowners association shall also be responsible for main- taining all landscaping in the adjacent public right-of-way Highridge Road. y 2. A grading plan and application must be made and approved by the Director of Planning prior to filing of final a nal map. 3. Prior to issuance of building permits, submit a soil engineer ' s report on the d expansive properties of soils as such soils are defined by Building Code Section 2903 (d)proposed ( ) on all building sites in p oposed subdivision. 4. Drainage plans and necessary support documents to comply with the following requirements must be a pp roved prior to filing ling of a final map: a. Prohibit on-street parking on Street "A" and two-way sections of Street "B" . 19. Provide hydrants as indicated on plans on file with the Los Angeles County Fire Department. These hydrants shall meet all specifications, in terms of type, design, location, water flow, finish, and any other requirements as deemed necessary by the Fire Department. A Fire Department representative shall inspect and test installation of hydrants. In the event additional water mains are necessitated to service required hydrants, they shall meet Fire Department requirements. Prior to installation of the water system, the City Engineer should review the system design to determine if it will provide required fire flow and duration. Upon completion of the system the Fire Department should conduct fire flow test. Bonds of faithful performance should be with the City to ensure installation of fire facilities. Provide 20-foot hard surface emergency access from "A" Street to the existing access easement to the property on the south. If gated, provide a 15-foot wide gate. 20. Parkland dedication fee of $67, 515. 07 shall be paid to the City prior to the approval of the final tract map. 21 . The developer shall post a cash .deposit or bonds or a combination thereof in an amount sufficient to cover the cost of full improve- ments on Highridge Road, including but not limited to sidewalk, curb and gutter, A.C. paving, median curb and gutter, and one half of the median (landscaping and bikeway) .
