A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES, CALIFORNIA, GRANTING CON-
DITIONAL USE PERMIT NO. 26, MODIFYING CONDITIONAL
USE PERMIT NO. 4
WHEREAS, the Peninsula Racquet Club has appealed denial of this
permit to the City Council; and
WHEREAS, after notice required by the City's Zoning Ordinance,
public hearings were duly held on the appeal of the conditional use permit on
September 8 and October 18, 1977, at which time all interested persons were
given a full opportunity to be heard and to present evidence.
NOW, THEREFORE, the City Council of the City of Rancho Palos Verdes
does hereby find, determine and resolve as follows:
Section 1. Said real property is in the Institutional District and
the proposed use is permitted therein by conditional use permit. Said real property
is described as a portion of the Salvation Army facility, situated at 30840 Hawthorne
Boulevard, City of Rancho Palos Verdes, California.
Section 2. The site is adequate in size and shape to accommodate the
yards, walls, fences, parking and loading facilities, landscaping and other devel-
opment features prescribed in this resolution. The proposed courts would not be
visible to more than ten residences, which are located on the south side of Via La
Cresta, from which the courts would be distant at least 330 feet. The site is at a
substantially lower elevation than the adjacent residential area, and is partially
isolated therefrom by the natural topography. Twenty-four inch box trees, properly
placed as a part of an approved landscape plan, would provide additional view and
sound protection.
Section 3. The site is adequately served by two major thorough-
fares, Hawthorne Boulevard on the north and Palos Verdes Drive on the south, and
streets of sufficient width and improved as necessary to carry the kind and quantity
of traffic such use would generate, and by other public or private service facilities
as are required. The additional traffic generated by the proposed use would not
result in any substantial impairment of traffic circulation or safety.
Section 4. Based upon the evidence presented, the facilities to
be located on and the uses to be conducted on said real property will not adversely
affect the health, peace, comfort or welfare of persons residing or working in
the surrounding area, or be materially detrimental to the use, enjoyment or valua-
tion of property of other persons located in the vicinity of the site, or jeopar-
dize, endanger or otherwise constitute a menace to the public health, safety, or
general welfare.
Section 5. For the foregoing reasons, the City Council of the City
of Rancho Palos Verdes hereby grants to the Peninsula Racquet Club a conditional
use permit modifying certain conditions in the Conditional Use Permit No. 4:
Condition No. 9. shall be deleted.
Condition No. 10. shall be modified as follows:
The existing six courts and the additional
currently unlighted six courts shall be lit
with Bieber lights or equivalent fixtures.
The lights shall have a maximum of 30 foot-
candles measured at 42 inches above the court
surface. There shall be separate switches
for each court.
Condition No. 12. The hours of court use shall be as follows:
a. After 7 A.M. every day.
b. To dusk every Sunday.
c. To 7:30 P.M. or dusk, whichever is later, on Saturday.
d. To 9:00 P.M. or dusk, whichever is later, or Monday
through Friday on the 6 courts closest to Hawthorne
Boulevard.
e. The six courts nearest the ocean side of the hill
may be lit to 8:00 P.M. or dusk, whichever is later,
Monday through Friday.
This condition is modified on the condition that the dead trees
on the upper slope be replaced and maintained with 24-inch box trees and that
all trees be properly maintained.
Section 6. The Mayor shall sign this resolution and the City
Clerk shall attest and certify to the passage and adoption thereof.
