CC RES 1979-012 RESOLUTION 79-12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES REQUESTING THE PUBLIC UTILITIES COMMISSION TO REQUIRE A WAIVER OF THE FACILITIES CHARGE FOR STREET LIGHTS TURNED OFF DUE TO LACK OF FUNDS CREATED BY PASS- AGE OF PROPOSITION 13 WHEREAS, the impact of Proposition 13 has been to severely limit revenues available to local governments historically received from the ad valorem tax; and WHEREAS, street lights provided by most local governments in the Los Angeles area County have historically been funded by ad valorem taxes; and II/ WHEREAS, ad valorem taxes to finance these street'lighting systems will be reduced in the magnitude of 70 percent; and WHEREAS, many of these street lights were installed at the request of the benefiting property owners; and WHEREAS, the continued operation of street lights is necessary for the safety and convenience of the public; and WHEREAS, the City and the County are investigating methods to provide alter- nate funding for the cost of operating these lights; and WHEREAS, the alternate methods may involve the passage of legislation and/or the vote of the affected electorate; and WHEREAS, it may be necessary to turn off many of the lights in the interim while alternate methods of financing are being developed and implemented; and WHEREAS, a great number of these street lights are owned and operated by the Southern California Edison Company under contract to the districts; and WHEREAS, in 1974, in connection with energy crisis measures, the Public Utilities Commission approved a facilities charge, which currently exceed three dollars per light per month, that Edison may assess for lights that are turned off but left in place for future use; and WHEREAS, in most cases the facilities charge would exceed the amount of tax revenue anticipated to be received under Proposition 13 for each light making it impractical to leave the lights in place while alternate funding is being pur- sued; and WHEREAS, charges for removal and reinstallation of the lights, ranging up to several hundred dollars per light depending on the type, could be subsequently assessed against the districts if this course is followed; NOW, THEREFORE, BE IT RESOLVED, that the Public Utilities Commission be requested to take action to require a waiver of the facilities charges until such time as alternate funding methods are adopted or, in the alternate, a decision is reached to leave the lights dark. BE IT FURTHER RESOLVED, that the City Clerk be instructed to notify the Public Utilities Commission and the Southern California Edison Company of this action. MAYOR ATTEST: LEONARD G.
