CC RES 1977-079 RESOLUTION NO. 77-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, DENYING VARIANCE NO. 14 WHEREAS, the City received application for Variance No. 14 to allow an overheight fence in the side setback; and WHEREAS, the Planning Commission denied said Variance; and WHEREAS, the denial was appealed to the City Council and the Council held hearings on this matter on August 2 and September 20, 1977, at which time all interested parties were given an opportunity to be heard and present evidence; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND AS FOLLOWS: Section 1: The City Council has reviewed the application and de- termines that all of the required findings cannot be made, as follows: 1) The 10-foot fence on top of an 8-foot barrier cannot be con- sidered a requirement based on exceptional or extraordinary circumstances; and 2) An 18-foot combination of retaining wall and fence is not re- quired for the preservation and enjoyment of a property right, as the normal tennis court fencing is considered to be 12 feet. Section 2: The City Council of the City of Rancho Palos Verdes hereby denies Variance No. 14. APPROVED AND ADOPTED this 4th day of October, 1977. ATTEST: 7#4#141:1 LEONARD G.
