A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES INSTITUTING PROCEEDINGS, ACKNOWL-
EDGING WAIVER OF DEBT LIMIT INVESTIGATION PROCEEDINGS
AND DIRECTING PREPARATION OF RESOLUTION OF INTENTION
FOR THE CONVERSION OF EXISTING OVERHEAD ELECTRIC,
TELEPHONE, AND CABLE TELEVISION FACILITIES IN DALADIER
DRIVE AND OTHER RIGHTS OF WAY. (RANCHO PALOS VERDES
IMPROVEMENT DISTRICT NO. 4)
WHEREAS, a petition for proceedings for conversion of existing overhead
electric and communication facilities to underground locations in Daladier Drive and
other rights of way, signed by persons representing ownership of 75% of the area of
lands in the district hereinafter proposed to be assessed for the improvement, includ-
ing waiver of debt limit proceedings required by Division 4, Streets and Highways Code
has been presented to the City Council of the City of Rancho Palos Verdes; and
WHEREAS, said petition has been signed by more than five owners of assessable
land in the proposed assessment district thereby satisfying the requirements of Section
5896.6, Division 7 of the Streets and Highways Code of the State of California; and
WHEREAS, the City Clerk of the City of Rancho Palos Verdes has, subsequent to
the checking of said petition, executed a certificate of sufficiency and has presented
said petition and said certificate to the City Council in compliance with the require-
ments of Sections 5896.7 and 5896.8 of said Division 7, Streets and Highways Code; and
WHEREAS, the intent of the City Council is to acknowledge the waiver of debt
limit investigation proceedings pursuant to said Section 2804; and
WHEREAS, it is desirable that the City of Rancho Palos Verdes now institute
proceedings and direct preparation of a resolution of intention for the proposed improve-
ment; and
WHEREAS, the County Engineer of the County of Los Angeles has been appointed
City Engineer of the City of Rancho Palos Verdes and will thus provide certain acts,
services and forms in these proceedings; and
WHEREAS, the City of Rancho Palos Verdes will be reimbursed for this compen-
sation from the improvement fund to be established for this improvement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES RESOLVES AND DETER-
MINES THAT:
1. The public interest and convenience require proceedings for conversion of
existing overhead electric and communication facilities to underground in Daladier Drive
and other rights of way within the assessment district proposed therefor, substantially
as indicated on the map attached to the petition requesting the improvement.
2. That said petition filed with the City Council is adequate and signed by
the required number of owners to waive the debt limitations prescribed by Division 4,
Streets and Highways Code. Therefore, the provisions of said Division 4 do not apply.
3. Proceedings are hereby instituted for the conversion of existing overhead
electric and communication facilities to underground locations in Daladier Drive and
other rights of way within the assessment district proposed therefor, substantially as
indicated on the map attached hereto.
4. The district of lands proposed to be specially assessed to pay the cost
of said improvement shall include in general the area included within the bound line as
shown on said map.
5. The City proposed to pay no money toward the total cost of the improve-
ment from any source other than the funds generated from special assessments upon
benefited property.
6. This project shall be known as Rancho Palos Verdes Improvement District
No. 4, Daladier Drive et al.
7. The City Engineer is hereby requested to prepare the resolution of
intention, all other necessary resolutions, reports, plans, specifications, estimates,
maps, notifications, proposal forms, contract forms, bond forms and any other acts,
service or forms necessary to complete this project in accordance with the provisions
of Division 7 of the Streets and Highways Code under which the proceedings are to be
conducted.
8. The City Engineer is hereby directed to negotiate agreements with the
Southern California Edison Company, General Telephone Company of California and Palos
Verdes Cable, T.V. which shall provide among other things for the supplying of plans
and specifications said agreements to be in accordance with the provisions of Section
5896.9 of Division 7, of the Streets and Highways Code.
9. The City of Rancho Palos Verdes will reimburse the County of Los Angeles
for all costs incurred by the County Engineer on this project after this date in accor-
dance with the General Services Agreement.
10. The City Clerk is directed to forward one certified copy of this resolution
to the County Engineer.
