CC RES 1978-064RESOLUTION NO. 78 -64 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES APPROVING SUPPLEMENT NO. 1, REVISION NO. 1 TO LOCAL AGENCY -STATE AGREEMENT No. 07 -5413 THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES RESOLVE AS FOLLOWS: Section 1: The City Council hereby approves the attached form of supplement No. 1, Revision No. 1 to Local Agency -State Agreement No. 07 -5413 for roadway construction on Palos Verdes Drive West. Section 2: The City Council hereby authorizes and directs the Mayor and City Clerk to execute said supplement on behalf of the City of Rancho Palos Verdes. Section 3: The City Clerk shall certify to the adoption of this Resolution. AID URBAN Svsmi PROJECTS IN THE CITY OF RANCHO PALOS VERDES Local Agency Pursuant to the Federal Aid for Urban Systems Acts, the attached "Program" of Federal Aid Urban System Projects marked "Exhibit 8" is hereby incorporated in that Master Agreement for the Federal-Aid Program which was entered into between the above named LOCAL AGENCY and the STATE on December 6, 1977 and is subject to all of the terms and conditions thereof. All maintenance, involving the h sical condition P Y nand the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the City of Rancho Palos Verdes � � intervals at regular intervals or as required for efficient operation of the completed improvements. 2. The City of Rancho Palos Verdes will advertise, award and administer this project. 3. The City of Rancho Palos Verdes share of matching funds for Preliminary Engineering will be 100 percent of the amount remaining after Federal participation. DH -OLA -411 (5/77) EXHIBIT B. Page 2 August 21, 1978 4. The actual funds for the project will be set up on the basis of contract prices after the bids for the work - have been opened. In awarding, or agreeing to award the contract, the City agrees to use maximum Federal funds participation in the detail estimate. 5. The availability of Federal Funds will be subject to meeting deadlines and /or other conditions as may be imposed by the Director upon the recommendation of the FAU Advisory Committee. 6. The use of Federal Funds for this project is subject to the project being selected as part of the FAU Program for Los Angeles County. . 7. Funds required to match Federal Highway Funds for construction and construction engineering for this project will be provided by the State as authorized by Item 151.3 of the Budget Act of 1978 and allocated by the California Transportation Commission. 8. In the event Item 151.3 funds less than the amount shown are required as a result of a low bid, the excess will be returned to the county allocation. . 9. In the event Item 151.3 funds greater. than the amount shown are required as a result of a high bid, the required amount may be added subject to the availability of funds in the county allocation. 10. Item 151.3 funds in the project will be limited to the amount required to match the Federal Funds shown in the Detail Estimate which is prepared when bids are opened. 11. After completion of the final cost accounting for a project, any unexpended Item 151.3 funds will revert to (1) the county allocation provided that the final cost accounting is completed before April 1, 1979; or (2) the statewide allocation provided that the final cost accounting is completed between April 1, 1979 and June 30, 1979; or (3) to the Item 151.3 appropriation provided that the final cost accounting is completed subsequent to June 30, 1979.
